Recommended Action: A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated October 28, 1996 from Jorgen Clausen and Kristine Clausen. B. AUTHORIZE the Public Works Director to execute said Right of Way Contract on behalf of the County. C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to issue a check for $22,000 payable to Chicago Title Company, 590 Ygnacio Valley Road, Suite 300, Walnut Creek, CA., 94596, Escrow No. 77247, to be forwarded to the Real Property Division for delivery. D. DIRECT the Real Property Division to have the above-referenced Grant-Deed recorded in the Office of the County Recorder. Financial Impact: Payment totaling $22,000 which is 80% reimbursable from federal HBRR funds; remainder comes from the Road Fund. III. Reasons for Recommendations and Background: This project was developed to replace an aging and narrow bridge structure over Tassajara Creek at Highland Road. The new bridge is located approximately 100 feet to the south, and Highland Road has been realigned vertically and horizontally to provide improved sight distances. In addition to monetary compensation for the above-referenced Grant Deed, the County will vacate the public interest in the section of old Highland Road which is being replaced; ownership of said roadway will then revert to the Clausens as owners of the underlying fee. The County also plans to vacate and quitclaim to the Clausens surplus road right of way along Camino Tassajara at its intersection with Highland, exchanging it on a square-foot-for-square-foot basis for a portion of the property rights required for this project. IV. Consequences of Negative Action: The project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications.
