ADOPTED Resolution No. 96/492 authorizing the County to withdraw from the Delta Advisory Planning Council; 2. DIRECTED the Community Development Director to prepare a commendation for Bob Gromm to be presented by the Board of Supervisors for his outstanding leadership in the Delta Advisory Planning Council; and 3. DIRECTED the Community Development Director to bill Sacramento County for Contra Costa County staff time, as appropriate. ATTESTED: November 19, 1996_ Phil Batchelor, Clerk of the Board of Supervisor County Administrator C ine Wampler, Deputy CIGk cc: Board of Supervisors County Administrator Community Development Director THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 19, 1996 by the following vote: AYES: SUPERVISORS ROGERS, BISHOP, DE SAULNIER, TORLAKSON AND SMITH NOES: NONE ABSENT: NONE ABSTAIN: NONE RESOLUTION OF INTENTION TO WITHDRAW FROM THE DELTA ADVISORY PLANNING COUNCIL RESOLUTION NO. 96/492 WHEREAS, the 1992 Delta Protection Act authorized the formation of the Delta Protection Commission, comprised of 19 members of local and state agencies and individuals, which effectively replaces the Delta Advisory Planning Council; and WHEREAS, the Delta Advisory Planning Council was established by a Joint Powers Agreement dated October 2, 1972, among the counties of Contra Costa, Sacramento, San Joaquin, Solano, and Yolo to advise local government officials regarding the development, coordination and completion of comprehensive planning studies in the Delta area; and WHEREAS, pursuant to Paragraph 17 of this Joint Powers Agreement, any signatory county may, at any time, withdraw from the Council if their intent to withdraw is stated in the form of a resolution and enacted by the Board of Supervisors of the County wishing to withdraw. The resolution of intent to withdraw from the Council is to be given to the Chairman by the withdrawing county at least 90 days prior to the effective date of the withdrawal. Pursuant to Paragraph 19 of the Joint Powers Agreement, the Delta Advisory Planning Council may be dissolved upon the withdrawal of a majority of the signatory counties; and WHEREAS, the Delta Advisory Planning Council is superseded by the Delta Protection Commission and is therefore redundant. IT IS HEREBY RESOLVED that it is the intention of this Board to withdraw and it hereby does withdraw from the Delta Advisory Planning Council pursuant to the above-mentioned sections of the Joint Powers Agreement establishing the Council. Dept: Community Development Contact: Roberta Goulart(335-1226) SUMMARY MINUTES DELTA ADVISORY PLANNING COUNCIL November 21, 1994 ATTENDING: Supervisor Toby Johnson, Sacramento County; Supervisor George Barbour, San Joaquin County; Supervisor Tom Torlakson, Contra Costa County: Chairman Bob Gromm, Staff Roberta Goulart Others attending: Margit Aramburu (Executive Director, Delta Protection Commission), Seth Cockrell (Western Waterways) A quorum was established with the attendance of Supervisors of three delta counties. 1. The dissolution of DAPC, and/or the potential for its continuance. Discussion focused on the relative need for DAPC with the establishment of the Delta Protection Commission (Commission) in 1992, and the fact that the five Delta Counties are now members of the Commission and are meeting in that capacity. The enabling legislation calls for a sunsetting of the Commission in 1997, and Supervisor Barbour felt that the Commission's time would be extended. If the Commission was not extended, then some consideration of DAPC continuation would be in order. Chairman Bob Gromm commented that perhaps DAPC erred in not bringing the documents produced by DAPC to the Secretary of State so they would have been officially adopted. Supervisor Tom Torlakson agreed, commenting that DAPC pioneered some good things, and initiated a good working relationship among the counties, but at this point, he felt that the Commission has more potential to accomplish common goals, than does DAPC. In fact, DAPC's continuance may be confusing. Seth Cockrell commented that he prefers DAPC in inactive status, rather than dissolved, in case the Commission is allowed to sunset. Supervisor Torlakson commented that there is a DAPC fund in Sacramento County which needs to be liquidated. Chairman Gromm countered that Yolo County has neglected to attend nor pay fees for the last few years, and that their funds were expended before they dropped out. A motion was made, seconded and passed unanimously to provide funds back to the counties,with the exception of Yolo County, in the relative percentages in which they were provided, as follows; Contra Costa and Sacramento Counties at 33% each, San Joaquin County 22%, and Solano County 12%. A Motion was made and seconded for a resolution of dissolution of DAPC,working through the member counties by resolution. The October 2, 1972 Joint Powers Agreement allows for a majority of 3 counties to withdraw via resolution, essentially dissolving DAPC. Supervisor Torlakson amended the Motion to indicate that they are not abandoning the Delta, and if the Commission should sunset, then the delta counties should consider a joint powers agreement at that time.
