BACKGROUND/REASONS FOR RECOMMENDATIONS
At the October 15, 1996 Board of Supervisors hearing, staff
reported on efforts to complete three improvements associated with
the recently approved modification to the Final Development Plan
for Bettencourt Ranch: (1) issuance of building permits for
construction improvements within the creekbed next to the detention
basin associated with required recreational improvements; (2)
hydroseed improvements for the graded slopes on the north side of
the ridgeline; and (3) commencement and completion of cul-de-sac
and geotechnical repairs for the area at the end of Fleetwood Road.
The Board asked that staff work with the developer, -Dame
Construction Company, to see that these improvements are completed
before rainy conditions either aggravate existing conditions or
prevent such work from occurring.
Creekside Improvements for Detention Basin Recreation Area
The Building Inspection Department has- -s building permits for
the creekside improvements associated with the recreation tot-lot
area next to the detention basin. These improvements. consist of
abutments for two pedestrian bridges, retaining walls and grading
for pedestrian paths .

Hydroseed Improvements for North Side of Ridge
Following the last Board meeting, the developer submitted a revised
landscape plan for the common area of the last phase of Bettencourt
Ranch, Final Map Subdivision 7279 . On October 18, 1996, the
Community Development Department approved the revised landscape
plans with minor modifications . These plans include hydroseed
improvements for the graded slopes . On that same day, the
developer indicated that he was trying to find out whether he could
schedule the hydroseeding improvements and give staff a date
certain as to when the improvements would be completed. Staff may
receive a commitment from the developer by time of the Board
meeting on October 22, 1996 .
In the absence of such a commitment then staff will explore
possible enforcement actions that may be taken against the
applicant (e .g. , non-compliance with grading ordinance) .
Fleetwood Road Cul-de-Sac Improvements
At the hearing on October 15, 1996, staff reported that staff had
received a peer review report from the County Consulting
Geotechnical Engineer, Rogers/Pacific, on the proposed improvements
at the end of Fleetwood Road. That report recommended a couple of
modifications including those relating to drainage improvements .
The report was forwarded to the applicant and he was asked if they
would agree to include those recommendations in their project .
The developer indicated that his geotechnical engineer had some
concerns with the recommendations from Rogers/Pacific . According
to the developer, the developer' s geotechnical engineer and the
County' s consultant were meeting on October 18, 1996 to attempt to
resolve their differences .
As of the preparation time of this report, no resolution has yet
been reached, however such a resolution may occur prior to the
Board meeting on October 22, 1996 . As soon as the differences are
resolved, then Community Development Department staff will be able
to clear a grading permit, and it is staff' s understanding that the
Building Inspection Department is prepared to issue such a permit
for the work. At that point, the developer will be able to proceed
with the Fleetwood improvements subject to compliance with the
Grading Ordinance.
If the differences between the geotechnical professionals cannot be
resolved, then there may be a need for a meeting on this matter
between County staff and the developer to review possible
alternatives .
