I. Recommended Action:
APPROVE License Agreement with Robert T. Mann and Audrey R. Mann Trust and
AUTHORIZE Board Chair to execute said License on behalf of the Flood Control District.
II. Financial Impact:
Annual revenue of $500.00.

III. Reasons for Recommendations and Background:
The Robert T. Mann and Audrey R. Mann Trust owns a commercial shopping center on the
southwesterly corner of the intersection of Center Avenue and Pacheco Boulevard in Pacheco.
The improvements on the property were constructed quite close to the property line adjacent to
the Flood Control District's Grayson Creek service road. The Manns have requested permission
to use a portion of the service road for delivery of supplies, storage of a dumpster and garbage
removal, and ingress and egress purposes. As a condition of the above-referenced License
Agreement, the Manns agree to pay an annual license fee of$500 and to indemnify the District
against any loss or damage which may occur as a result of their use of the District's property.
IV. Consequences of Negative Action:
The terms and conditions of this agreement limiting the use of the District's property will not be
in force, and problems will continue with unauthorized access and use of the service road.

On August 11,1997,the County Zoning Administrator approved a Land Use Permit fair take out fbod at 5884

issuadce of a building permit for the subject property. of those Conditions,#7,#8,and#9 rec prod you to enter
into a license agreement with the Flood Contra District for temporary paddng for delivene s and supplies and
removal caf'gerbae and construction of a gate at the southwest corner of the project to prevo rt vehicular access
to the Road Control Maintenance mad.
On December 4, 1997, the Flood Control District sent you a copy of the Grayson Crick Munn License
Agreement for your review and signature, On December 16,1997,the Board of Supervisors approved a license
agreement although the license had not been signed As of December 31,1997,the Flood C ontrol permit has
expired.
