This side letter is necessary in order to allow employees an opportunity to participate in an open enrollment process and meet the January 1, 1997 Health Care Spending Account Program implementation date. It is the intent of the parties that the provisions of the attached Health Care Spending Account Program will be incorporated into the Memoranda of Understanding to be approved by the Board of Supervisors at a later date. The provisions of this side letter shall be superseded by tentatively agreed to memoranda of understanding with the recognized employee organizations that are members of the Labor Coalition upon ratification by the employee organizations' members and approval by the Board of Supervisors. In the event either the Board of Supervisors fails to approve such a memorandum of understanding or the members of any employee organization fail to ratify such a memorandum of understanding, this side letter shall be void and of no force or effect and the Health Care Spending Account Program shall not be implemented. If the foregoing conforms with your understanding, please indicate your acceptance and approval in the space provided below. The HCSA Program allows employees to set aside a pre-determined amount of money from their paycheck, not to exceed $2400 per year, for health care expenses not reimbursed by any other health benefits plan with before tax dollars. HCSA dollars can be expended on any eligible medical expenses allowed by Internal Revenue Code Section 125. Any unused balance can not be recovered by the employee.
