BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on November 19. 19% by the following vote:
AYES: Supervisors Rogers, Bishop, DeSauhuer, Torlakson and Smith

ABSENT: None
ABSTAIN: None
SUBJECT: Report From Staff and Counsel On The Issues Presented
By Stephen Chase Related To The "Hill 310" Land Creep,
Bay Point Area.

On this date the Board considered the oral report presented
by Tim Ryan, Special Counsel retained by Contra Costa County in
connection with efforts to recover the massive expenditures that
have been made to repair the Sea Breeze landslide . Mr. Ryan
reported the various efforts being made on the repairs and he
also commented on the damage that has occurred to Mr. Chase' s
home being cosmetic damage rather than structural damage .
Mr. Stephan Chase, 1279 Beaulieu Drive, Baypoint, commented
that the issues and concerns that he has raised have not been
addressed in Mr. Ryan' s oral report .
Supervisor Torlakson suggested that the Board accept the
oral report and request further followup in writing on issues
such as the location of the drainage gallery and whether the
damage is structural or cosmetic and perhaps include a third
party to help resolve the issues .
IT IS BY THE BOARD ORDERED that the oral report from Tim
Ryan, Special Counsel, on the issues presented by Stephan Chase
related to the Hill 310 Land Creep, Bay Point area, is ACCEPTED;
and staff and County Counsel are DIRECTED to provide a written
report to the Board of Supervisors on issues, including the
drainage gallery location, Mr. Chase' s concerns and the possible
inclusion of a third party to resolve the issues, and
confirmation of whether the damage to Mr. Chase' s home is
structural or cosmetic .
