SUBJECT: Determine the Need to Continue the Emergency Action Regarding the Repair of"Hill 310"

SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
DETERMINE that there is a need to continue the emergency action taken by the Board of
Supervisors on June 4, 1996 pursuant to Public Contract Code Sections 22035 and 22050, to
repair the "Hill 310" Land Creep, Bay Point.
11. Financiallmpact:
Total cost of repairs cannot be fully determined at this time, but staff is developing an estimate
for completion of the repair.
III. Reasons for Recommendations and Background:
A. On February 26, 1996, Public Works and Building Inspection were notified that cracks
were occurring in Beaulieu Court. The County hired a geotechnical firm to identify the
cause of the slide, and recommend and direct remedial actions to mitigate land movement.
B. On March 19, 1996 the Board of Supervisors concurred in the County Administrator's
proclamation of a local emergency.
C. On June 4, 1996 the Board of Supervisors declared an emergency and authorized the
Public Works Director to proceed in the most expeditious manner to repair the area subject
to creep.

Board Agenda.

D. Repair status:
1. Ford Construction Company, Inc. is under contract to complete the first phase of the repair
consisting of an earth buttress. Work began on September 3, 1996 and is expected to be
completed by mid-November.
2. Judd Drilling is under contract to complete the second phase of the repair consisting of a
drainage gallery. This work began September 25, 1996 and is expected to be completed
by late November.
3. Geotechnical and civil engineering consultants are preparing a summary report.of the
investigation, analysis, and repair. The consultants have installed subsurface monitoring
devices in the project site and will monitor the instrumentation during the construction
period of this project.
4. Environmental staff members have prepared a report detailing proposed mitigation for the
wetland impacts resulting from the project. This report was submitted to the Bay Area
Regional Water Quality Control Board for review and approval.
IV. Consequences of Negative Action:
Repair work would not be completed before next winter.

Dear Supervisor Smith,
As you are aware, the Board and County Staff has been involved in
the situation in Baypoint regarding a land creep that exists under
my home. Staff, with Board approval have taken measures they hope
will stop the land creep, and prevent further damage to my home as
well as other homes and roadways involved in this problem. As you
may also recall, I have encouraged the Board to approve a proposal
for the County to purchase my home because of the damage it has
incurred as the result of the land creep.
In the past month, there has been developments regarding my home
and the land creep problem. I would like the opportunity share
those results with the Board at the next scheduled Board meeting on
November 5, 1996. As part of my presentation, I would like to show
the Board a short video tape related to these issues. I believe
this new information may alerter past questions members of the
Board have had regarding requests for the County to purchase my
home. I do not anticipate requiring more than five minutes for my
presentation.
This represents my formal request to be included on the agenda for
the November 5, 1996 Board of Supervisors meeting.
