RE00-MMENDATION
That the County Probation Officer be authorized to enter into an agreement with
Sonoma County for the purpose of placing delinquent wards of the Court in
Sonoma County's Sierra Youth Center at a monthly rate of$2,800.
BAICKGRO-U-ND
Sonoma County operates a co-ed probation residential treatment facility under the
provisions of Section 880, Welfare and Institutions Code, known as the Sierra
Youth Center. The facility has 20 unlocked beds used for male and female
delinquents committed by the Court. Sonoma County has invited other counties to
place youth in their facility under the provisions of Section 888, Welfare and
Institutions Code, which requires an inter-county agreement. Section 755, Welfare
and Institutions Code, allows the Juvenile Court to permit a ward's placement out of
county under the supervision of the Probation Officer of that county.
Contra Costa County has had an agreement with Sonoma County for such
placements since September 27, 1994 and has found it to be a suitable place for
Contra Costa County wards. This resource has expanded the Probation
Department's alternative treatment options for difficult to place youth, especially
girls, who might otherwise be placed in long term foster care or CYA. /
_COST .
The rate of payment to Sonoma County is $2,800 per month which is the same as
last year's contract agreement and still less than the average group home rate of
$3,300 per month.

In view of the program size (20 beds), the needs of Sonoma County and its use by
other counties, we do not anticipate placing more than three Contra Costa County
youth there at any given time.
The proposed inter-county agreement (attached) is identical to the agreement signed
last year.

AGREEMENT FOR PLACEMENT OF WARDS
AT THE SONOMA COUNTY PROBATION DEPARTMENT
SIERRA YOUTH CENTER
This Agreement is made this 2nd _ day of December 1997
between the COUNTY OF SONOMA, hereinafter referred to as "Sonoma, " and CONTRA
COSTA COUNTY, hereinafter referred to as "Second County. "
This Agreement is in effect from July 1, 1997 through June 30, 1998 .
RECITALS :
Whereas, Sonoma County has established a residential treatment
facility for Wards of the Juvenile Court known as the Sonoma County Sierra
Youth Center at Los Guilucos (hereinafter referred to as the Sierra Youth
Center) in accordance with Welfare and Institutions Code, Section 880, et
seq.
Whereas, Sierra Youth Center has complied with the standards for
juvenile camps established by the California Youth Authority.
Whereas, from time to time there are excess accommodations in the
Sierra Youth Center beyond the needs of Sonoma County, and the Second
County is desirous of contracting to place its own Wards in the Sierra
Youth Center.
Whereas, the Sonoma County Board of Supervisors has authorized the
Sierra Youth Center Superintendent to contract for placement of Wards from
other counties at the Sierra Youth Center subject to the conditions and
limitations in this Agreement .
IT IS HEREBY AGREED AS FOLLOWS :
1 . SERVT_CES TO BR PROVTDRD. Sonoma County will provide care and
detention for Juvenile Court Wards of the Second County at the Sonoma
County Sierra Youth Center subject to the conditions and limitations of
this Agreement . Care for Wards will include housing, limited health care,
counseling, academic assessment, work projects, recreational activities
and individual case plans to meet resident/family needs .
2 . LIMITATIONS ON A CEPT NCE AND RF.TENTTON OF WARDS AT SONOMA COUNTY
ST ,RRA YOUTH CENTER . The Director of the Sierra Youth Center may at her
discretion decline to accept or retain a Ward of the Second County for
reason of limited residential facilities, or any other reason affecting
the welfare of the Wards at Sierra Youth Center. Second County agrees to
promptly arrange for the transportation of any Ward out of the Sierra
Youth Center upon receipt of a written or oral notice from the Director
(or her designee) that the Ward should be removed from the Sierra Youth
Center.
3 . MAXIDETM NUMBER OF WARDS OF SECOND COUNTY AT STE RA YO 7THENTRE .
In order to provide priority for the placement needs of Sonoma Wards,
Second County agrees that the following restrictions will apply to
placement of its Wards . No more than ten (10) Wards of the Second County
can reside at the Sierra Youth Center during any time period. If sixteen
(16) or more of the total of twenty (20) beds at the Sierra Youth Center
are occupied, no new Wards will be admitted from the Second County until
such time as the residential population declines below sixteen (16) Wards .
4 . PHYST A . EXAMINATION PRIOR TO PLACEMENT_ The Second County
agrees to provide a physical examination for each of its Wards prior to
placement at the Sierra Youth Center. Second County will only place those
Wards who are physically fit for placement in a Sierra Youth Center
Program in accordance with the placement standards established by the
California Youth Authority.
5 . OE RAT. CONDITIONS FOR OUT-OF-COUNTY O A T PLACEMENTS .
Both parties agree to the attached "General Conditions of Out-of-County
Contract Placements Sonoma County Sierra Youth Center, " which is
incorporated herein as part of this Agreement .
6 . PAYMENT. Second County agrees to pay Sonoma County the sum
of TWO THOUSAND EIGHT HUNDRED DOLLARS ($2, 800 .00) per calendar month for
each of its Wards who receive services at the Sierra Youth Center.
Payment of the aforementioned fees shall constitute full payment and
satisfaction of the obligation of Second County for its Wards except as
otherwise specified in this Agreement (see Subsections 7, 8, 9, and 10 of
this Agreement) .
Sonoma will bill Second County monthly. Billing will commence on
the day of admission, and will terminate on the day prior to release .
Payment will be prorated based on monthly rates . Payment is to be made

7 . COSTS OF MEDICAL ARF. FOR SECOND O TNTY WARDS . Second
County agrees to reimburse Sonoma County for all costs incurred for
medical, dental, optical, surgical, and psychiatric services performed on
a Ward of the Second County excepting as follows :
a. Routine medical examinations and first aid will be provided
free of charge to Wards of the Second County.
b. Sonoma agrees to bear the cost of medical services, up to a
maximum of $1, 000, for any ward of Second County receiving medical
services at Community Hospital in Santa Rosa. Any and all medical
expenses in excess of $1, 000 . 00 shall remain the responsibility of Second
County. Second County agrees to reimburse Sonoma for any and all medical
costs in excess of $1, 000 . 00 .
8 . COSTS OF TRANSPORTING WARD OF SECOND COMM. Second County
agrees to provide for transportation for its own Wards between the Second
County and the Sierra Youth Center. Second County further agrees to
reimburse Sonoma County for any costs incurred for the transportation of
Second County' s Wards outside of the facilities of the Sierra Youth
Center. Second County will send payment for transportation costs within
30 days of billing to the Sonoma County Probation Department at the
address provided in Subsection 6 of this Agreement .

9 . CHARGES FOR DETENTION OF WARn AT SONOMAA SO TNTY JTTVENTLE HALT'.
If a Ward of the Second County is detained at Sonoma County Juvenile Hall,
the following charges will apply:
a. If a bed is not kept available for the return of the Ward to
the Sierra Youth Center by the Director of the Sonoma County Sierra Youth
Center there will be no charge for the care of the Ward at Juvenile Hall .
b. If a bed is kept available for the return of the Ward to the
Sierra Youth Center by the Director, Second County agrees to pay the
regular charge for care and detention of the Ward at the Sierra Youth
Center as specified in Subsection 6 of this Agreement .
10 . INDEMNIFICATION. Sonoma shall defend, release, hold
harmless, and indemnify Second County, its officers and employees, from any
and all claims for injuries or damages to persons and/or property which
arise out of the terms and conditions of this Agreement if such injuries or
damages result from the negligent acts or omissions of Sonoma, its officers
and/or employees . It is further agreed that Second County shall defend,
hold harmless and indemnify Sonoma, its officers and/or employees, from any
and all claims for injuries and/or damages to persons and/or property which
arise out of the terms and conditions of this Agreement and which result
from the negligent acts and/or omissions of Second County, its officers
and/or employees . In the event of concurrent negligence of Sonoma, its
officers and employees, and Second County, its officers and employees, the
liability for any and all claims for injuries or damages to persons and/or
property which arise out of the terms and conditions of this Agreement
shall be apportioned under the California theory of comparative negligence
as presently established, or as may hereafter be modified. In addition,
Second County will reimburse Sonoma for damage to Sonoma property and/or
any costs incurred by Sonoma for injuries to its employees if such damage
or injury is caused by Wards accepted from Second County, provided that
Sonoma shall pay to second County any insurance proceeds received by Sonoma
from third persons reimbursing Sonoma for such actions, claims, damages,
disabilities, or expenses .
Second County agrees to defend, hold harmless, release and
indemnify Sonoma County, its officers and employees, from any and all
claims for workers compensation benefits asserted by any ward.
11 . AGREEMENT S TPE S .nES ANY PRIOR CONTRACT. This Agreement
supersedes any prior written Agreement between the parties for placement of
Wards at the Sonoma County Sierra Youth Center.
12 . MODTFTC'ATTON of AGREEMENT. This writing is intended both as
the final expression of the Agreement between the parties hereto with
respect to the included terms and as a complete and an exclusive statement
of the terms of the Agreement, pursuant to California Code of Civil
Procedures, Section 1856 . No modification of this Agreement shall be
effective unless and until such modification is evidenced by a writing
signed by both parties
13 . TERMINATION. At any time and without cause, each party to
this Agreement shall have the right in its sole discretion to terminate
this Agreement by giving 30 days written notice. In the event of such
termination, County shall be paid for services and expenses to the date of
termination.

14 . METHOD OF GIVING NOTICE. All notices shall be sent to the
Sonoma County Chief Probation Officer at P.O. Box 11719, Santa Rosa,
California 95406 . Notice will be given to the Contra Costa
County Chief Probation Officer when a minor is terminated from placement .
IN WITNESS WHEREOF, said First and Second Counties have executed
these presents by causing them to be subscribed by the Chairman of their
respective Boards of Supervisors, and the seal of said Boards to be
affixed and attested by the Clerk thereof, the day and year first
hereinabove written

GENERAL CONDITIONS OF OUT-07-COUNTY CONT A T RI-ACEMENTS

The following are general conditions agreed upon by the contracting
Probation Department and the Director of the Sonoma County Sierra Youth
Center, with concern toward providing effective client services in the
individualized treatment and release plans for each youth who enters the
Sonoma County Sierra Youth Center.

1 . Males/females ages 12 through 18 .
2 . No physical disabilities .
3 . No pattern of arson or serious violent crimes .
4 . No CYA parolees .
5 . Each resident must have an identified furlough and release legal
guardian or responsible adult, and a functional residence to return to
upon release from the Sierra Youth Center.
6 . Minimum accumulative time on each resident to be five months . Maximum
accumulative time is of no concern in screening. Average length of
stay at the Sierra Youth Center is six months . Minimum time to
complete the program is four months . Maximum time on record is 14
months .

All cases will be screened by the contracting county' s Probation
Department within the selection criteria provided, and the identified
Deputy Probation Officer in that county will contact the Sonoma County
Sierra Youth Center Director or Sierra Youth Center Youth Supervisor III
for verbal screening of each recommended youth.
An orientation packet, including medical release forms, step expectations,
grievance procedures, wilderness experience program authorization,
furlough contract agreement, etc . will be reviewed with the parents and
the recommended youth by the contracting county' s DPO. All forms must be
signed and delivered to the Sierra Youth Center with the arrival of the
out-of-county youth.
The Sonoma County Sierra Youth Center agrees to provide monthly reports on
the progress and problems of the youth from contracting counties, set
release dates, and provide termination reports on each resident .

The Sonoma County Sierra Youth Center agrees to attempt at all times to
mak& decisions and provide opportunities that are in the best interest of
the youth within his individualized treatment and release plan, and, at
all times, to provide maximum focus on change of anti-social thinking and
behavioral patterns found in any of the youth committed to the Sierra
Youth Center Program.

The contracting Probation Department agrees to provide an identified
contact DPO to maintain consistent communication on each case. The
contracting Probation Department shall provide a six-month post-release
probationary period on each graduate unless this interferes with the
graduate' s individualized release plan (military, relocation, job, etc. ) .
This DPO shall meet monthly with the resident, his family, and the
assigned Youth Counselor in the youth' s county of residence. That the
goal of these meetings be to develop a functional, stable and healthy
family environment to turn to or to work towards emancipation and
alternative residence for the youth upon release .
That the contracting Probation Department agrees to strongly encourage
their Superior Court to deal firmly with escapees or failures from the
Sonoma County Sierra Youth Center to avoid programmed failure of existing
or future youth who are in placement .
