HomeMy WebLinkAboutMINUTES - 12021997 - D9 D.9 THE BOARD OR SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on _December 2, 1997,_ by the following vote: AYES: Supervisors Rogers, Uilkema, Gerber, Canciamilla, DeSaulnier NOES: None ABSENT: None ABSTAIN: None SUBJECT: Consider County Withdrawal from the Central Contra Costa Solid Waste Authority The Board considered the recommendation of Supervisors Canciamilla and DeSaulnier to request the County Administrator and County Counsel to give notice to the Central Contra Costa Solid Waste Authority (CCCSWA) before December 31, 1997, that the County intends to withdraw from the CCSWA on July 1, 1998. The following persons spoke in opposition to the recommendation: Dick Waldo, Central Costa County Solid Waste Authority, 176 St. Helena Court, Danville; and Kathy Hicks, Chair, Central Contra Costa Solid Waste Authority, 76 Amberwood Lane, Walnut Creek. At the conclusion of the discussion on the recommendation, IT IS BY THE BOARD ORDERED that consideration of this matter is CONTINUED to December 16, 1997. IT IS FURTHER ORDERED that the County Administrator and Interim Community Development Director are DIRECTED to report to the Board on December 16, 1997, on the Contra Costa County Solid Waste budget and the effects on CCCSWA if the County were to withdraw. Request the County Administrator and County Counsel give notice to the Central Contra Costa Solid Waste Authority(CCCSWA) before December 31, 1997, that the County intends to withdraw from the CCSWA on July 1, 1998. 2. Prior to July 1, 1998, review the intended withdrawal from CCCSWA. BACKGROUND INFORMATION: Contra Costa County joined the CCCSWA with the understanding that it would benefit the citizens represented by the Board. While rates may have benefited in the short term, a major rate increase is being sought by the franchisee(s). The Board also is seriously concerned about CCCSWA's consideration of acquiring a landfill and transfer station, which was not contemplated when the County joined the CCCSWA. A budget consideration should be made with respect to the fact that the County already administers several solid waste franchises, and to administer.two more would not burden the County. The CCCSWA duplicates what the County already does. Under the terms of the CCSWA agreements the Board must give notice of its intention to withdraw prior to December 31, 1997. In order for the Board to maintain the maximum flexibility we recommend the Board give notice prior to December 31, 1997. First,at its October meeting, the CCCSWA Board discussed the Town ofMoraga impact to the CCCSWA franchise agreements of the potential sale of the Keller Canyon landfill and the potential for a public purchase. The Board did not take any action to move forward with any efforts to pursue a purchase. Instead, the Board tabled the matter for six months (1) due to substantial controversy indicating lack of strong support and (2) in order to focus on Company compensation and rate review. The Board did not request any further staff work to evaluate a purchase. No further Board action is being recommended or is currently contemplated by staff. Furthermore,any serious consideration of a landfill and/or transfer station purchase Would require further written agreements between the CCCSWA and its member agencies, and as a practical matter, it would require substantial cooperation with the Contra Costa County Board of Supervisors as the regulatory body for solid waste facilities in the unincorporated areas. Secondly, since 1994, the CCCSWA and its member agencies have saved the ratepayers nearly $10,000,000 annually in required revenue for comprehensive solid waste and recycling services in its service area. During the same time frame, the CCCSWA member agencies are meeting and in some cases,exceeding its state-mandated diversion goals. While the CCCSWA Board is currently considering Browning-Ferris Industries' and Valley Waste Management's requests for increased compensation beginning in March 1998, an increase in compensation does not automatically translate into an increase in residential solid waste and recycling rates. Each member agency will again(similarly to 1995)review its own rate structure including levels of contingencies and member agency fees.Your decisions will ultimately determine the variety of customer categories and rates. At the first CCCSWA workshop held in November,the Board reviewed a draft consultant report that indicated that the County's forecasted revenues at its current rates are expected to meet or exceed the unincorporated area's revenue requirement for the rate year beginning March 1, 1998. This will provide the Contra Costa County Board of Supervisors substantial leeway in determining its rate structure and related policies. The CCCSWA Board is scheduled to have a Board meeting and Public Hearing dealing with service and compensation issues on December 11, 1997 and follow up with a rate setting workshop in mid- January. The rate payers of central county have significantly benefited by the cooperative efforts of the local governing bodies in solid waste and recycling matters and the CCCSWA Board would like to encourage continued cooperation in the future.
