Re: Health Care Spending Account Program
Dear Damita:
This side letter confirms the tentative agreement signed on March 7, 1996 between
the County and the Labor Coalition regarding the Health Care Spending Account
program (attached).
This side letter is necessary in order to allow employees an opportunity to participate
in an open enrollment process and meet the January 1, 1997 Health Care Spending
Account Program implementation date.
It is the intent of the parties that the provisions of the attached Health Care Spending
Account Program will be incorporated into the Memoranda of Understanding to be
approved by the Board of Supervisors at a later date.
The provisions of this side letter shall be superseded by tentatively agreed to
memoranda of understanding with the recognized employee organizations that are
members of the Labor Coalition upon ratification by the employee organizations'
members and approval by the Board of Supervisors. In the event either the Board
of Supervisors fails to approve such a memorandum of understanding or the
members of any employee organization fail to ratify such a memorandum of
understanding, this side letter shall be void and of no force or effect and the Health
Care Spending Account Program shall not be implemented.
If the foregoing conforms with your understanding, please indicate your acceptance
and approval in the space provided below.
