SUBJECT: ESTABLISHMENT OF COUNTY CHARTER COMMISSION APPOINTMENT
OF MEMBERS TO THE CHARTER COMMISSION
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. ESTABLISH the County Charter Commission as a 22-member body,
composed as indicated on the attached listing.
2. APPOINT the attached list of members to the County Charter Commission, in
some cases conditioned on their willingness to serve, for a two-year term of
office ending November 30, 1998.
3. DIRECT the County Administrator to return to the Board with additional
appointments to fill the remaining seats on the Commission, as noted, and to
make any additional adjustments in the membership of the Commission which
may be required.
4. AUTHORIZE each member of the Commission to designate an alternate to
participate fully in the meetings and work of the Commission.
5. DIRECT the County Charter Commission to begin meeting as soon as
possible in 1997 and to provide a final report to the Board of Supervisors by
July 1, 1998, along with whatever additional status reports the Commission
deems appropriate in the meantime.

6. AUTHORIZE the County Charter Commission to appoint a Technical Advisory
Committee, consisting generally of appointed representatives including the
County Administrator, one or more city managers, one or more special district
representatives, one or more school district representatives and other
representatives the Commission may from time to time need to add to the
Technical Advisory Committee.
7. AUTHORIZE the County Charter Commission to appoint such subcommittees
as it believes are necessary for the efficient conduct of its business.
8. SUNSET the County Charter Commission effective November 30, 1998.
9. DIRECT the County Charter Commission to prepare a draft Charter which
covers the following three general areas:
4 Matters internal to Contra Costa County government, along the lines of
the more traditional county charters which�are now in existence.
d Matters external to County government, which address cooperation,
coordination and collaboration among the County, the cities, the special
districts and the school districts.
4 Identify and prioritize issues, conditions or problems that the
governments of Contra Costa County (County, cities, special districts
& school districts) should address, including identifying the extent to
which the issue, condition or problem exists currently; quantifying -
where possible - the resources currently being dedicated by the public
and private sectors to address that issue, condition or problem;
suggesting a benchmark for the level at which that issue, condition or
problem should be by some specific date in the future; and a set of
performance indicators that should be used to measure the progress on
each issue, condition or problem.
10. DIRECT the County Charter Commission to provide public notice of its
meetings, REQUIRE that all meetings of the Commission and any
subcommittees be open to the public, and REQUIRE the Commission to
comply with all applicable provisions of the Ralph M. Brown Act and the
County's Better Government Ordinance, both as amended from time to time.
11. DIRECT the Chief Clerk, Board of Supervisors.to enter the County Charter
Commission in the "Maddy Book," although the Technical Advisory Committee
and subcommittees need not be entered in the Maddy Book since their
membership will not be appointed by the Board of Supervisors.
BACKGROUND:
The Board of Supervisors placed an advisory measure on the November 5, 1996
ballot to determine whether the voters were in support of having the Board establish
a Charter Commission to draw up a Charter for Contra Costa County. The voters
provided overwhelming support to this concept, approximately 67% in favor.
In order to provide as much time as possible for the Commission to do its work, it is
important that the Commission be established and members be appointed as soon
as possible.

The proposed composition adheres to the rule that no more than 50% of the
membership of the Commission be from government. It also provides representation
from the major elements of local government, private sector business leaders, and
representatives from academia, the Taxpayers' Association, the League of Women
Voters, Labor, and Environmental Organizations.
We have suggested appointments to most of the 22 seats. In some cases, the
nominated individuals have been contacted and have agreed to serve on the
Commission. In other cases, we are still in the process of contacting individuals.
In still other cases, we still have to contact the represented organizations to identify
the appropriate representative. As additional members are identified and if any
further adjustments are needed in the membership of the Commission those
additional and changes will be returned to the Board for the Board's approval.

ADDENDUM to Item D. 5
November 19, 1996
Supervisor DeSaulnier presented the report on this matter
and moved approval of the recommendations .
Supervisor Torlakson seconded the motion.
Supervisor Rogers spoke in support of the proposed
establishment of the County Charter Commission and he suggested
alternates to those people proposed for membership on the
Commission should those named in the report not be able to serve,
and he requested that the Commission report to the Board of
Supervisors by January 1, 1998 .
Supervisor DeSaulnier concurred with Supervisor Rogers'
suggestions and he clarified two appointments under the Labor
category, Henry Clark with Lou Paulson as alternate .
Supervisor Bishop expressed concerns with a County charter
and the composition of the County Charter Commission and she
advised she could not support the motion.
Supervisor Rogers also suggested that the Board should have
an alternate to Supervisor DeSaulnier to represent the Board of
Supervisors and that the alternate should be one of the three
incoming Board members and that it should be agendaed for the new
Board to decide on who the alternate should be.
The following persons presented comments :

Supervisor Rogers requested the addition to the motion of
the referral to the Internal Operations Committee of the comments
made today relative to the composition of the Commission and
request the Internal Operations to address the concerns expressed
today relative to the composition for any future vacancies that
might occur.
Supervisor Torlakson concurred with Supervisor Rogers
request and he expressed support for the Charter County process
and that he would like the East County issue referred to the
Internal Operations Committee and he also requested that the
Special Districts Association and the Mayor' s Conference be
invited to assign who they wish to represent them on the
Commission.
IT IS BY THE BOARD ORDERED that the recommendations in the
report from Supervisor DeSaulnier relative to the establishment
of a County Charter Commission are APPROVED (See November 21,
1996 , revision attached) , and the composition of the County
Charter Commission as amended (See November 21, 1996, revision
attached) is APPROVED; and it is DIRECTED that future vacancies
on this Commission be referred to the Internal Operations
Committee for consideration and recommendation to the Board of
Supervisors .

nominate individuals to fill any vacancies which occur on the Charter
Commission, REQUEST the Internal Operations Committee to use any
additional appointments to balance the Commission in terms of geographical
