BACKGROUND The Contra Costa County Animal Services Department Volunteers was formed 20 years ago to help re-unite owners with lost animals and assist the public in adopt- ing appropriate pets from the County's Animal Shelters. Since the program' s incep- tion, over 79,000 animals have been re-united with their owners and over 74,000 animals have found homes through the efforts of this group of dedicated citizens. WHEREAS: Breastfeeding is the Gold Standard for the nurture and nutrition of infants, providing health, economic and social benefits to the infant, mother and family that remain unduplicated by any artificial feeding; and WHEREAS: Breastfeeding success depends on learned skills and the respect and support of women and men whose lives, personal and professional, touch those of the mother and infant; and WHEREAS: Progress in breastfeeding success rates is being made in Contra Costa towards the National Healthy 2000 goals of 75%of newborns and 50%of infants 6 months old being breastfed, in that combined breastfeeding rates at WIC, the Women Infant and Children Supplemental Food Program has shown a significant increase from approximately 30% in 1993 to 38% in 1996, a triumphant measure for our higher risk families; and WHEREAS: Merrithew Memorial Hospital and Clinics continues to be the leader in its efforts to provide Baby Friendly services to families in Contra Costa County and become certified as defined by UNICEF and the World Health Organization; and WHEREAS: Breastfeeding is a daily commitment to the life and well being of an infant and family, a precious gift of love often overshadowed and made difficult by a society dependent on commercial artificial milks and trappings that promote the separation of infant and parent; and WHEREAS: Valentines Day is celebrated as a symbol of love,by old and young alike, it is appropriate to take this opportunity to recognize that special relationship nurtured by breastfeeding. Therefore be it resolved by the Board of Supervisors that it hereby declares its continuing support and encouragement of Baby Friendly breastfeeding promotion activities and proclaims Valentines Day and the month of February as a time to celebrate Breastfeeding,A Gift of Love. By Deputy Clerk SD.2 PUBLIC WORKS DEPARTMENT CONTRA COSTA COUNTY DATE: February 4, 1997 TO: Board of Supervisors FROM: J. ichael Walford, Publ r � SUBJECT: Report Re: State Highway 4 Willow Pass Grade Widening and Lowering Project Pursuant to procedure approved by Board Order, dated November 1, 1988, the Public Works Director sent a Notice of Intention to Adopt a Resolution of Necessity for acquisition by eminent domain of real property in the Pittsburg area for highway construction, and set February 11, 1997, at 10:30 a.m. as the date and time affected owners may appear and be heard as to matters specified by law under C.C.P. Section 1245.235 as set forth below. Upon recommendation of County Counsel, the following report is made for the Board's information and consideration prior to taking action upon said hearing. 1. Proposed Project - The project consisted of widening State Route 4, between the Willow Pass Road undercrossing in Concord to 0.1 miles west of the Bailey Road undercrossing, from four through lanes to six through lanes, providing land rights for two future high occupancy vehicle lanes and for a forty-four foot wide median for the East County BART extension, as well as constructing two auxiliary truck climbing lanes between the two Willow Pass Road interchanges. In addition a new partial cloverleaf interchange was constructed at Willow Pass Road in West Pittsburg. In order to clear title to the right of way needed for the project, it is necessary for the County to exercise its power of eminent domain. Pursuant to Section 1245.235 of the Code of Civil Procedure, notice was given to the following persons: Richard Traverso Adco Outdoor Advertising P.O. Box 368 Belmont, CA 94002-0368 This notice consisted of sending by first-class and certified mail on January 16, 1997, a Notice of Intention which notified these owners that a hearing is scheduled for February 11, 1997, at 10:30 a.m. in the Board's Chambers, at which time they may appear to be heard on the matters referred to in the notice. II. Scope of Hearinq Per C.C.P. Section 1245.235 A. Public Interest and Necessity require the proposed project. It was necessary to improve traffic flows on State Route 4 and to provide the necessary right-of-way for the extension of the BART system to Bailey Road in Pittsburg. B. The proiect is planned and located in the manner that will be most compati- ble with the greatest public good and the least private iniurv. The project was planned in accordance with Caltrans Route Concept Report. The alignment was chosen as the the most beneficial route with the intent to minimize impacts to the property owners as a result of the findings from the environmental studies. C. The property sought to be acquired is necessary for the project, The properties to be acquired were determined necessary to provide for the improvements described in Item 1, above. Ili. Recommended Action A. Board to ask if any notified property owners wish to be heard as to the three items specified in Section 11 above. B. Upon completion and closing of the hearing, it is recommended that the Board make the findings and determinations listed under 11 A, B and C above, make an additional finding that the offer of compensation required by Section 7267.2 of the Government Code has been made to the owner or owners of record, adopt a Resolution of Necessity to acquire the required property by eminent domain and direct the Board Clerk to file a copy of this report. Sec. 1245.230) 5 6 The Board of Supervisors of Contra Costa County, California, by vote of two-thirds 7 or more of its members, RESOLVES THAT: 8 Pursuant to Government Code Section 25350.5 and Streets & Highways Code g Section 943, Contra Costa County has constructed a road reconstruction project, a public 10 improvement, to widen and lower the grade of State Route 4 and provide related slope and 11 drainage improvements in the Pittsburg area, and, in connection therewith, needs to acquire 12 certain interests in real property. 13 The property to be acquired consists of a leasehold interest for an outdoor 14 advertising display and is generally located in the Pittsburg area. The said property is more 15 particularly described in Appendix "A";, attached hereto and incorporated herein by this 16 reference. 17 On January 16, 1997, notice of the County's intention to adopt a resolution of 18 necessity for acquisition by eminent domain of the real property described in Appendix "A" 19 was sent to persons who have represented that they are the owners of the leasehold interest. 20 The notice specified February 11, 1997, at 10:30 a.m. in the Board of Supervisors Chambers 21 in the Administration Building, 651 Pine Street, Martinez, California, as the time and place of 22 the hearing thereon. 23 The hearing was held at that time and place, and all interested parties were given 24 an opportunity to be heard and based upon the evidence presented to it, this Board finds, 25 determines and hereby declares the following: 26 1 . The public interest and necessity require the proposed project; and 27 2. The proposed project is planned and located in the manner which will be most 28 compatible with the greatest public good and the least private injury; and 1 SD, 2 1 3. SR4/Railroad Avenue Interchange: a $50 million project to reconstruct the Railroad Avenue Interchange, widen the freeway to west of Loveridge Road to eight lanes, and median space for a future BART Station at Railroad Avenue. E. SR4 from Cummings Skyway to 1-80: an additional $73 million would be required to upgrade this section of SR4 to a 4 lane full freeway standard. 3. FISCAL IMPACT No impact to the General Fund. Potential for new funds for transportation improvement projects in Contra Costa. BACKGROUND/REASONS FOR RECOMMENDATIONS On January 14, the Board of Supervisors referred to the Transportation Committee a report from the Public Works Director regarding prospective transportation improvement projects for the 1998 State Transportation Improvement Program (STIP). In the past, the California Transportation Commission has used the STIP to allocate hundreds of millions of dollars in transportation improvements. As 1997 unfolds, there is a potential opportunity to direct significant state transportation funding toward projects along the State Route 4 corridor in Contra Costa County. On January 16, 1997, the Contra Costa Transportation Authority (CCTA) initiated the 1998 STIP process in Contra Costa by issuing a Call for Projects letter which invited each city, transit operator, and the County to nominate regionally significant projects in Contra Costa for the 1998 STIP (see Exhibit A). This is the first of several reports from the Transportation Committee to the Board of Supervisors regarding the 1998 STIP. Exhibit B provides a preliminary schedule of the 1998 STIP process, identifying key decisions anticipated during the coming months. The California Transportation Commission (CTC) will ultimately review and adopt the 1998 STIP after receiving input from agencies and commissions statewide. The Metropolitan Transportation Commission (MTC) will prepare a Regional Transportation Improvement Program (RTIP) to be submitted to the CTC for inclusion in the 1998 STIP. The RTIP will represent the consensus of the nine Bay Area counties on the region's project priorities for the STIP. As the Congestion Management Agency for Contra Costa, the CCTA will represent Contra Costa interests at both MTC and CTC. CCTA, following the Call for Projects to transit operators, cities, and the County, will evaluate the submitted projects based on established criteria from MTC, hold a public hearing, and then adopt a list of projects for submittal to MTC. In previous years, the Board of Supervisors has provided input to the STIP process from a countywide perspective. sD,� State Transportation Improvement Program February 3, 1997 Page Four BACKGROUND/REASONS FOR RECOMMENDATIONS (continued) Basis for the Candidate Project List On December 13, 1994 the Board established the State Route 4 Corridor, from Interstate 80 to Interstate 205 in San Joaquin County, as the highest priority for future transportation funding. This finding was based on the need to improve safety, reduce congestion, and improve goods movement within the only corridor which provides an east-west traverse through the entire County. These conditions on State Route 4 Corridor have not changed since the Board's finding in December 1994. Accordingly, the Transportation Committee recommends that the Board reaffirm its commitment to the State Route 4 Corridor and urge the CCTA to focus the 1998 STIP on improvements within the corridor. Nominating other projects would dilute the potential to pool state funding for needed improvements for the State Route 4 Corridor. While the Transportation Committee acknowledges that the 1-680 HOV Lane Project is a high priority project, we recommend that the Board ask both CCTA and MTC to consider programming Toll Bridge Funds to construct this project instead of using Contra Costa's share of Flexible Congestion Relief funds. An operational analysis for the 1-680 corridor (1-80 in Solano County to SR 24), prepared by Caltrans as part of the Martinez-Benicia Bridge Project's environmental review, identified the HOV lanes as one of several needed improvements for 1-680 to make the proposed new bridge more efficient. The Benicia Martinez Bridge Project environmental document listed the 1-680 HOV project on a list of "unfunded complementary improvements". This indicates that the 1-680 HOV Lane Project is more directly associated with the Martinez-Benicia Bridge Project and, therefore, should qualify for funding from the Toll Bridge Revenue Fund. Exhibit C provides project fact sheets for the proposed improvements to the State Route 4 Corridor, including cost estimates and funding shortfalls for each project. The Transportation Committee believes that these candidate projects would measure well against the previously mentioned evaluation criteria. I want to emphasize that this effort is very preliminary. We do not yet know what programming rules the CTC or MTC may adopt, nor do we know precisely the year in which funding might be available. But we do believe that it is prudent to create an inventory of potential candidate projects. Following the adoption of programming rules by the MTC and CTC, the Authority may elect to solicit formal applications from this pool of projects in March or April. For your information I am also enclosing as an attachment,the statutory language defining the FCR program. Please note that time projects which cost-effectively alleviate congestion by increasing the capacity of rail, local arterial or state highways best reflect the principal intent of the flexible congestion relief funding category. We are also attaching two additional documents for your consideration, review and comment. First, Attachment C is proposed screening criteria submitted by the Contra Costa Economic Partnership, and briefly discussed by the Authority at its January 15 meeting. The Economic Partnership, and the Contra Costa Council, suggested that these criteria could be used in a screening process to qualify projects as candidates for Contra Costa's nominations for the 1998 STIP. Attachment D reflects the initial comments of the Authority's Technical Coordinating Committee (TCC), which reviewed preliminary STIP information at the Authority's request at its January 16, 1997 meeting. All proposed criteria will be fully considered by the Authority,probably at its March meeting,before final decisions are made. We would appreciate your comments on the proposed criteria and the TCC's initial comments, along with your identification of potential candidate projects, for further consideration by the TCC, RTPCs and Authority. Should you or you staff have questions relating to this request,please direct them to Paul Maxwell, Deputy Director for Projects.
