Shasky, 102 Chilpanchingo Parkway, #113, Pleasant Hill; Dorothy Clinton, 2400 Nevin Avenue, #323, Richmond; Ethel Richardson, 44 McAllister, San Francisco, Public Authority Local 250; Bruce Allison, Local 250. The Board of Supervisor also considered comments from the following people: Al Simmons, AMARCH, 2936 Linden, Berkeley, noted that he has not yet received information regarding Black children in group home placement. Rich Gulledge, Hilltop Drive Citizens Advisory Committee, 650 E. Centro Road, El Sobrante, commented on the Hilltop Drive pathway. THIS IS A MATTER FOR RECORD PURPOSES ONLY NO BOARD ACTION WAS TAKEN 0*0 gER�sp Amendments to Public Authority blic Authority advisory designee will take an active role in the bargaining process between the County and union by being given a vote. Before any decision is reached in the bargaining process that a consensus for approval will be forwarded by the Public Authority Advisory Chair Person; any change to the agreed consensus will return to the Advisory for their approval;this will guarantee that the rights of the consumer to hire, fire and managed their own Personal Assistant and to truly remain Independent. 2. That no person shall be required to become a member of a union or to pay dues or fees to any union without the signed consent of the IHSS provider. That an IHSS provider may at any time be granted the right to disenroll from union membership within a disenrollment period from January 1 to January 10 and still maintain their role as an IHSS provider without consequence. I was told we needed to work out some of the bugs in the system. I do remember Kagey asking about the things I am involved with. So after the meeting when she, "said ' I wanted you to tell what IHSS means to you, and your way of life, " I felt awful . There is no way I can put into words just what my motorized wheelchair and my in-home-help has meant to me. All I can do is tell you some of the things I do because of those two things. I am on the Richmod Housing Advisory Board, I have been a member of the Richmond Senior Volunteer Program (RSVP) for about nine years. I volunteer four hours every Wednesday at the Senior Legal Services, I work with the IHSS Task Force, and so many more things that seem small to those that do not need my kind of help, but mean so much to those that do. For instance when someone comes from the hospital and are on a walker, and are afraid to venture out, I let them hold onto the back of my wheelchair and take them around the block or down to McDonalds for a hamburger. I go to a little grocery store, Farmer ' s Market, or the drugstore that ' s nearby for the ones that can not walk that far. I just hang the bag on the back of my chair. We needed Security Guards in our building and Housing would not provide them for us , so I borrowed a city van from the city, and asked a Paratransit driver to drive the bus for me. My daughter helped the seniors get on the van, (they were too frail to walk one block to City hall . ) They could not even get on the van without help. 63 Seniors from our apartment building went to City Hall with me to ask for Security Guards. Three days later we had Security Guards. That ' s just some of the things my in-home-care AND my motorized wheelchair make possible for me to do. They give me my life, not just a life, but a good worthwhile life. Not only is it a good life for this 73 year old woman, but it allows me to help repay some of the good life I have been privileged to enjoy, while helping others . Thank you for any help you can give IHSS. Simmons vice president AMARCH AND CHAIRMAN OF AAGHA. To begin I want to remind this Board that regardless of our efforts to gain access to Black children in foster care for six years we get a lot of rhetoric but little else. Realizing that elected officials come and go, but staff tends to run the show, you might want to review the videotape of your Septem- ber meeting. The Social Services report and ensueing discussion did , indeed fall short of telling the Black community where our children. You might recall your legal representative reciting all the reasons why you could Dt have a community advisory group to help correct the current unsatisfactory policies and practices. It is significant that neither counsel nor staff offered the Board any of the many options available to you. They allowed Supervisor Bishop to assume that an oversight committee would be illegal. When she expressed that opinion the director in a very convincing tone said "RIGHT" . You will recall that the committee chair expressed � unflappab13 faith in the staff' s position etcetera. The Black community would like to be able to share that trust. Therefore, we present to Supervisors a non controversial format that provides the information that we requested of staff one year ago. It is important that we pay lose attention to IN COUNTY and OUT OF COUNTY placements. I hav peen assured that you only place Black children within Contra Cost:: County. I hope this information will be available before the 30th to allow some time to read and digest. Thank you. This ongoing volunteer El Sobrante resident effort has been conducted by the Hilltop Drive Citizen Advisory Committee. This committee officially began in 1991 as the Hilltop Manor Neighborhood Council and in August 1993 became the HDCAC-a sub TAC to the El Sobrante Traffic Advisory Council. It has since become an ad hoc committee to the El Sobrante Municipal Advisory Council. The purpose of this document is two-fold: 1. advise the Board of an alternative to the current legal deadlock between County Public Works and the First Baptist Church located in the City of Richmond and adjacent to the County right of way for Hilltop Drive. 2. to address concerns associated with other safety related improvements. HDCAC believes that it is in the best interests of the City and the County from both the perspectives of safety and staff costs, energy, and time to resolve this dispute with mutually agreeable terms as soon as possible. HDCAC believes it is in the best position to commence discussion of those terms. A brief description of the situation with references to enclosures follows: Public Works staff contend that the Church did not obtain the proper permit to alter drainage facilities in the County's jurisdiction between the Church and the County road. Richmond staff contend that the contractor failed to obtain a City permit to pave an old gravel parking lot that County staff contend will now add to an existing flooding problem on the property of a private residence in the County across the Drive. Richmond and County staff concur that permits shall not be issued until all Conditions of Approval from both jurisdictions are met. Please, review the enclosed letters from both agencies and the Church's Counsel for enumeration, content, and refutation of the COA's. The HDCAC has chosen to involve itself in this dispute because construction of the western most segment of a Board allocated(Sept. 1991)pedestrian path cannot begin in a cost effective manner until the parking lot paving and it's storm run-off issues are resolved. The path will cross the new parking area and the rushing water created by the impervious asphalt surface(I 3,000t sq. ft.)should be conveyed under the raised pathway so that it does not cross over the path. The rain storm on Oct. 29 has already proven the previously asserted need for conveyance under the path at this location. Some junior high and elementary school children walk this route to school regardless of the weather. The primary motivation of the Deferred Improvement Agreement already imposed upon and settled with the Apostolic Faith Church next door to First Baptist and the same imposition on Baptist are opposed by HDCAC because further widening of the pavement will result in further increases in vehicle speed and accidents. 85%of traffic already exceeds the posted limit by 12MPH. Currently, speeds frequent 50WH in a 25WH zone. Many unrecorded accidents occur on this road, even though the CHP cites aggressively. Pavement widening will also encourage additional illegal and unsafe passing on both the left and right. Canvassing of the residents along Hilltop Drive has revealed this aggregate opinion. Residents already experience significant egress and ingress driveway problems because of traffic speed and volume. With some dedication of First Baptists frontage,HDCAC believes a durable safe and aesthetically pleasing asphalt path can be constructed for less cost than concrete, curb, and gutter. First Baptist should still make safe their drainage alterations made adjacent to the roadway. Landscaping and soil removal as recommended by City staff don't affect County responsibilities. As for the residential flooding,the Baptist Church's contractor has a conditional agreement with the County,the Church and the resident to increase the size of the pipe under the street and under the residents property,at the contractor's expense, should it be agreed to by all parties that such pipe replacement will be the extent of and all of the required work. In summary,the HDCAC is requesting the Board's support in: 1. having our input involved in a concurrent manner as an equal partner in arriving at a final settlement as to how and where our path and directly associated drainage facilities will be.constructed throughout it's entire length. 2. having the DIA removed and reduce the 15 foot ROW dedication for the First Baptist Church as COAs for issuance of an encroachment permit, in return for the necessary frontage to construct a path and connect it to the concrete sidewalk to the west and the already aligned path to the east and the Church correcting the storm run-off drainage facilities along its frontage as already discussed with staff. 3. agreement to maintaining Hilltop Drive from Alhambra to Manor at it's present paved width. 4. encouraging Public Works staff to proceed steadily without delay in the proper preparatory processes and to begin construction as soon as possible along the entire length of the pathway project. 5. having Public Works staff prepare a critical path and timeline schedule for the remaining project and deliver it to the ESMAC chair so that HDCAC may plan its activities accordingly. The schedule should include anticipated lengths of time for each part of the project. Addendum: The HDCAC has already met with the Deacons of the Church and they are conceptually in agreement with the terms listed above. Further information about assumption of liabilities for the new path and ROW are necessary to complete the negotiation process. Assistance from Public Works staff in compiling the appropriate ordinances and statutes would be greatly appreciated. The Deacons expressed the desire to commence fulfilling their responsibilities as indicated above as soon as possible. Hilltop Drive Improvement Plan General: The County Board of Supervisors has authorized the Public Works Department to use Road Funds (Proposition 111 Gas Tax Funds) for safety and operational improvements on Hilltop Drive. The residents felt that vehicles traveled too fast on Hilltop Drive, there were sight distance problems on some of the side streets and driveways, there were no places to walk and several other issues were a concern. The Public Works Department has been continually meeting with the Hilltop Citizen's Advisory Committee (HCAC) to develop goals for the study and to get a sense of the type of problems the residents in the Hilltop area would like to correct. More recently, the proposed improvement plan and status of its respective stages have been discussed. Propositsion 111 Gas Tax funds are collected by the State and forwarded annually to the County. The Public Works Department has been receiving approximately $14 million per year in Road funds. The majority of the funding, approximately $9.7 million, goes towards the County maintenance operations,. The remainder of the monies are designated for items such as traffic safety operations, the Community Development Department and capital road projects. The Hilltop Drive Improvements fall under this last category. The County relies on many other sources of project funding than the Road funds. All of these funding sources, such as the Area of Benefit fee program and grant monies have been coming in significantly less than expected. The Road funds have had to cover several unanticipated project deficits. Hilltop Drive Improvement Project will continue to receive some of this funding, but it is coming in less than expected. We have had a request from Bill's Underground, the contractor listed on the permit, to approve the work and thus release the $500.00 bond. We have several concerns regarding the work performed under the above permit: 1. The work is much more extensive than that described on the permit. The roadside drainage ditch has been filled in, the existing 12 inch diameter culverts extended as well as the driveways widened. In addition, an area approximately 6 feet by 300 feet has been paved over with asphalt concrete. We would like you to submit a plan and project description to our building permit center that more accurately describes the above work so we may evaluate it accordingly. The plan should show existing information as well as the proposed project (now complete). 2. The existing driveways have been widened significantly allowing more vehicles than before to access Hilltop Drive directly. We recommend that if diagonal parking is to remain, the angle of the parking stall be changed from 90 degrees to 60 degrees. This will allow for a 20 foot buffer zone behind the parking stall for a vehicle backing up to maneuver safely and enter Hilltop Drive at a better angle than if the stall parking angle was kept at 90 degrees. The recommended clear zone behind a 90 degree parking stall is 24 feet. The current parking stall configuration has only a 20 foot clear zone to the edge of Hilltop Drive. A 60 degree angle parking would provide a safer area for your parking lot users. We are also concerned about a parking lot recently constructed on the east side of your parcel without the required permits from the City of Richmond. As you are aware, the church parcel is located within the City of Richmond but fronts on Hilltop Drive, a roadway within the unincorporated area of the County. It is my understanding that this parking lot was paved without going through the City of Richmond's permit process. Even though this church is located within the City of Richmond it gains access and services via a'county road (Hilltop Drive), and more importantly, its storm drainage naturally flows to the south out of the City of Richmond and into unincorporated Contra Costa County. The City of Richmond has given us the opportunity to provide input on what conditions of approval the County would impose for the approximately 13,320 square feet of new paving placed at the First Baptist Church. The first and most important condition that the County would place on this project, relates to the additional stomi drainage generated by this new impervious surface area. The County requires that new development, such as this parking lot, "collect and convey"the storm drainage to an adequate storm drain system or an adequate natural water course. The existing 12 inch culvert beneath Hilltop Drive in the vicinity of this church is inadequate. Moreover,this culvert then drains into a private 12- inch storm drain system across Larry Neptune's property at 4566 Hilltop Drive. Mr. Neptune has informed us that tivs storm drain system is also inadequate. It is our concern that with the additional impervious surface area created by this parking lot, the already over taxed storm drain system will fail to convey the storm water and could potentially cause flooding damage to Tor. Neptune's property and possibly other private properties or County facilities. Therefore, we are requesting that the First Baptist Church be required to collect and convey the additional storm drainage per Title 10 of the County Ordinance Code. After doing a preliminary review of the existing storm drainage system and the existing hydrology in the area, �it is our belief that a storm drain system must be installed to convey apprommately 6.5 cubic feet per second of storm flow (10 year storm). We believe that the most economical design would include installation of an 18-inch reinforced concrete pipe beneath Hilltop Drive,two new storm drain inlets(one on each side of Hilltop Drive) and an 18- inch plastic storm drain pipe from Hilltop Drive right of way to a point of adequate discharge. We believe the cost of this system would be in the range of$8,000 to $13,000. However, there may be a possibility that the County could participate in the portion of this improved storm drain system within the County road right of way. Our second area of concern involves traffic safety. After being field reviewed by our County Traffic Engineer,we are concerned that the new perpendicular parking that is being used along the frontage of the First Baptist Church, does not provide adequate back up space and that vehicles may be forced to back up into on coming traffic on Hilltop Drive. Therefore, we are requesting that if the use of the parking spaces directly off of Hilltop Drive is continued, that they be re-striped at a 60° angle, providing adequate room for vehicles to back up without interfering with the traffic on Ililltop Drive. HUltop Drive is shown on the County's road circulation plan. As a result, if this parking lot were permitted through Contra Costa County we would also ask for right of way dedication and frontage improvements. The County is requesting that the following Conditions of Approval be imposed on this development: 1. Collect and convey the drainage that originates on or passes along this property to an adequate manmade storm drainage system or natural watercourse. 2. Restripe the perpendicular parking along the frontage to the satisfaction of the County's Traffic Engineer. 3. Right of Way Dedication-We would request that the right of way be dedicated along the parcel for First Baptist Church to accommodate ultimate widening of Hilltop Drive in this area. The ultimate roadway and right of way width along Hilltop Drive will be a 40-foot wide roadway within a 60-foot right of way. The current road along the church's frontage is approximately 22-feet wide within a 45-foot wide right of way. We are, therefore, requesting that the church dedicate an additional 15-feet of right of way along its Hilltop Drive frontage. 4. Frontage Improvements - We would require the applicant to enter into a Deferred Improvement Agreement whereby, at such time as the County deems necessary, the property owner(First Baptist Church or subsequent property owners)would be required to pay for the design and installation of necessary pavement widening, curb, gutter, and any necessary longitudinal or transverse drainage. Your characterization of the subject parking lot as"new" in the last paragraph of your letter indicates that you are unaware of the fact that the First Baptist Church has been using the subject lot continuously for parking for more than twenty years;.thus, it is not new. Please be referred to the enclosed copy of my letter to Rich Davidson which explains this point in more detail. You state that you are most concerned about the adequacy of the storm drainage system appurtenant to the parking lot and you make certain recommendations as to how to alleviate this perceived problem. It is our understanding that Mark Raine, my client's general contractor, already has made arrangements with representatives of the County to proceed to install the proposed drainage system pursuant to your specifications. Accordingly,this issue is moot and the first Condition of Approval which you imposed appears to be met. Parenthetically,Mr.Neptune,the owner of the property at 4566 Hilltop Drive, has been complaining repeatedly since 1978 about the fact that his property has been flooded many times because of inadequate storm drainage. Therefore,it is clear that the recent paving of the subject - parking lot could not be the only cause of flooding in the area, especially since the new storm • drainage system recently installed by the First Baptist Church in accordance with conditions previously imposed by Contra Costa County is designed to collect much of the water runoff and 16/7 Mr.Rich Lierly October 21, 1996 Page 2 has not yet been tested by any rains. In other words, it is more than likely that the newly paved lot will produce lesser amounts of runoff. The other concern noted in your letter relates to traffic safety and you suggest altering the -configuration of the parking spaces in remediation. Your second Condition of Approval addresses this point. Please be advised that my client does not see any difficulty complying with this Condition, even though the area in question has been used for parking for many years prior to this time as it presently is laid out and no one has ever cited it as hazardous. We are at a loss to understand how Conditions numbers 3 and 4 relate in any way to the two concerns noted in your letter. It appears that the County simply is taking undue advantage of a procedure which is of doubtful validity in this case (the City of Richmond permit requirements) to extract very costly improvements and benefits from the Church without regard to fairness and without any logical connection to the long-established uses attributable to the Church property. Notwithstanding my client's contention that Conditions number 3 and 4 are objectionable because they are being imposed unconscionably, it is willing to work with the-El Sobrante Municipal Advisory Council (ESMAC) in a good faith attempt to develop a mutually beneficial plan whereby the County obtains some use of part of the land,while, at the same time, the Church is not overburdened functionally or financially. My client already has met and conferred with Hilltop Drive Citizens Advisory Committee regarding these issues and considerable progress has been made towards a meeting of minds on viable solutions. If arrangements are not made to the satisfaction of all concerned, my client will have no alternative but to remove the new surface of the lot and restore it to its former condition. effectively obviating the need to obtain any approvals from either the City of Richmond or the County and thereby preserving the status quo ante.
