SUBJECT: Approval of resolution to implement Statutes 1997, Chapter 587, Section 1, authorizing
County participation in a new $1.00 fee on vehicle registrations to fund Automated
Mobile and Fixed location Fingerprint Identification System equipment as authorized by
CVC 9250.19
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
1. RECOMMENDED ACTION:
1. Approve the,attached resolution authorizing County participation in a new fee collected on vehicle
registrations effective January 1, 1998 which will fund the Automated Mobile and Fixed location
Fingerprint Identification System. Resolution 97/668
2. Authorize the County Auditor-Controller to establish an interest bearing Cal-ID Update Special
Revenue Fund for deposit of such funds received from the State for appropriation by the Board of
Supervisors based upon the recommendation of the .Contra Costa Cal-ID Regional Access Network
Board.
Il. FINANCIAL IMPACT.
State of California Department of Motor Vehicles statistics reveal that as of December 1996 there were
742,157 "fee paid'vehicles registered in Contra Costa County. This legislation provides that, once the
attached resolution is adopted and filed with the Department of Motor Vehicles, they will add a $1.00 fee
to each subsequent vehicle registration or renewal in Contra Costa County. After a deduction, for any
administrative costs, DMV will remit the balance to the county for use in the Automated Mobile and Fixed
location Fingerprint Identification System. There will be a one time, up-front, "computer set-up charge"
which will be deducted from registration revenues by DMV before the funds are allocated to the county.
According to the Department of Motor Vehicles, it will take 4 or 5 months from the time the resolution is
Filed until funds are received by the county.
THIS PROGRAM SHOULD PROVIDE APPROXIMA TEL Y$300,000.00 IN FIRST YEAR FUNDS AND
AMOUNTS IN EXCESS OF$74Z 157.00 ANNUALLY THEREAFTER, DEPENDING ON THE NUMBER
OF VEHICLES REGISTERED IN THE COUNTY. THE FEE AUTHORITY WOULD SUNSET AND BE
REPEALED ON JANUARY 1, 2003.
REASONS FOR RECOMMENDATION.
SB 720, enacted as Statutes 1997, Chapter 587, Section 1 will add Section 9250.1.9 of the California
Vehicle Code effective January 1, 1998 providing that upon adoption of a resolution by the Board of
Supervisors, a new $1.00 fee on vehicle registrations in the County will be imposed and continuously
appropriate to fund local programs that enhance local law enforcement to provide Fingerprint identification.
The funds raised by this fee are to be used exclusively for programs that enhance the capacity of local
law enforcement to provide automated mobile and fixed location fingerprint identification of individuals who
may be involved in vehicle-related crimes and other crimes committed whle operating a motor vehicle.
Automated fingerprint identification systems are used to verify the identity f individuals during arrests and
bookings and for warrants;to identify crime suspects through latent prints recovered�from crime scenes;
and for coroners to identify John and Jane Does. The current county Calb automated fingerprint system
is over 13 years old, and it uses computer technology at is er 16 years old.

Ill. REASONS FOR RECOMMENDATION (CONT
The operation of the Cal-ID system is funded under the provisions of a User's Agreement with
contributions by the county and all cities in the county. These contributions only cover the cost of
operation and are not sufficient to fund the replacement of our existing system. There is no identified
funding source to replace the system's outmoded equipment. Technology has surpassed the usefulness
of the required Cal-ID system equipment making it antiquated, and increasingly more costly to maintain
and operate. This equipment is near capacity in terms of memory, is frequently in disrepair, and if not
updated or replaced, will cease to operate in 2000 due to the "Year 2000"issue.
Funds collected pursuant to section 9250.19 would permit the installation of live scan devices at major
booking and arrest facilities throughout city and county law enforcement agencies to speed the entry of
fingerprints into Cal-ID and the identification process of arrestees. This would allow more immediate
knowledge of past criminal histories, outstanding warrants, and linkages to other crimes. The equipment
would also enable quicker classification of inmates and determinations of eligibility for releases of
an estees on their own recognizance.
The information from these fingerprint identification programs is to be made available by the local law
enforcement agency to any local public agency that is required by law to obtain a criminal history
background of persons as a condition of employment with that local public agency. For example, the
additional funds raised by the new fee will permit the timely identification of individuals who seek
employment with school districts to insure the applicant has no inappropriate criminal history, before being
allowed contact with students.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Failure to approve this recommendation would result in the inability of county law enforcement to take
advantage of this funding source, which can be enacted at the local level by board resolution.
Negative action would perpetuate the inability of the county to respond to local law enforcement needs
in the face of continuing budget cuts.
Without this vital fingerprint identification link, law enforcement will suffer serious degradation in
investigative efforts to identify coroner bodies, and in the attempts to identify, locate and prosecute
criminals who commit crimes against the citizens of Contra Costa County.

WHEREAS, California counties are authorized to operate automated fingerprint identification
systems; and
WHEREAS,the current Cal-ID automated fingerprint system is over 13 years old; uses
computer technology that is over 16 years old, and is nearing the end of its useful life; and
WHEREAS, operation of the Cal-ID system is funded under the provision of a User's
Agreement with contributions by the County and by all the cities in the County; and
WHEREAS, The State of California has enacted California Vehicle Code Section 9250.19, which
authorizes the Department of Motor Vehicles to increase and collect an annual one dollar fee for
vehicles registered or renewed in Contra Costa County to be used exclusively for the purchase
and operation of new Cal-ID automated fingerprint identification equipment to identify individuals
who may be involved in vehicle-related crimes and other crimes committed while operating a
motor vehicle; and
WHEREAS, implementation of California Vehicle Code Section 9250.19 would permit the
installation of live scan devices at major booking and arrest facilities throughout the city and
county law enforcement agencies to speed the entry of fingerprints into Cal-ID and the
identification process of arrestees; and
WHEREAS, Cal-ID live scan fingerprint devices would provide for the timely identification of
persons who seek employment with school districts, before the applicant contacts students, to
insure that the applicant has no inappropriate criminal background; and
WHEREAS, California Vehicle Code Section 9250.19 requires that the Board of Supervisors
adopt a Resolution establishing the $1.00 per vehicle registration fee prior to the collection of the
fee; and
NOW, THEREFORE, BE IT RESOLVED that the Contra Costa County Board of
Supervisor's hereby formally requests the State of California Department of Motor Vehicles
implement section 9250.19 of the California Vehicle Code and commence collection of an
additional one dollar($1.00) fee, to be paid at the time of registration or renewal of registration
on every vehicle registered to an address within Contra Costa County, except those vehicles
expressly exempted from payment of registration fees. It is the intention of the Contra Costa
County Board of Supervisors to fund an eligible program, as specified in section 9250.19, which
will enhance the capacity of local law enforcement agencies to update and replace Cal-ID
automated fingerprint identification systems.
