SUBJECT: Land Use Permit/Development Plan Fee Waiver/Deferment Request of Love-
A-Child Ministries in Bay Point
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Deny the request of Love-A-Child Ministries for waiver/deferment of
application and development fees.
FISCAL IMPACT
The Community Development Department is fee supported. If fee
waiver or deferment were granted, the Community Development staff
time spent on this application would have to be funded through some
other source. Staff has been unable to identify such an
alternative funding source.
BACKGROUND/REASONS FOR RECOMMENDATIONS
This item was heard by the Board on September 24 , 1996 . At that
meeting, the Board referred the matter to Public Works Department,
Community Development Department and Social Services Department to
give input and to review the fee requirements associated with
reviewing and (if approved) establishing the operation in
compliance with County Code requirements.
Community Development staff has contacted the County Social
Services Department and has been informed by their staff that Love-
A-Child Ministries does not require any permits through their
Department. Social Services has also indicated that they refer
their General Assistance clients to Shelter Inc. , - the organization
that runs the County homeless shelters in Richmond and Concord and
their needs are met through those facilities.

Community Development staff net with Public Works Department staff
to catalog the Public Works Department fees. Mr. Jerome Knott has
obtained the Fire District, School District, Sanitation District
and the County Building Inspection Department estimated fees for
the project.
The Community Development Department's Development Plan/Land Use
Permit application processing fee is $7 , 890. However, since the
use was established prior to obtaining permits, a 50% penalty is
added to the fee bringing the total to $11, 835. This penalty
recoups part of the costs of enforcement. Substantial effort has
been expended to date in this regard for this matter. Since the
Community Development Department is fee supported and no
alternative funding source has been identified, it is critical
that the project proponent pay the $11, 835 fee.
Public Works Department assessment of the traffic mitigation fee
is based on the number of employees at the facility. Mr.Knott has
informed the County that 5 of the 6 employees reside on the
premises. Due to this special circumstance, Public Works
Department is willing to assess traffic mitigation fees based on
one commuting employee. The proposed chapel will be utilized by
the people residing on the premises and would, not generate
additional traffic. The property is not covered by a Drainage
Area Plan and hence no fee is collected towards drainage. The East
Contra Costa traffic mitigation fee is $3 , 683 and the Area of
Benefit fee is $501 . The total Public Works Department fee is
$4 , 183 .
The Building Inspection Department had given an original
estimation of $30, 355 in fees. Out of this total fee, $24 , 070 was
attributed to Public Works Department fee. However, Public Works
Department has now determined that the total fee would only be
$4 , 183 based on use of the property.
The following is a breakdown of the estimated fees to legalize
Love-A-Child Ministries homeless recovery program in Bay Point:

In deference to the Board's deferral of the subject agenda item regarding consideration of fee
waiver/deferral for land use permit/development plan application, the. Building Inspection
Department shall suspend all abatement action pursuant to the Board's resolution of May 21,
1996, (#96/233) until the Board resolves the fee issue at its October 8, 1996 meeting.
The Building Inspection Department has insufficient information regarding the potential
applicants proposal/s to proffer a building permit fee estimate. In any respect, building permits
can be issued only antecedent to the planning application approval. The applicant shall be
subject to regular building permit fees, plus a code enforcement fee of two times the amount and
a fee of $25.00 per inspector site visit as documented under the "Notice to Comply" complaint
(RF940683).
