Recommended Action: Authorize the use of thirty-two (32) hours of vacation during the month of October 1997, for David Mendez, employee #55273. II. Background: David Mendez was hired by the County in June 1997, as the new Manager of Airports. In October, he wanted to use four days (32 hours) of vacation time. He called the Public Works Payroll Clerk, who called the County Auditor's Office to verify that he could use the vacation hours which he had accrued. Mendez Parte Tw-o 9.1 of the Salary Regulations. He used the vacation time. In preparing his paycheck for October, the Auditor's Office noted the vacation time and determined that Section 9.1 did apply to Mr. Mendez and has subtracted four days (32 hours) of pay from Mr. Mendez's paycheck. III. Justification: Mr. Mendez would not have used the vacation time if he had correctly been told that it was not available to him. Mr. Mendez should not be penalized four days of pay for an error made by another employee, when the other employee is in a position that is normally relied upon for advise in personnel/time-keeping matters. Since the vacation time in question had been accrued by Mr. Mendez, allowing him to use it three months early does not financially impact the County.
