RECOMMENDATION ACKNOWLEDGE receipt of report requested by the Internal Operations Committee in response to the County' s review of project affirmative action compliance. II . . BACKGROUND On August 28, 1996 the County' s consulting Contract Compliance Specialist sent the Merrithew Memorial Hospital Replacement Project Manager a letter reporting on the status of Minority and Female workforce participation. Overall, the minority employment goal is exceeded with an actual participation percentage of 28 . 050 and the female workforce almost meets the goal with a participation percentage of 6 . 290 . The report advises, however, that a number of individual subcontractors are under their individual goals and are therefore in non-compliance. The report provided a detailed list of subcontractors who currently have a minority workforce less than the 25 . 7% goal and subcontractors who have a female workforce less than the 6 . 90-o goal . BACKGROUND (continued) timely submittal of certified payrolls, the presence of a full time Affirmative Action/Equal Employment Opportunity Manager, the reporting requirements for instances of non-compliance by subcontractors and the initiation of sanctions against subcontractors who are in non-compliance. This report was sent to the General Contractor and all the subcontractors who were in apparent non-compliance . Following distribution of this letter, the Project Manager met with the General Contractor to assure that there was no misunderstanding about the. items in the County' s letter. On September 11, the General Contractor responded to the County' s non-compliance letter. This letter took exception to some of the data while acknowledging the validity of the balance. This letter also addressed his interpretation of certain contract clauses pertaining to placing sanctions on subcontractors in apparent non-compliance . Because of the variety of issues and related contract interpretations, the General Contractor requested a follow up meeting with the Project Manager and Contract Compliance Specialist upon his return from vacation. A meeting will be held on Monday, September 30 . On September 23 , the Contract Compliance Specialist and the Project Manager met to review the contractor' s response and prepare for the upcoming meeting.
