SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated September 18, 1996,
from Francis C. Hardy and APPROVE naming of marsh area being conveyed the "Julia
Cox Freeman Wetlands Preserve," in honor of Grantor's mother.
B. AUTHORIZE the Chief Engineer to execute said Right of Way Contract on behalf of the
District.
C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to
issue a check for $31,000 payable to Chicago Title Company, 590 Ygnacio Valley Road,
Suite 300, Walnut Creek, CA 94596, Escrow Number 76063, to be forwarded to the Real
Property division for delivery.

D. DIRECT the Real Property Division to have the above-referenced Grant Deed recorded
in the Office of the County Recorder.
11. Financial Impact:
Payment of$31,000 from Drainage Area 56 funds.
111. Reasons for Recommendations and Backaround:
These property rights are required for the East Antioch Creek project, part of the East Antioch
Creek Watershed Area Drainage Improvement Plan. The marsh between Wilbur Avenue and
Cavallo Road will be cleaned up and opened to increased tidal water flow preserving and
enhancing the riparian habitat. Over time, the project will result in the reversion of the existing
freshwater marsh to a more natural saline marsh.
The parcels being conveyed total 1.09± acres located in the heart of the marsh area. The
property owner agreed to the District's purchase on the condition that the marsh be named in
memory of her mother, Mrs. Julia Cox Freeman, who was the previous owner of the property.
Mrs. Freeman was a resident of the City of Antioch for forty-five years and raised her four children
there. According to her daughter, she was a good citizen, was devoted to her family and loved
the wildlife which lived on her property. Mr. Victor Carniglia, Deputy Director of Community
Development for the City of Antioch, .has already reviewed and approved the proposed name.
IV. Consequences of Negative Action:
The District will be unable to protect and preserve this valuable environmentally sensitive habitat.
