The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer
required for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter
4 of the Streets and Highways Code, commencing with Section 8330.
This vacation request is for a roadway located in the Byron area. A description of
the vacated area is attached hereto as Exhibit "A" and incorporated herein by reference.
This vacation request is based on the fact that the street or highway has been
superseded by relocation (S. & H. Code Section 8330).
This vacation request is part of a larger project for which an EIR was prepared and
approved by the Board. The project has been determined to conform to the County's
General Plan.
RESOLUTION NO. 96/521
This Board declares that the hereinabove described proposed vacation area is
HEREBY ORDERED VACATED subject to any reservation and exception described in
attached Exhibit"A". From and after the date this Resolution is recorded, the area vacated
no longer constitutes a public highway.
The Real Property Division is ORDERED to record a certified copy of this
Resolution in the office of the County Recorder.

EXIMIT A
All of that County road known as Vasco Road, as acquired by Contra Costa County and established
by the Board of Supervisors of Contra Costa County,November 3, 1879 upon the petition (No.
29A) of H.C. Gallagher,etal,the proceedings of which are recorded in the office of the County
Clerk in "Road Records" Book at page 280, and as said road is described in the Grant Deed from
M. Grunauer,et ux,recorded June 5, 1941 in Book 597 of Official Records, at page 48, and in the
Grant Deed from Edward C. Grueninger, recorded June 20, 1941 in Book 603 of Oficial Records,
at page 278, and in the Deed from the Estate of Mary Ives Crocker,deceased,recorded June 20,
1941 in Book 613 of Oficial Records, at page I92, and in the Grant Deed from Oscar L. Starr,
etux,recorded January 22, 1942 in Book 632 of Official Records, at page 165, and in the Grant
Deed from Sarah Longwell,recorded February 5, 1942 in Book 604 of Official Records, at page
223, and in the Grant Deed from Frank Nunez Cabral, recorded February.19, 1942 in Book 630 of
Official Records, at page 447, and in the Grant of Easement from Florence G.Baldwin,recorded
August 25, 1947 in Book 1122 of Oficial Records, at page 167, and in the Grant Deed from

page 803, and in the Offer of Dedication, as provided for in the Owners Certificate of the Parcel

Contra Costa County records, further described as all of Vasco Road lying southerly of the south
line of Camino Diablo to the Alameda/Contra Costa County line. (Not including however any
portion thereof contained in the Order of Abandonment by the Board of Supervisors of Contra
Costa County recorded November 20, 1942 in Book 655 of Official Records, at page 285).
EXCEPTING THEREFROM: A non-exclusive right of way in favor of Carol A. Davis, trustee of
the Davis Family Trust for use as a roadway for vehicles of all kinds, pedestrians and animals, for
water, gas,oil and sewer pipe lines, and for telephone,electric light and power lines and cable,
together with the necessary poles or conduits to carry said lines over the following described parcel
of land:
That portion of the previously described area to be vacated which lies northerly of the
westerly prolongation of the southerly line of Parcel 'C' as said Parcel 'C'is designated on
the map of Subdivision M.S. 141-74, filed July 9, 1975, in Book 38 of Parcel Maps at page
41, records of said County.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and
Highways Code, the easement and right at any time,or from time to time,to construct,enlarge,
maintain, operate, replace, remove and renew those existing and in place utilities, as of the date of
recording this instrument, in, upon, over and across any highway or part thereof proposed to be
vacated, including access to protect the property from all hazards, in, upon, and over the area herein
before described to be vacated.
