SUBJECT: Agreement to Provide Real Property Services to the City of Rio Vista

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action: APPROVE agreement to provide real property services to the City of
Rio Vista for their 2nd Street Storm Drain Repair Project and AUTHORIZE the Board Chair to
sign the agreement on behalf of the County.
II. Financial Impact: The City of Rio Vista will pay the actual costs for Real Property staff services
and acquisition.
III. Background and Reasons for Recommendations: The City of Rio Vista requires a variety of
real property services but has no real property staff and desires to contract with the County for
these services. The agreement specifically covers the 2nd Street Storm Drain Repair project
IV. Consequences of Negative Action: Less efficient government because the City of Rio Vista
would have to hire additional private contractors at greater a wnse.

RESOLUTION 97-68
RESOLUTION APPROVING AGREEMENT WITH COUNTY OF CONTRA COSTA
FOR RIGHT-OF-WAY APPRAISAL RELATED TO THE SECOND STREET
STORM REPAIR
BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIO VISTA
that said Council approves of the AGREEMENT with Contra Costa County
for the furnishing of appraisal services in relation to the Second
Street Storm Repair Project and authorizes the Mayor to execute said
Agreement and to take such further action as may be necessary in con-
nection therewith. A copy of the agreement is on file in the Office
of the City Clerk and is hereby referred to for further particulars.

Clerk of the City Council of said City do hereby certify the above and
foregoing to be a full, true and correct copy of a Resolution of said
City Council, which was regularly introduced, passed and adopted by
said City Council at a regular meeting thereof, by the following

AGREEMENT
1. Effective Date and Parties. Effective on gp;itamLer2 U 1922
the COUNTY OF CONTRA COSTA, a political subdivision of 'the State of
California (hereinafter referred to as "County") , and the CITY OF
RIO VISTA, a municipal corporation (hereinafter referred to as
"City") , hereby mutually promise and agree as follows:
2 . Purpose. The City contracted the Second Street Storm Repair
project during the Fiscal Year ending June 30 , 1997 . The City has
no right of way staff and desires to contract with the County for
property appraisal and acquisition services.
3 . Services by County. The services to be rendered by County to City
may include appraisal, appraisal review, negotiation, land rights
document preparation, right of way acquisition, relocation, and/or
supervision of independent contractors providing such services.
4 . Payment for Services. City agrees to reimburse County for all
labor costs and appropriate overhead for County Real Property
Agents ' labor including overtime rates for evening or weekend work
(See Appendix "A" for pay rates) . City shall pay all acquisition
settlement and any other costs of acquisition such as title fees,
recording fees, etc. Such payments shall be made within 30 days
of billing by County.
5. Indemnification. To the extent allowed by law, City agrees to
defend, indemnify and save harmless County, its officers, and
employees against any and all loss, damage, liability, expense,
claims or demands of whatever character, direct or consequential,
directly or indirectly contributed to or caused by County assuming
and acting as the right of way agency for and on behalf of City.
6. Independent Status. Nothing herein shall be construed to imply
that any County employee providing services hereunder is a City
employee.
7 . Term. The term of this agreement shall commence on the effective
date hereof and shall end upon termination by either party upon 30
days written notice. The rights and obligations of Paragraph 5
"Indemnification" shall survive any such termination.
