The following ordinance(s) having been introduced, the Board
by unanimous vote of the members present waives full reading
thereof and fixes December 16, 1997 as the time for adoption of
same.

ORDINANCE NO. 98-
The Contra Costa County Board of Supervisors ordains as follows (omitting the
parenthetical footnotes from the official text from the enacted or amended provisions of
the County Ordinance Code).
SECTION I. SUMMARY. At the time section 33-5.337 was added to the Ordinance Code, the
County Administrator served by operation of law (Government Code sections 54777 [1963, C.
1808] and 56384(a)) as the LAFCO executive officer in the absence of the Commission directly
appointing its own executive officer employee. In recent years, LAFCO has appointed and
employed its own executive officer employee but the continuation of section 33-5.337 in the
Code has resulted in administrative confusion as to whether the Board of Supervisors or the
Commission fixes the compensation and other terms of employment of a LAFCO appointed
executive officer.
SECTION II. LAFCO Executive Officer. Section 33-5.337 of the County Ordinance Code is
repealed.

SECTION II: EFFECTIVE DATE. This ordinance becomes effective 30 days after passage,
and within 15 days of passage shall be published once with the names of the supervisors voting
for and against it in the , a newspaper published in this County.
