HomeMy WebLinkAboutMINUTES - 11191996 - D6 D.6 TO: ,- BOARD OF SUPERVISORS -sE L Contra FROM: SUPERVISOR JIM ROGERS - Costa DATE: November 12 f1996 -' Count sT'� CpUN� REQUEST THAT THE GOVERNOR APPOINT SUPERVIS -ELECT SUBJECT: UILKEMA AND SUPERVISOR-ELECT CANCIAMILLA TO THE BOARD OF SUPERVISORS SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: AUTHORIZE the Vice-Chair of the Board of Supervisors to write to the Governor asking that the Governor agree to appoint Supervisor-Elect Joe Canciamilla and Supervisor-Elect Gayle Uilkema to the Board of Supervisors effective with the resignations of Supervisor Tom Torlakson and Supervisor Jeff Smith from the Board of Supervisors. BACKGROUND: Supervisor Torlakson has been elected to the State Assembly and will have to resign from the Board of Supervisors in order to be sworn into office as a member of the Assembly on December 2, 1996. While the counting of absentee ballots has not been completed in both Contra Costa and Alameda Counties, it appears likely that Supervisor Smith will be elected to the State Senate and will also have to resign from the Board of Supervisors in order to be sworn into office as a member of the State Senate on December 2, 1996. SUPERVI ORS AND COUNTY ADMINISTRATOR See Page 20 BY ,DEPUTY I With the resignations of Supervisors Torlakson and Smith from the Board of Supervisors, the residents of those districts will be deprived of representation for more than a month until Supervisor-Elect Canciamilla and Supervisor-Elect Uilkema assume office on January 6, 1997. In addition, having vacancies in two seats on the Board of Supervisors means that all three remaining Board members must be in agreement on issues in order to conduct business during the month of December 1996. This effectively means that no controversial matters on which even one Board member disagrees will be able to be acted on until the middle of January. Only the Governor can resolve this situation and insure that the residents of Supervisorial Districts II and V have representation and that the Board can conduct normal business during the remainder of the terms of office of Supervisors Torlakson and Smith. He can do this by appointing to serve out the balance of the terms of Supervisors Torlakson and Smith those individuals who have already been elected by the people to replace them. As a result, I am recommending that the Board authorize Supervisor DeSaulnier, as the Vice-Chair of the Board, to write to the Governor and ask him to appoint Supervisors-Elect Canciamilla and Uilkema to serve out the balance of the terms of Supervisors Torlakson and Smith, to be effective upon the resignations of Supervisors Torlakson and Smith. cc: County Administrator Supervisor DeSaulnier Supervisor Torlakson Supervisor Smith Supervisor-Elect Canciamilla Supervisor-Elect Uilkema County Counsel -2-
