W R RECORDS COUNTY RECORDER 1FFF � THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on October 8, 1996 by the following vote: AYES: Supervisors Rogers, Bishop, DeSaulnier, Torlakson, Smith NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 96/453 SUBJECT: Completion of Improvements and Declaring Certain Roads as County Roads, Subdivision 7174, Moraga Area. The Public Works Director has notified this Board that the improvements in Subdivision 7174 have been completed as provided in the Subdivision Agreement with Vantage Homes, Inc. heretofore approved by this Board in conjunction with the filing of the Subdivision Map. NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of September 8, 1996 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement: DATE OF AGREEMENT SURETY October 17, 1995 $125,300 Cash Bond ADP No. 267440 Dated September 29, 1995 BE IT FURTHER RESOLVED that$125,300 cash security for labor and materials (ADP No. 267440, dated September 29, 1995) deposited by Vantage Homes be RETAINED for the six-month lien guarantee period until April 8, 1997, at which time the Public Works Director is AUTHORIZED to refund the cash security less the amount of any claims on file. SUBJECT: Completion of Improvements, Declaring Certain Roads as County Roads, and Approve substitute surety, Subdivision 7174, Moraga Area. DATE: October 8, 1996 Page -2- BE IT FURTHER RESOLVED that Knoll Drive and Skyview Court the hereinafter described roads, as shown and dedicated for public use on the Final map of Subdivision 7174 filed October 17, 1995, in Book 383 of Maps at page 11, Official Records of Contra Costa County, State of California, are ACCEPTED and DECLARED to be County Roads. Road Name Road/Right of Way Widths Road Number LengthsCM11W Knolls Drive 28/55 3225 CA .10 Skyview Court 32/40 3225 CB .14 BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby established, and that$37,594 (15% of performance deposit) of the cash deposit (Auditor's Deposit Permit No. 267440, dated September 29, 1995, $263,223) made by Vantage Homes, Inc. be RETAINED pursuant to the requirements of Section 94-4.406 of the Ordinance Code and that $100,329, which represents the remainder of the cash deposit (263,223 - 125,300 - 37,594 = ]00,329) (Auditor's Deposit Permit No. 267440, dated September 29, 1995) be RETURNED to Vinatage Homes, Inc., plus interest in accordance with Government Code. Section 53079, if appropriate, pursuant to the requirement of the Ordinance Code.
