ADVISORY BOARDS, COMMITTEES AND COMMISSION WHICH ARE
SUBJECT: RESPONSIBLE FOR THE SAME OR SIMILAR SUBJECT MATTER AS THE
EMPLOYEE DEALS WITH ON THE JOB
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ADOPT as a statement of general policy of the County that employees of the County
should not be appointed to County advisory boards which deal with the same or
similar subject matter to that which the employee deals with on the job.
BACKGROUND:
Our Committee has recently been confronted with one or more situations where an
employee of the County is recommended for appointment to an advisory board
which addresses the same or a similar area of subject matter as that for which the
employee is responsible on his or her job. This presents two problems to our
Committee:
1. There is always the potential for a perceived conflict of interest, if not an
actual legal conflict of interest, because the employee may be in a position to
influence recommendations made to the Board of Supervisors by the advisory
board on which he or she serves.
2. Having employees on advisory boards reduces the independent, outside
community advice the Board of Supervisors receives. We assume employees
always the opportunity to make their views known to the Board. We need to
have advisory boards provide independent advice and recommendations.

Supervisor Smith advised that since he is employed as a physician
in the Health Services Department, he was absenting himself from
participating in the discussion and voting on this matter because
of possible conflict of interest.
With Vice Chair DeSaulnier officiating as Chair, the Board
ADOPTED the statement as set forth above.

MATTER AS THE EMPLOYEE DEALS WITH ON THE JOB
As a result, we are recommending that the Board of Supervisors adopt as a general
policy that employees should not serve on an advisory board if the advisory board
addresses a subject matter which is the same or similar to that with which the
employee deals on his or her job. There will always be exceptions to this policy,
such as advisory boards which are intentionally made up of staff to address a
particular area of concern. There may be other occasional exceptions which the
Internal Operations Committee, individual Board members and the Board of
Supervisors may wish to made on an individual case-by-case basis.
