SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
AUTHORIZE County Counsel to file a lawsuit, if necessary, against David Bloomfield, et al, to
recover funds spent to remove hazardous waste material from property sold to the District for the
Deer Creek Detention Basin, off Fairview Avenue in Oakley.
11. Financial Impact:
The District is seeking to recover approximately $38,895 spent for the removal of hazardous
waste material.

III. Reasons for Recommendations & Background:
The contract with the Bloomfields required them to reimburse the District if it was necessary to
remove any hazardous waste material from the property purchased for the Deer Creek Detention
Basin. Hazardous waste material was discovered on the property and after the Bloomfields
refused to participate in the removal of same, the District had the material removed at a cost of
approximately $38,895. The District seeks to recover this amount from the Bloomfields under the
terms of their contract.
IV. Consequences of Negative Action:
The District will not be able to recover approximately $38,895 spent on the removal of hazardous
waste material from the Deer Creek Detention Basin site.
