No. 4054 The Board of Supervisors of Contra Costa County RESOLVES THAT: On November 19, 1996, the Board adopted Resolution No.96/521 which vacated Vasco Road. This Board hereby DETERMINES that said land, described in Exhibit "A" attached hereto, was previously subject to a street, highway or public service easement, and is no longer needed by the public. Pursuant to Streets and Highways Code Section 8355, and in consideration of the terms and conditions of the Cooperative Agreement being satisfied (Cooperative Agreement, between Contra Costa County and Contra Costa Water District, is on file with the Public Works Department)the Board hereby APPROVES the quitclaim of said property to Contra Costa Water District and AUTHORIZES the Chair to sign a Quitclaim Deed on behalf of the County. The Real Property Division is DIRECTED to cause said deed to be delivered to grantee. This conveyance request is part of a larger project for which an EIR was prepared and approved by the Board. Gallagher, etal, the proceedings of which are recorded in the office of the County Clerk in "Road Records" Book at page 280, and as said road is described in the Grant Deed from M. Grunauer, et ux, recorded June 5, 1941 in Book 597 of Official Records, at page 48, and in the Grant Deed from Edward C. Grueninger, recorded June 20, 1941 in Book 603 of Official Records, at page 278, and in the Deed from the Estate of Mary Ives Crocker, deceased,recorded June 20, 1941 in Book 613 of Official Records, at page f92, and in the Grant Deed from Oscar L. EXCEPTING THEREFROM: A non-exclusive right of way in favor of Carol A. Davis, trustee of the Davis Family Trust for use as a roadway for vehicles of all kinds, pedestrians and animals, for water, gas, oil and sewer pipe lines, and for telephone, electric light and power lines and cable, together with the necessary poles or conduits to carry said lines over the following described parcel of land: That portion of the previously described area to be vacated which lies northerly of the westerly prolongation of the southerly line of Parcel 'C' as said Parcel 'C' is designated on the map of Subdivision M.S. 141-74, filed July 9, 1975, in Book 38 of Parcel Maps at page 41, records of said County. RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and Highways Code, the easement and right at any time, or from time to time,to construct,enlarge, maintain, operate,replace, remove and renew those existing and in place utilities, as of the date of recording this instrument, in, upon,over and across any highway or part thereof proposed to be vacated, including access to protect the property from all hazards, in,upon, and over the area herein before described to be vacated.
