OPPORTUNITY RECONCILIATION ACT ]
WHEREAS, President Clinton signed into law the Personal Responsibility and Work Reconciliation Act
of 1996 (H.R. 3734); and Governor Pete Wilson signed Executive Order W-135-96 to implement this
act that denys benefits to legal immigrants and undocumented residents; and,
WHEREAS, studies consistently show that providing prenatal care services to women is cost-effective, and
that preventive services significantly improve a woman's ability to deliver a healthy baby and minimizes
costly neonatal care. Denying undocumented women access to prenatal care is counter to preventive
healthcare and increases the risk of low birth weight infants while placing the expectant mother and her
unborn child at unnecessary risk of complications during pregnancy; and
WHEREAS, Welfare and Institutions Code section 14007.5 allows emergency care, medically necessary
pregnancy-related services and long term care under certain circumstances be provided to aliens; and,
WHEREAS, Section 411(d) of the Personal Responsibility and Work Opportunity Reconciliation Act of
1996 (H.R. 3734) allows a state to continue providing public benefits to undocumented residents through
enactment of state law and the State of California has the ability to continue providing health care services,
including prenatal care, to undocumented residents under the provisions of Section 411 (d) of the Act;
NOW, THEREFORE BE IT RESOLVED that the Board of Supervisors of Contra Costa County
does direct the Health Services Department to continue providing these necessary medical services to
undocumented residents.
