Recomme ded Action: APPROVE and AUTHORIZE the Public Works Director, or his designee, to CONSENT, on behalf of the County, to a Loaned Equipment Agreement between Lithia Real Estate, Inc., and Pennzoil Products Company,under the terms and conditions more particularly described in said Loaned Equipment Agreement. II. Financial Impact: There will be no financial impact from this action. Reasons for Recommendations and Background: The County leases a portion of its land near the Buchanan Field Airport to the Solano Way Partnership (Solano)for the operation of a new car dealership. Solano has subleased the premises to Lithia Real Estate, Inc., (Lithia)with the County's consent. Lithia claims to own certain specific oil storage, dispensing, and lubricating equipment on the premises. Lithia desires to sell that equipment to Pennzoil Products Company (Pennzoil),and lease the equipment back from Pennzoil for a five-year term. The County owns reversionary rights to the improvements and fixture equipment on the premises should the lease terminate or expire. Lithia has requested the County's consent to the Loaned Equipment Agreement. IV. Consequences of Negative Action: County will not consent to Lithia's Loaned Equipment Agreement.
