Adopted this Order on November 19, 1996 by the following vote:
AYES: Supervisors Rogers, Bishop, DeSaulnier, Torlakson, Smith
NOES: None
ABSENT: None
ABSTAIN: None
SUBJECT: Release of Cash Deposit to Lippow Development(Encroachment Permit No. 11027)
for satisfying deficiencies for Minor Subdivision 75-84, Pacheco area.
On April 20, 1993, this Board resolved that the improvements in Minor Subdivision 75-84
were completed With deficiencies as provided in the Subdivision Agreement with Vine Hill Business
Park and the$1,000 cash deposit was not refunded, now on the recommendation of the Public Works
Director;
The Board hereby FINDS that the deficiencies have been corrected by the adjoining property
owner, Lippow Development. These deficiency corrections were completed under Encroachment
Permit# 11027 dated October 24, 1996.
IT IS BY THE BOARD ORDERED that the Public Works Director is AUTHORIZED to
refund the$1,000 cash deposit (Auditor's Deposit Permit No. 105955, dated March 21, 1986) plus
interest in accordance with Government Code Section 53079, if appropriate, to Lippow Development
Company, pursuant to Ordinance Code Section 94-4.406 and the Subdivision Agreement.
