Sheriff Facility Standard General Plan Amendment in the third consolidated General
Plan Amendment for 1997.
FISCAL IMPACT
Approval of either option would assure Contra Costa County's continued compliance with
the Measure C-1988 Growth Management Program requirements and qualify the County
to receive its future allocation of Measure C-1988 "return to source" revenues, estimated
at $1.7 million in 1997. Option # 1, however, would likey have long range fiscal impacts
for the County because it raises the amount of Sheriff space required to meet performance
standards in the General Plan and maintain compliance with the Measure C-1988 Growth
Management Program requirements. Funding to provide such expansion of facilities has
not, as of yet, been identified.
BACKGROUND/REASONS FOR RECOMMENDATIONS
A. Measure C-1988 Growth Management Program Requirements
Contra Costa County must annually submit a compliance checklist to the Contra Costa
Transportation Authority in order to receive the County's share of the 18 percent return-to-
source funds from Measure C-1988 % cent sales tax for transportation. In FY 1996-97,
approximately $7 million in "return-to-source" funds were available countywide and the
County was eligible to receive approximately $1.5 million. The return-to-source funds are
made available to Contra Costa jurisdictions for local street maintenance and
transportation improvements provided that they can demonstrate adherence to the public
facilities and service standards contained in their respective General Plan Growth
Management Elements.
The County is required to maintain adequate Sheriff's facilities under performance
standards contained in the General Plan Growth Management Element and Public
Facilities/Services Element in order to demonstrate annual compliance with Measure C-
1988 Growth Management Program requirements. Failure to meet this standard could
result in a potential loss to the County of its annual allocation of Measure C (1988) "return-
to-source" funds, estimated at $1.7 million for 1997.
The Measure C-1988 ordinance's Growth Management Program, Section 3. Adopt
Performance Standards, does not specify the type of a police performance standard a
jurisdiction must adopt. Consequently, the adopted police performance standards vary
among the 19 jurisdictions in the county: some jurisdictions set their standards according
to capital facilities; some jurisdictions' police performance standards are based on targeted
police response times for emergency and non-emergency calls; and some of the
jurisdictions have pegged their standard to a police personnel or force level per one
thousand population.
It is worth noting that the City of Concord uses a police performance standard based on
200 square feet of police station space area per one thousand residents. This facility-
based police performance standard is very similar to the County's Sheriff facility standard.
They used the gross building square footage from Concord's old police facility, located at
Willow Pass Road and Parkside Drive (a new police facility, located at 1350 Galindo Street

was opened in 1995). This computation of square footage included all the space set aside
in the old building for the police department's patrol, investigation, and support services
(including dispatch, records, and administration).'
B. Current Sheriff Facility Standard and Compliance
The County's current standard in the Growth Management Element and Public
Facilities/Services Element sets a requirement to maintain Sheriff facilities at 155 square
feet per 1,000 population. This standard, which was adopted in 1991 as part of the
comprehensive update to the General Plan, is based on a definition that only includes
space for the Sheriff Department's patrol and investigation functions and does not include
detention and other ancillary facilities.
The performance standard for the Sheriffs facilities is described in the Growth
Management Element, Section 4.3, page 4-4, and Section 4.4, page 4-11, and in the
Public Facilities/Services Element, Section 7.9, Public Protection Policy#7-57, page 7-37.
Since 1991, a total of 211,687 square feet of new Sheriffs facilities have been added,
including additions to the crime lab and coroner's office and the opening of the West
County Detention Facility. These facilities, however, do not count toward the Sheriffs
facility standard contained in the General Plan, because the space does not fit within the
narrow definition of patrol and investigation services used in calculating square footage to
demonstrate compliance with the standard. In a recent inter-departmental review of the
standard, Sheriffs Office representatives have noted that the current definition does not
include certain support facilities essential to the department's patrol and investigation
activities. As an example, the Sheriff's Office current priority to upgrade and expand its
dispatch facility, estimated at $2 million, would not count toward the calculation of space
based on the current definition.
C. Board Authorization for GPA: Modify Standard's Definition
At an April 1, 1997 Board of Supervisors meeting, the Board approved a report from the
Finance Committee which reviewed the matter of the Sheriff facility standard requirement
and the Measure C-1988 Growth Management Program requirements. This report was
prepared following two Finance Committee meetings in March 1997, in which
representatives from GMEDA, Sheriff and County Administrator participated in discussions
about meeting the Sheriff facility standard. The Board endorsed the Finance Committee's
recommendation that in the short-term the Sheriff facility standard be modify or redefined
to include support facilities within the definition of the Sheriffs patrol and investigation
functions and in the long-term directed that the Sheriff and CAO prepare a master plan to
address future needs for patrol and investigation activities in the unincorporated area and
evaluate potential revenue sources to fund implementation of the master plan.
In a subsequent action, the Board of Supervisors on May 6, 1997 then authorized the
Community Development Department to prepare a General Plan amendment study to
modify or redefine the Sheriff facility standard to include certain support facilities, such as
dispatch, within the patrol and investigation definition used in establishing the standard, as
described in both Growth Management Element and Public Facilities/Services Element.
The Board's direction to modify the standard to include support facilities within the
definition of patrol and investigation activities was intended to assure the County's
adherence to the Sheriff facility standard in the General Plan.

D. County Planning Commission Recommendation, 11/18/97
A public hearing was conducted on November 18, 1997 by the County Planning
Commission on the proposed General Plan amendment to modify the Sheriff facility
standard ( see Exhibit "A"). Community Development staff reported on the background
and reasons for the proposed definition changes to the Sheriff facility standard. Testimony
was received from Commander Kathryn J. Holmes, Support Services Bureau, Sheriffs
Office, speaking on behalf of Sheriff Warren Rupf. Commander Holmes indicated that the
Sheriff's Office would not support changes in the standard's definition, unless it also
included further changes to the standard that would increase the amount of station area
per 1,000 population from the existing 155 square feet per 1.000 population to 349 square
feeder 1,000 population. The County Planning Commission was persuaded by testimony
from the Sheriffs Office and recommends approval of a General Plan amendment, as
follows (see Exhibit "B", CPC Resolution No. 36-1997):
1) Modify the Sheriff Facility Standard to include support services, such as dispatch,
within the definition of the Sheriffs patrol and investigation functions;
2) Increase the amount of station area per 1,000 population in the Sheriff Facility
Standard from 155 square feet of station area per 1.000 population to 349 square
feet station area per 1.000 population.
E. Impact if County Cannot Meet Higher Standard, as Recommended by the
County Planning Commission
Community Development staff has prepared an analysis of projected space needs for the
Sheriff to the Year 2002 to determine if the County could meet the change in the amount
of station area per 1,000 as recommended by the Sheriffs Office and County Planning
Commission. As illustrated in Exhibit "C" , a change in the standard's current 155 s.f. of
station area per 1,000 population to 349 s.f. of station area per 1,000 population would
become a problem for the County in year 2000. Based on current population growth
trends, the County in year 2000 would have to add at least 9,029 s.f. of new station area
to meet a Sheriff facility standard set at 349 s.f. of station area per 1,000 population;
however, only 7,263 of new space is expected to be added by Year 2000 according to the
inventory of Sheriff space in the County's Capital Improvement Program (CIP). This would
leave the County with a 1,766 square foot deficit in Sheriff facilities in the year 2000.
Failure to meet the Sheriff facility standard could have two significant impacts in year 2000
for Contra Costa County:
1) Contra Costa County would be unable to demonstrate compliance with the Measure
C-1988 Growth Management Program requirements for the reporting period,
calendar year 2000. Contra Costa County would be ineligible to receive its future
allocation of "return-to-source" funds (approx. $1.7 Million) until it could
demonstrate compliance with the General Plan performance standards as
mandated under the Measure C-1988 Growth Management Program requirements.

2) Contra Costa County would be unable to make consistency findings for
discretionary land use actions based on higher Sheriff facility standard contained
in the General Plan. In determining that a discretionary land use action is consistent
with the General Plan, the County must demonstrate that the discretionary action
can meet the performance standards established in the General Plan. As discussed
in this report, space for the Sheriff Department under a higher standard would be
insufficient in year 2000 to match the projected population growth and this could
affect the ability to approve discretionary land use applications submitted to the
County during this period.
F. Finance Committee Recommendation, 4/1/97
When the Finance Committee reviewed this matter earlier this year, they considered
changing the performance standard for sheriff facilities in addition to revising the definition
of this performance standards. At that time, the priority for the Sheriffs Office was to
improve dispatch facilities, not Sheriff substations. The Finance Committee acknowledged
that the County's five-year CIP did not identify enough funding for Sheriff facility expansion
to satisfy the performance standard beyond the existing 155 square feet per 1,000
population. In limiting their recommendation to revising the definition of the Sheriff facility
standard, the Finance Committee desired to direct funding for Sheriff facilities to where the
greatest need existed, e.g. support facilities, and allow the County to receive credit for such
expenditures underthe Measure C-1988 Growth Management Program requirements. The
Finance Committee recognized that Sheriff substations would eventually become a priority,
so in the second recommendation they requested that the Sheriff, in cooperation with the
County Administrator's Office, prepare a master plan to address future needs for Sheriff
patrol and investigation activities in the unincorporated area and to evaluate potential
revenue sources to fund implementation of the master plan. The Board of Supervisors
concurred with the Finance Committee's recommendation on April 1, 1997, and reaffirmed
this recommendation on May 6, 1997 by authorizing the Community Development
Department to proceed with a General Plan amendment for the Sheriff facility standard.
To date, no new information has been provided to the Community Development
Department which would change the concerns raised in April by the Finance Committee
about the County's ability to meet a performance standard for Sheriff facilities any higher
than the existing standard of 155 square feet per 1,000 population.
In view of County fiscal concerns, and, considering how failure to meet a higher Sheriff
facility standard could affect discretionary land use decisions in the future, Staff believes
the Finance Committee's original recommendation is still the most appropriate way to
address this issue. Staff recommends Option #2: Finance Committee Recommendation
on Sheriff Facility Standard.
Furthermore, based on the concerns raised by the Sheriffs Office at the recent County
Planning Commission hearing, a status report from the Sheriffs Office on preparation of
the Master Plan for Sheriff Patrol and Investigation Facilities, as requested in the Board's
action on April 1, 1997, would seem timely.

CONSEQUENCES OF NEGATIVE ACTION
If the Board of Supervisors does not act by the end of the calendar year to modify or re-
define the Sheriff facility standard contained in the General Plan Growth Management
Element and Public Facilities/Services Element, as recommended in Option #2: Finance
Committee Recommendation (4/97), the following negative consequences would likely
occur:
1) The calculation of Sheriff facilities space included in the Board approved (5/7/97)
FY 1996-97 Annual Compliance Checklist would be invalid since it assumed a
revised definition combined with a five year capital program for sheriff facilities in
order to show compliance with the standard. Contra Costa County would be unable
to demonstrate compliance with the Measure C- 1988 Growth Management
Program requirements for the reporting period, calendar year 1996 and future
Annual Compliance Checklists would be subjected to greater scrutiny by the Contra
Costa Transportation Authority.
2) Submittal of the County's FY 1998 Annual Compliance Checklist would need to be
delayed pending Board action on a revised definition of the standard. Until this
action occurs, Contra Costa County would be ineligible to receive its FY 1997-98
allocation of approximately $1.7 Million in "return-to-source" funds because it could
not demonstrate compliance with the Measure C Growth Management Program
requirements. This would effectively delay numerous road maintenance and
improvement projects scheduled for 1998, which are to be funded primarily by
Measure C "return-to-source funds".

4. Growth Management Element
between job and housing centers, carry significant volumes of intra-county trips. All other roadways included
in the circulation network of the general plan are referred to in the Growth Management Element as Basic
Routes. Basic routes, and their signalized intersections, are those to which LOS standards are applied in
determining whether proposed projects may be approved. The methodology used in determining if projects
exceed allowable LOS standards is the Circular 212 Method with Operation Method Capacities.
At present, most Basic Routes in the unincorporated area operate at or better than the LOS Standards specified
in the Growth Management Element. Routes of Regional Significance are generally below these standards,
however, reflecting the fact that the trips are not dependent upon land uses in unincorporated Contra Costa
County, but are cumulative with traffic generated by land uses located outside of the unincorporated areas.
Public Protection Facility standards contained in this plan are based upon the 1990 facilities to unincorporated
population ratio. In the area of parks, for example, the current unincorporated population to park acreage
yields a ratio of less than 1 acre per 1,000 persons. While certain developed areas of the County experience
flooding in the event of the 100-year flood, the County Ordinance Code collect-and-convey requirements are
applied to all new developments. Water and sewer services are generally adequate for existing development.
For the purposes of establishing a Public Protection Facility standard, several factors must be considered.
Firstly, the unincorporated community of Kensington has established a Community Services District which
provides the full range of police services in the area, and the Sheriff does not service this area. Secondly, the
California Highway Patrol is responsible for enforcement of the Vehicle Code on highways and County roads
throughout the unincorporated area. Thirdly, certain economies of scale enable the Sheriff to provide patrol
and investigation services in physical facilities substantially smaller than a comparable series of cities would
require, due to centralized administrative services, crime lab facilities and other similar functions which
numerous cities would duplicate in each location. According to the Department, very little time is spent by
deputies in the stations; nearly all is spent in the vehicles on patrol; no clericals are housed in the stations. In
addition, the Sheriff also provides coroner services, incarceration and criminalistics services. For these
reasons, direct comparisons between County facilities standards and standards that may be adopted by cities
in the County are not advised, since such comparisons would be highly misleading.
The computation of a Sheriff facility standard in this General Plan includes only patrol and investigation
services, adjusted for a marginal increase in centralized administrative services. As of January, 1991, the
County provides approximately 155 square feet of floor area per thousand population in six locations

4. Growth Management Element
Water
The County, pursuant to its police power and as the proper governmental entity responsible for directly
regulating land use density or intensity, property development and the subdivision of property within the
unincorporated areas of the County, shall require new development to demonstrate that adequate water quantity
and quality can be provided. At the project approval stage, (subdivision map, land use permit, etc), the
County may consult with the appropriate water agency. The County, based on information furnished or
available to it from consultations with the appropriate water agency, the applicant or other sources, should
determine whether (1) capacity exists within the water system if a development project is built within a set
period of time, or(2)capacity will be provided by a funded program or other mechanism. Project approvals
conditioned on(1)or(2)above, will lapse according to their terms if not satisfied by verification that capacity
exists to serve the specific project("will serve letters"), actual hook-ups or comparable evidence of adequate
water quantity and quality availability.
Sanitar; Sewer
The County, pursuant to its police power and as the proper governmental entity responsible for directly

unincorporated areas of the County, shall require new development to demonstrate that adequate sanitary sewer
quantity and quality can be provided. At the project approval stage, (subdivision map, land use permit, etc),

available to it from consultations with the appropriate sewer agency, the applicant or other sources, should
determine whether (1) capacity exists within the sewer system if the development project is built within a set
period of time, or(2)capacity will be provided by a funded program or other mechanism. Project approvals
conditioned on(1)or(2)above, will lapse according to their terms if not satisfied by verification that capacity
exists to serve the specific project("will serve letters"), actual hook-ups or comparable evidence of adequate
sewage collection and wastewater treatment capacity availability.
Fire Protection
Fire stations shall be located within one and one-half miles of developments in urban, suburban and central
business district areas. Automatic fire sprinkler systems may be used to satisfy this standard.
Public Protection
A Sheriff facility standard of 155 square feet of station area aper 1,000 population shall
be maintained within the unincorporated area of the County.
Parks and Recreation
Neighborhood parks: 3 acres-required per 1,000 population.

o apartment corridors accessible from only one exterior entrance;
o windows placed for easy resident surveillance of entryways of public and semi-public areas;
o absence of interior hiding places;
o short streets ending in cul-de-sacs in single-family residential areas; and
o landscaping to permit surveillance of open areas and entryways.
Defensible space design principles have demonstrated a high rate of crime deterrence in residential as well as
other types of development.
In order to provide an acceptable level of police protection service for the projected population as provided
by this General Plan and to improve the level of efficient police protection needed through the land use
planning and review process the following goals and policies were developed.
PUBLIC PROTECTION GOALS
7-V. To provide a high standard of police protection services for all citizens and properties throughout
Contra Costa County.
7-W. To incorporate police protection standards and requirements into the land use planning process.
7-X. To encourage public participation in crime prevention activities.
PUBLIC PROTECTION POLICIES
7-57. A sheriff facility standard of 155 square feet of station area and support,facdifes per 1,000
population shall be maintained within the unincorporated area of the County. (Also see Growth
Management Element.)
7-58. Sheriff patrol beats shall be configured to assure minimum response times and efficient use of
resources.
7-59. A maximum response time goal for priority 1 or 2 calls of five minutes for 90 percent of all
emergency responses in central business district,urban and suburban areas, shall be strived for by the
sheriff when making staffing and beat configuration decisions.
7-60. Levels of service above the county-wide standard requested by unincorporated communities shall be
provided through the creation of a County Service Area or other special governmental unit.
7-61. Increased costs associated with the County's jail system shall not reduce the level of sheriff patrol
service throughout the County.

RESOLUTION OF THE CONTRA COSTA COUNTY PLANNING COMMISSION OF THE STATE OF
CALIFORNIA, RECOMMENDING APPROVAL OF A GENERAL PLAN AMENDMENT TO THE
STANDARD FOR SHERIFF FACILITIES CONTAINED IN THE GROWTH MANAGEMENT ELEMENT
AND PUBLIC FACILITIES/SERVICES ELEMENT (#GP97-0013)
WHEREAS, the Board of Supervisors authorized preparation of an application for a General Plan
Amendment to modify or re-define the Sheriff Facility Standard, contained in the General Plan's Growth
Management and Public Facilities/Services elements, to include support facilities, such as dispatch, within
the definition of the Sheriff's patrol and investigation functions; and
WHEREAS, a Negative Declaration of Environmental Significance was posted on the project and no
comments were received on that document; and
WHEREAS, staff prepared a report recommending changes in the General Plan for the Growth
Management Element and Public Facilities/Services Element and circulated it to interested agencies; and
WHEREAS, after notice was lawfully given, a public hearing was scheduled before the County
Planning Commission on Tuesday, November 18,1997, at which all persons interested might appear and be
heard; and
WHEREAS, Kathryn J. Holmes, Commander, Support Service Bureau, Contra Costa County Sheriff
Department testified on the issue and the public hearing was closed; and
NOW THEREFORE BE IT RESOLVED that the Contra Costa County Planning Commission
recommends to the Board of Supervisors APPROVAL of a General Plan Amendment changing the Sheriff
Facility Standard contained in the Growth Management Element and Public Facilities/Services Element, as
follows;
1) Modify the Sheriff Facility Standard to include support services, such as dispatch, within the
definition of the Sheriff Department's patrol and investigation functions;
2) Increase the amount of station area per 1,000 population in the Sheriff Facility Standard from

Subject: Recommendations to the County Planning Commission re the Sheriff's
Facility Standard
have received your October 29 memo with the recommendations which are being
made to the County Planning Commission. There is a very serious oversight contained
in the documents which must be corrected.
The recommendation to include support functions in the calculation of Sheriff's facilities
is fine, as we have discussed. However, to maintain the baseline standard at 155
pare feet not acceptable. By doing so, we would be setting a facility standard
:�h is less than half of the space we had in 1991.
I have attached the Sheriff's facility inventory which was prepared by Community
Development earlier this year. The inventory indicates that the space devoted to Patrol,
Investigation and Support functions in 1991 was 3dc_ souare feet. This should be the
baseline standard which is adopted. It is irrationa< ,o think our standard should be any
less than what it was in 1991. In order to meet this standard, we would need to add
approximately 4000 more square feet.. This would �e easily satisfied by the Dispatch
remodel project as we have requested.
Unless the square footage for the facility standard is amended, the Sheriff's Office will
oppose the recommended changes.

The Board of Supervisors of Contra Costa County RESOLVES THAT:
There is filed with the Board and its Clerk a copy of Resolution No. 36-1997 adopted by the Contra Costa
County Planning Commission which discusses a General Plan Amendment to the Standard for Sheriff
Facilities contained in the Growth Management Element and Public Facilities/Services Element(County File
#GP-97-0013).
On Tuesday,December 9, 1997,the Board held a public hearing on said General Plan Amendment discussed
by County Planning Commission (Resolution No. 36-1997). Notice of said hearing was duly given in the
matter required by law.The Board accepted a staff report which outlined two options for amending the Sheriff
facility standard contained in the General Plan: Option#1: County Planning Commission Recommendation,
11/19/97 (Resolution No. 36-1997), and Option #2: Board of Supervisors' Finance Committee
Recommendation, 4/1/97. The Board then called for testimony on this hearing matter. A representative from
the Sheriff's Office testified in favor of Option #1 to amend the General Plan Sheriff facility standard as
recommended by the County Planning Commission (Resolution No. 36-1997). In response to the public
testimony, Supervisor Joseph Canciamilla explained the reasons for the Finance Committee's April 1, 1997
recommendation to the Board of Supervisors to modify the Sheriff facility standard to include support
facilities within the definition of Sheriff patrol and investigation functions (Option#2).
The Board closed the public hearing and APPROVED Option 42: Board of Supervisors' Finance Committee
Recommendation, 4/1/97, as the General Plan Amendment to the Standard for Sheriff Facilities contained
in the Growth Management Element and Public Facilities/Services Element, and directed staff to include this
amendment into one of the consolidated General Plan Amendments as allowed by State Planning Law.

WHEREAS, the Board of Supervisors authorized preparation of an application for a General Plan
Amendment to modify or re-define the Sheriff Facility Standard, contained in the General Plan's Growth
Management and Public Facilities/Services elements, to include support facilities, such as dispatch, within the
definition of the Sheriff's patrol and investigation functions; and
WHEREAS, this project is Categorically Exempt under the General Rule of Applicability, Section
15061(b)(3), California Environmental Quality Act; and
WHEREAS, staff prepared a report recommending changes in the General Plan for the Growth
Management Element and Public Facilities/Services Element and circulated it to interested agencies; and
WHEREAS, after notice was lawfully given, a public hearing was scheduled before the County
Planning Commission on Tuesday, November 18,1997, at which all persons interested might appear and be
heard; and
WHEREAS, Kathryn J. Holmes, Commander, Support Service Bureau, Contra Costa County Sheriff
Department testified on the issue and the public hearing was closed; and
NOW THEREFORE BE IT RESOLVED that the Contra Costa County Planning Commission
recommends to the Board of Supervisors APPROVAL of a General Plan Amendment changing the Sheriff
Facility Standard contained in the Growth Management Element and Public Facilities/Services Element, as
follows;
1) Modify the Sheriff Facility Standard to include support services, such as dispatch, within the
definition of the Sheriff Department's patrol and investigation functions;
2) Increase the amount of station area per 1,000 population in the Sheriff Facility Standard from
