SUBJECT: Contract Award Recommendation: Byron Airport Aviation Fueling System Project,
Project No. 4873-6X5328-95, Byron area.
Specific Request(s)or Recommendation(s)&Background&Justification
RECOMMENDED ACTION:
AWARD the contract for furnishing labor and materials for the subject project to Tank Protect
Engineering of Northern California, Inc., the low bidder, who has also met the requirements of the
County's Minority and Women Business Enterprise Contract Compliance Program, in the amount of
$144,000.00 and at the unit prices submitted; and REQUIRE the contractor to present surety bonds for
Payment and Faithful Performance in the amounts of$72,000.00 and $144,000.00, respectively.
DIRECT the Public Works Director to prepare the contract for the project.
AUTHORIZE the Public Works Director to sign the contract on behalf of the Board subject to the Director
having reviewed and found sufficient all required documents, including the contract signed by the
contractor, the aforementioned surety bonds, and a certificate of insurance.
DIRECT that, in accordance with the project specifications and/or upon the execution of the contract by
the Public Works Director, any bid bonds posted by the bidders be exonerated and any checks or cash
submitted for bid security be returned.
Pursuant to Public Contract Code Section 4114, the Board DELEGATES its functions under Public
Contract Code Sections 4107 and 4110 to the Public Works Director or his designee.
Pursuant to section 6705 of the Labor Code, the Board also DELEGATES to the Public Works Director
or to any registered civil or structural engineer designated by him the authority to accept detailed plans
showing the design of shoring, bracing, sloping or other provisions to be made for worker protection
during trench excavating covered by that section.
DECLARE that, should the award of the contract to Tank Protect Engineering of Northern California, Inc.
be invalidated for any reason, the Board would not in any event have awarded the contract to the second
listed bidder or any other bidder, but instead would have exercised its discretion to reject all of the bids
received. Nothing herein shall prevent the Board from reawarding the contract to another bidder in
cases where the successful bidder establishes a mistake, refuses to sign the contract or fails to furnish
required bonds or insurance (see Public Contract Code Sectio ,5100- 1 7)

FINANCIAL IMPACT:
The project, including engineering and appropriate overhead charges, is funded by Airport Enterprise
Fund (100%).
REASONS FOR RECOMMENDATION/BACKGROUND:
The plans and specifications were approved and the project advertised for bids by the Board of
Supervisors on August 13, 1996. The bids were received and opened at 255 Glacier Drive, Martinez,
California, on September 24, 1996. The construction bids received were as follows:

The three lowest bidders were reviewed for the Byron Airport
Aviation Fueling System project . The lowest bidder, Tank Protect
Engineering of Northern California, Inc . exceeded the Minority
Business Enterprise (MBE) goal and met the Woman Business
Enterprise (WBE) goal . Tank Protect Engineering of Northern
California, Inc . Attained 250-. MBE participation and 6% WBE
participation.
My recommendation is to award to the lowest bidder, Tank Protect
Engineering of Northern California, Inc.

Dear Ms.Quaevor:
As I mentioned to you this morning,we attended the bid opening and had an opportunity to inspect the
bid results. Upon this inspection it is apparent that the apparent low bidder has listed only two sub
contractors,and one supplier fdr this project. The firms named were not assessed with a percentage
of work to be accomplished. Further,only the supplier and the electrical sub contractor were assessed
dollar values. Subcontractors and/or supplier were not indicated to be WMBE firms at time of bid
opening,
it appears that the low bidding contractor has not complied with the requirements of the Counties
Affirmative Action Program, and thus we are protesting the award of the contract. The second
purpose of this letter Is to transmit additional Information to the county concerning our affirmative
action pre bid program. Attached Is a copy of an advertisement in the Solano Builders Exchange
requesting minority sub bids to Avila construction,
+ A copy of a bid from Titan Rubber Suppliers. We did not know that Titan was a minority owned
firm. We have solicited a price from them on September 9 and received a quotation the moming
of September 23,at 9;39 am.
Delta Excavation a minority film wes solicited also on September 9, however, when we
investigated them we discovered that their license was not active-they were not used,
Balch Petroleum Was also solicited to participate on September 9 , Our subsequent negotiation
were not productive and we were not able to use them on this project. We Inadvertently omitted
them from our bid submission relative to the affirmative action submittal.
