RECOMMENDATION:
I
HOLD a public hearing to conduct a performance evaluation of Telecommunications,
Inc.("TCI") systems in unincorporated Contra Costa County.
At the end of the public hearing, DIRECT the Cable TV Administrator to provide TCI
with a summary of unincorporated subscribers needs and interests expressed and any
actions suggested by the Board of Supervisors.
FINANCIAL IMPACT:
None.
BACKGROUND:
On August 5,1997, the Board of Supervisors directed the Cable TV Administrator to set
a hearing date for a performance evaluation of Telecommunications, Inc. (TCI systems
serving unincorporated residents).
A letter was sent to all TCI general managers on August 11,1997 informing them of the
hearing date and time and directing them in accordance with the respective cable ordi-
nances to notify their unincorporated subscribers. TCI inserted the attached notice in
subscribers' bills 1.0/20/97 through 11/14/97 and ran a notice in the Contra Costa Times
on October 27, 1997. CCTV has aired a notice about the hearing on InfoNet since No-
vember 21, 1997.

Staff has reviewed all TCI systems for compliance with their respective cable or-
dinances. Their are two areas that require resolution: 1) the TCI audit issue regarding
payment on advertising revenues and receipt of appropriate payment for the arrearage
and Baltimore Decision; and 2) the pending completion of rate review on the last FCC
1240s and 1205s submitted. Staff is currently working with TCI to resolve these issues.
Attached are summaries of the systems unincorporated subscriber counts, service and
rate options; summaries of customer complaints from January, 1997 through October,
1997; and a sample of the three part complaint form that is completed and distributed
with one copy on file.
The County has the authority to regulate TCI's rates, customer service and technical
standards based on Federal Law and the current Cable Television Ordinances. We
do not have authority to require particular channels on cable systems. However, we
can require that renewing systems meet customer needs and interests.
TCI has recently conducted a survey of their customers which may provide them with
some information about channels that customers would like to see on their systems.
They have stated that they could not share survey results with local jurisdictions, but
they may be able to provide us with a summary of trends or plans for the future. In ad-
dition, information gathered at this hearing may also provide a basis for renewal discus-
sions with three TCI systems (Martinez, Brentwood and Pinole).
