Recommended Action: A. APPROVE Amendment to Right of Way Contract with Ben S. Romiti and AUTHORIZE Public Works Director to execute said contract on behalf of the County. B. APPROVE payment of$1,050 and AUTHORIZE the Auditor-Controller to issue a check payable to Ben S. Romiti, 1092-2100 Oakley Road, Oakley, CA 94561, to be forwarded to the Real Property Division for delivery. II. Financial Impact: Payment totaling $1,050 from Oakley/N. Brentwood Area of Benefit funds. Reasons for Recommendations and Background: On March 23, 1993, the Board of Supervisors approved the acquisition from Mr. Romiti of certain property rights necessary for the horizontal and vertical realignment of Oakley Road. After completion of the project, Mr. Romiti complained that the new raised grade of the road and shoulder eliminate access to a portion of his property and have resulted in the loss of twenty-one additional vines. Pursuant to the above-referenced Amendment to Right of Way Contract, the compensation is for additional damages to Mr. Romiti's property resulting from the project. IV. Consequences of Negative Action: The property owner would not be fairly compensated for damages which resulted from the project. Further, the County could suffer additional costs associated with legal action undertaken by Mr. Romiti.
