Duncan, Oil Chemical and Atomic Workers, Antioch; All persons desiring to speak having been heard, the Board further discussed the issues and took the following action: IT IS BY THE BOARD ORDERED that the proposed ordinance entitled "Land Use Permits for Development Projects Involving Hazardous Waste or Hazardous Material" to amend County Ordinance Code Chapter 84-63 and Section 73-4.010 and the proposed ordinance entitled "Community Safety Assurance Ordinance" are REFERRED to the Contra Costa County Planning Commission and the Hazardous Materials Commission for recommendations and report to the Board of Supervisors on October 22, 1996; IT IS FURTHER ORDERED that the Community Development Director and County Counsel are DIRECTED to report to the Board of Supervisors on the proposed ordinance entitled "Community Safety Assurance Ordinance" and its possible implementation on October 15, 1996; IT IS FURTHER ORDERED that the County Administrator is DIRECTED to convene an Ad Hoc Committee of the Board consisting of two representatives to be appointed by Ron Banducci, President and CEO, Shell Martinez Refining Company; two representatives to be appointed by Denny Larson, Communities for a Better Environment (CBE); one representative to be appointed by the Oil, Chemical and Atomic Workers (OCAW) union; one representative to be appointed by the Building and Construction Trades Council; and County staff to review the aforementioned proposed ordinances and report to the Board of Supervisors on October 15, 1996; IT IS FURTHER ORDERED that the County Administrator is AUTHORIZED to engage a facilitator, at his discretion, to help the Ad Hoc Committee reach consensus on the issues and to clearly define any areas where consensus is not reached; IT IS FURTHER ORDERED that County Counsel is DIRECTED to schedule discussion of possible litigation on these matters for an upcoming Closed Session meeting. A special meeting of the Planning Commission has been scheduled for October 15, 1996 for this purpose and at least a quorum of the members have confirmed their availability. In a related action, staff is recommending that the Board suspend its late meeting schedule (1:00 p.m. start) for the third Tuesday in October in order to accommodate the special meeting. The Board of Supervisors specifically directed that the ordinance include the following provisions: 1. Exemption from the land use permit requirement for Major Maintenance Projects where the facility could demonstrate an exemplary safety record (no incidents over a specified time period); 2. Modify section 84-63.1016(1) to reflect the degree of hazard present in the actual mixture; 3. Provide an exemption for emergency situations; 4. Modify section 84-63.424 to stipulate that major maintenance is a scheduled event and significant enough that the process unit, tank or equipment is taken out of service; 5. Clarify section 84-63.604 (Exemptions) to indicate that a facility under order of a regulatory agency to comply in a time period which precludes timely review under the ordinance is required to provide the County with notice of such order within 15 days of receipt by the facility, in order to claim exemption under this section; 6. Clarify the definition of incident to include only significant events. In addition, staff was requested to analyze and address the points raised in the September 23, 1996 memorandum from the Health Services Department Hazardous Materials Division to Supervisor Smith. Attachment A represents the current ordinance version (96-20) with the first set of highlighted ("redlined") wording containing the modifications proposed in the submittal of Supervisor Smith. The second set of highlighted text following the bold OR is alternative language in response to the direction of the motion. In some instances, additional alternative language is provided. The Board packet also includes a version submitted on September 27, 1996 by Mr. Tom Adams of the Law firm Adams & Broadwell. Some of the language in Mr. Adams' submittal is included in Attachment A. In addition, staff had extensive discussions with Supervisor Rogers, who expressed concerns with both certain provisions of the draft as directed in the motion of September 24th, and with certain other provisions of the ordinance as written. p16\boWzMt9-30.ord Proposed Amendments to Chapter 84-63 (LUPs for Development Projects D. Involving Hazardous Wastes or Hazardous Material) of the CCC Code Page 3 The alternatives in Attachment A are presented below, along with staff recommendations as indicated; following that discussion, we tum to the points raised by Supervisor Rogers for consideration by the Board. 84-63.410(b)(1) Supervisor Smith has clarified this exception to the definition of Development Project that"process units" are not related equipment. Health Services Department Hazardous Materials Division Staff (hereafter "HSD") has suggested a more detailed listing of what is and is not included, as well as a provision giving the Zoning Administrator discretion to find a particular piece of minor equipment exempt from the ordinance, as indicated in their September 23, 1996 memorandum cited above. 84-63.410(b)(2) Excepts major maintenance projects from the exemption, per Supervisor Smith proposal. 84-63.410(b)(3) Exception for transportable treatment units. HSD/CDD recommend the second version, as consistent with state requirements. This allows one year placement and one (1) one year extension. 84-63.410(b)(4) Clarifies per Supervisor Smith proposal that exemption for project which is in process before another agency must have been deemed complete by that agency within one calendar year, and CEQA documentation completed. Supervisor Rogers has expressed concern that it is not clear from what date the one year is measured. This section could be clarified to read "... within one calendar year of notification to the County of Contra Costa of exempt status, and which has completed CEQA documentation". 84-63.421 "Incident". The highlighted and striked-over version is as submitted by Supervisor Smith. Supervisor Rogers' motion as indicated in #6 above requested staff to redefine the term to include only significant events. HSD has suggested two alternative definitions with specific criteria to measure when an event would be considered an incident. The difference between the two is that the first includes immediate response by HSD and the Bay Area Air Quality Management District, including an on-site response and situations in which there is a release of hazardous waste or material that caused an off-site impact resulting in sheltering in place notification. The second alternative substitutes immediate action by CCCHSD which caused the activation of their Emergency Operations Center, and secondly, in place of the shelter in place notification criteria, that the release of hazardous waste or hazardous material caused the facility to activate their Emergency Operations Center. The HSD recommends the first option. Supervisor Rogers has expressed the concern that this focus on the single, large event excludes consideration of a series of smaller events, which by themselves would not trigger the ordinance requirements, but in the aggregate, or cumulative sense would be significant as he used the term in his motion. The Board could either agree on specific criteria to be added before introduction of the ordinance, refer the issue to the Planning Commission for recommendation, or determine that such cumulative events should not be included in the definition of "Incident". 84-63.421.5 "Major Maintenance Project" The first highlighted version is per Supervisor Smith's proposal. The second reflects the request of the motion of September 24, 1996 that the maintenance be scheduled and the unit taken out of service. Staff suggests two weeks as a threshold for time for major versus minor maintenance and clarifies that the $1 million figure does not include overhead, planning, engineering or other pre-construction costs in response to an inquiry from Supervisor Rogers. p16\bo\HzMt9-30.ord Proposed Amendments to Chapter 84-63 (LUPs for Development Projects 1✓ ' Involving Hazardous Wastes or Hazardous Material) of the CCC Code Page 4 84-63.423 "Process Unit"At the request of Supervisor Rogers, HSD has suggested a definition of the term "process unit", which was added in the modifications proposed by Supervisor Smith and was the subject of the motion of September 24, 1996. 84-63-424(d) requires submittal of five years' baseline data and justification for choice of representative baseline year of data used in the calculation of the hazard score, per the HSD memo of September 23, 1996. 84-63.430 "Public Safety Agreement" Per Supervisor Smith's proposal. Supervisor Rogers has questioned whether this agreement would only be related to the unit under consideration, or to any or all of the processing units or other facilities at the site. Staff has reviewed the language proposed and determined that as worded, the intent is that the Public Safety Agreement address all of the units in the facility in a comprehensive fashion. Staff has proposed additional language to indicate the basic content of a Public Safety Agreement. Supervisor Rogers has expressed a related concern that the provisions of section 84-63.604(d) limit the exception period to three years, which may not be sufficient incentive for agreement of facility or operational safety improvements. This point is addressed further below in that section. HSD suggests that this item be referred to the Health Services Department for determination of the appropriate content of the agreement, and the development of procedures. Staff of CDD suggests that a specific funding mechanism for staff work related to such agreements be identified. 84-63.604(a) "Exemptions" Supervisor Rogers' motion indicated that the County should be notified by the company receiving an enforcement order within 15 days of the receipt of the notice by the company. Staff suggests that in addition, a description of the project be required to document that the work proposed is limited to the order, and allow 30 days time for such a description and notice copy to be prepared and forwarded to the County. 84-63.604(b) (3) Supervisor Smith's proposal included an exemption for a destroyed building, structure or facility if the rebuilt project has a hazard score fifty percent lower than the destroyed or damaged project. HSD in its September 23, 1996 memo encouraged that the percentage be reduced to five percent lower than the destroyed or damaged project. See HSD 9/23/96 memo page 3, paragraph 3 for discussion. 84-63-604(b)(6) HSD recommends the exemption of rebuilt projects at least 300 feet from the nearest residential property or sensitive receptor, rather than the 1,000 feet incorporated in Supervisor Smith's proposal. This was suggested by CDD prior to the other changes being proposed in the ordinance. 84-63.604(d) This section exempts a major maintenance project from the requirement for a land use permit if the project is covered by a public safety agreement entered into between the County and facility within three years prior to the time the major maintenance project is performed. HSD suggests the applicability be measured between the time the agreement is reached and the application is submitted. Alternately, HSD recommends that no such three year time limit be imposed. (Second highlighted text, following OR) Supervisor Rogers has also expressed concern that the three year period may be insufficient, especially for larger facilities which have a longer running time between maintenance periods. In certain cases, a 5 or 7 year period might be more appropriate, depending upon the unit under discussion and the particulars of the proposed public safety agreement. p16\bo\HzMt9-30.ord Proposed Amendments to Chapter 84-63 (LUPs for Development Projects V• l Involving Hazardous Wastes or Hazardous Material) of the CCC Code Page 5 84-63.604(e) This addition responds to Supervisor Rogers' motion to include an exemption for an outstanding safety record and is tied to the definition of "incident" discussed above. 84-63.604(f) This addition responds to the portion of the motion requesting consideration of an exemption in the event of an emergency. HSD staff have drafted two alternative provisions. CDD and HSD staff suggest that the second alternative is preferable in that it more clearly stipulates the conditions under which emergency work may be done. Article 84-63.8 and 84-63.10 Hazard Scoring Generally. HSD strongly recommends retaining the original scoring scheme adopted in ordinance 96-20. CDD had recommended reducing the scoring in order to reflect a desire of the Board that more projects be subject to the land use permit requirements, without the Shutdown and Turnaround LUP requirement proposed as part of the "Good Neighbor Ordinance" proposal. Since the current discussion incorporates the "safe harbor' provision of the Public Safety Agreement exemption, and land use permit requirement for major maintenance projects, the Board may wish to rely on the threshold levels established by the Hazardous Materials Commission and Ordinance 96-20, and review the operating experience in one year as suggested by HSD.. 84-63.802 Application requirements modified to be consistent with 84-36.424(d). 84-63.1002 This section is modified to reflect the inclusion of major maintenance projects in the first highlighted text. In addition, the hazard scoring -formula is modified to add the letter R representing the incident record of the facility and the heading "Project Hazard Score" was added for clarification of the purpose of the paragraph. At the end of the distance table, 1600 feet was reduced to 15,840 feet to be reflective of the three mile distance referenced in section 84-63.1010. The record of incidents scoring proposed by Supervisor Smith has been reviewed by HSD and an alternative scoring scheme is provided. 84-631002(c) is renumbered (d) and a clarifying provision that credit for reduction is in the same facility as the development proposal is reflective of Supervisor Smith's proposal. 84-63.1012 HSD staff in their 9/23/96 memo indicate that specifying that the highest specific gravity material be used could lower a score if the material is lower volume. They recommend deletion of this paragraph. 84-63.1014 HSD Staff indicate that using a weighted average of scores for multiple categories could lower the overall project score. They recommend deleting that wording as indicated by the strikeover. In addition, HSD indicates that it is the hazard category rather than the development project for which the percent change is being calculated. 84-63.1016. The highlighted text following the OR includes that proposed by Supervisor Smith and modified by HSD to indicate that the chemical component exceeds ten percent by weight of the mixture. 84-63.1018. This section requires that, in pertinent part, "...within five working days of issuing a determination of non-coverage, the Community Development Director shall main notice on the date of the determination..." (Emphasis added) Staff believes that the "on" should read "of'. 84-63.428 Supervisor Rogers has expressed a concern that the inclusion of the phrase "...and similarly less-mobile populations" in the definition of sensitive receptor is not clear enough for those affected by the ordinance to understand what persons, or uses would be affected. He suggests adding congregate care facilities and facilities for or inhabited by disabled persons, as example of the types of uses which would fit this category. A memorandum from Dr. William Walker, Director, Health Services Department is attached as Attachment B. The highlighted revised Draft he references in that memorandum is Attachment A to this Board Order. General ORD. 96- 3`6 Proposed Revisions September 30, 1996 -1 - a r • S. 84-63.202 Purpnse. The purpose of this chapter is to promote the health, safety and general welfare of residents and persons in the County by encouraging businesses and other entities, in planning and developing projects involving hazardous material or hazardous waste, to consider factors which involve potential health and safety risks to the surrounding community, and by requiring land use permits for development projects which could significantly and adversely affect public health, safety and the environment. (Ords. 96-20 § 3, 90-92, 86-100.) 84-63.204 Cnnflirt. This chapter is not intended, and should not be deemed, to prevent or preempt compliance with federal or state laws, regulations, rules or orders, or to excuse compliance with any other County ordinance, including other _ requirements of this code. (Ords. 96-20 § 3, 86-100.) Article 84-63.4 Definitinns 8¢63.402 General. As used in this chapter, the words and phrases defined in this article shall have the meanings given unless the context otherwise requires. (Ord. 96-20 § 3.) 8463.404 "&3selin _ P _rind." "Baseline period" means the consecutive twelve month period of time during which activity is measured for purposes of this chapter. The baseline period shall be any twelve consecutive month period within five years of the date of the submittal of the application that is reflective of a normal year of operation. (Ord. 96-20 § 3.) 84-63.406 "Change-in-risk prniprt." A "change-in-risk project" means a new use of an existing building, structure, or facility, not involving construction other than minor alterations, which use will involve a hazardous material or hazardous waste in a higher hazard category and which use will result in a hazard score higher than the hazard score of the previous use. "Commercial property" means all properties with a commercial designation in the general plan including but not limited to the following: regional commercial, airport commercial, office, and business park. (a) A "development project" means a new permanent building, structure or facility to be constructed that will manage hazardous materials or hazardous waste, or a permanent change-in-risk project. ORD. 96-LPO Proposed Revisions September 30, 1996 -2- � I ♦ s As used in this section, "permanent" when used to describe a building, structure, or facility, or the new use of an existing building, structure, or facility (change-in-risk project) means that the building, structure, facility or use is intended to be in operation for more than six months. "Dispose" means to discharge, deposit, inject, dump, or place any hazardous waste into or on any land or water so that such hazardous waste or any constituent thereof may enter the environment or be emitted into the air or discharged into any waters, including ground waters. (Ords. 96-20 § 3, 86-100.) 84-63.414 "F_quipment." "Equipment" means pipes, pumps, vessels and other similar types of apparatus. (Ord. 96-20 § 3.) 84-63.416 _ility." "Facility" means a group of buildings, structures, or units with the same purpose on contiguous parcels (including parcels separated by a right-of-way, as defined in section 1002-2.002 of this Code) under common ownership or control. "Hazardous material" means any material that, because of its quantity, concentration, or physical or chemical characteristics, poses a significant present or potential hazard to human health and safety or to the environment if released into the workplace or the environment, and includes any material that is listed in the Code of Federal Regulations, Title 49, Section 172.101' (Hazardous Materials Table), as amended from time to time. On the effective date of this chapter, any proposed development project which is subject to the provisions of this chapter, and which has obtained all required federal and state permits and other governmental authorizations to manage hazardous waste or hazardous material including, but not limited to, permits or authorizations under the Federal Resource Conservation and Recovery Act (42 U.S.C. Section 6901 et seq.), Health and Safety Code Chapter 6.5 (§ 25100 et seq.), Hazardous Waste Control, Health and Safety Code Chapter 6.7 (§ 25280 et seq.), Underground Storage of Hazardous Substances, Health and Safety Code Chapter 3.5 (§39650 et seq.), Toxic Air Contaminants, and Food and Agriculture Code Section 14021 et seq., and which has complied with the requirements of the Hazardous Substances Information and Training Act (Labor Code Section 6360 et seq.) shall be exempt from the requirements of this chapter. Any person proposing a development project which may be used to manage hazardous waste or hazardous material shall apply to the Community Development Director for review and a determination whether a land use permit may be required under Article 84-63.10 or whether the project is exempt under section 84-63.604(a) or (b) or 84-63.606. Projects exempt under section 84-63.604(c) are not required to submit an application ORD. 96- 0 Proposed Revisions September 30, 1996 - 1 - pursuant to this section. If the hazard score of a project is 69 OR ? or less and the project does not increase the amount of hazardous waste or hazardous material managed as compared to the baseline of the last three years, a determination of non- coverage and an application therefor are not required. No later than ten calendar days after receipt of an application, or the submittal of additional information, the Community Development Director shall inform the applicant in writing that the application is complete or shall inform the applicant what additional information is required. Within twenty calendar days of the application being deemed complete, the Community Development Director shall issue a written determination of non-coverage pursuant to section 84-63.806, an exemption pursuant to section 84-63.604(a) or (b) or 84-63.606, or a determination that a land use permit is required pursuant to section 84-63.1002. (Ords. 96-20 § 3, 90-92.) 84-63.806 Determination of non-coverane. Upon determining that a proposed project has a hazard score up to and including 79 OR ;QS' or that the project is exempt pursuant to section 84-63.604 or 84-63.606, the Community Development Director shall issue a determination of non-coverage or exemption. A determination of non- coverage for projects with a hazard score between 70 OR and 79 OR , inclusive, means that the project is not subject to the requirements of article 84- 63.10, but is subject to sections 84-63.808 and 84-63.810. Projects with a hazard score below 69 OR # and projects which are exempt pursuant to sections 84- 63.604 and 84-63.606 are not subject to the requirements of sections 84-63.808 and 84-63.810. The transportation risk point assignment shall be calculated based upon planned total quantities of materials in a hazard category, measured in terms of tons per year for each hazard category proposed. The transportation risk point assignment shall be calculated for each mode of transportation proportionally within a single hazard category. That transportation point assignment shall be compared by hazard category with the total amount of material in the hazard category transported during the baseline period in order to obtain the percent change in section 84-63.1004(b), Transportation Risk. For purposes of determining whether truck transportation is through residential/commercial or industrial areas, the shortest legal route from the closest two-lane (or larger) freeway shall be considered. If the route used in the County does not traverse a two-lane (or larger) freeway, the entire route shall be considered. "Distance to Receptor" shall be the shortest distance between an exterior wall or other part of the development project and the property line of the residential property, commercial property or the sensitive receptor used to determine the hazard score of a development project. The size of a development project shall be measured in terms of tons of hazardous material and/or hazardous waste stored as a result of the development project, based upon the fill-to-the- maximum capacity of the development project, including amounts stored in tanks; reactors; columns; process lines; tank cars, tank trucks or rail cars when connected to process equipment; or any other receptacle used for the containment of hazardous materials and/or hazardous wastes. If more than one category of hazardous material is used, the amounts of materials (A, B, or C) shall be used with the respective hazard category in the formula in section 84-63.1004. Article 84-63.14 Offsite Hazardnlls Waste Facility Compliannp_ With r-ntinty Hazards is Waste Management Plan 84-63.1402 AI'thnrity. This article is enacted pursuant to Health and Safety Code sections 25135.4 and 25135.7, concerning the siting of offsite hazardous waste facilities. (Ords. 96-20 § 3, 90-73.) 84-63.1404 Dpfinitinns. (a) General. Unless otherwise specified in this section or indicated by the context, the terms used in this article have the meanings ascribed to them in Health and Safety Code Chapter 6.5 (§ 25100 et seq.). (b) "County Hazardous Waste Management Plan" means the county hazardous waste management plan adopted by the Board of Supervisors on August 29, 1989 and amended by the Board of Supervisors on January 30, 1990, approved by a majority of the cities within the county which contain a majority of the population of the incorporated area, and approved by the State Department of Health Services on February 28, 1990, as said plan is amended from time to time. (c) "Hazardous waste facility" means all contiguous land and structures, other appurtenances, and improvements on the land used for the treatment, transfer, storage, resource recovery, disposal, or recycling of hazardous waste. A hazardous ORD. 96- 19 Proposed Revisions September 30, 1996 -25- waste facility may consist of one or more treatment, transfer, storage, resource recovery, disposal, or recycling hazardous waste management units, or combinations of these units. (d) "Offsite hazardous waste facility" means a hazardous waste facility at which either or both of the following occur: (1 ) Hazardous waste that is produced offsite is treated, transferred, stored, disposed or recycled. (2) Hazardous waste that is produced onsite is treated, transferred, stored, disposed or recycled and the hazardous waste facility is not owned by, leased to or under the control of the producer of the hazardous waste. (Ords. 96-20 § 3, 90-73.) 84-63-1406 Cntinty Hazardous Waste Management. All land use permit, variance or other land use entitlement granted for the operation or expansion of an offsite hazardous waste facility shall be consistent with the portions of the County Hazardous Waste Management Plan which identify siting criteria, siting principles or other policies applicable to hazardous waste facilities. Before granting the application, the division of the planning agency hearing the matter initially or on appeal shall find that the application complies with the applicable siting criteria, siting principles and other policies identified in the County Hazardous Waste Management Plan, and that the proposed offsite hazardous waste facility is consistent with the County Hazardous Waste Management Plan. If any provision or clause of this ordinance or application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable and are intended to have independent validity. SECTION VII. PREEMPTION_ Nothing in this ordinance is intended, and should not be deemed, to excuse or prevent compliance with any State or federal law. If any provision of this ordinance is found by a court of competent jurisdiction to be preempted by any applicable State or federal law, the Board of Supervisors declares that its intent is for such provision to be severable from the remainder of the ordinance, and the remainder of the ordinance is to be given effect in accordance with the provisions of Section III of this ordinance. The item in question is "the land use permits for development projects involving hazardous waste or hazardous material"and commonly referred to as the Good Neighbor Ordinance. I realize that the text of this ordinance might not contain everything in the manner that would please all parties. However, I have read it over thoroughly, and it is a good start. As you may recall, our office has carried legislation attempting to modify the Risk Management Prevention Process -- a policy set in place several years ago to create a system of ample warning to the various communities in which companies producing or working with hazardous waste or hazardous materials are located. When we reviewed the process of the proposed RMPP, we had noted that many of the accidents were caused by faulty workmanship or work done by less than skilled crafts persons. One of the sure ways to correct this weakness is when a company is in the process of either expanding or making improvements, the local entity has the opportunity to review the plans to the changes and the effects they will have on the community and the environment. Too often when project analyses are being put together by one corporation without reference to what is taking place in the larger community, the potential negative results are underestimated and the combined workload gets rushed to a conclusion without adequate inspection of the finished product. I would urge your consideration of this ordinance, and, more important,the involvement of the business, labor and neighborhood communities in the process. A review of the history of this process shows that the County has been scrupulously careful, thorough, and open. moreover, the County has generally adhered to a process directed by a majority of the Board on June 25, 1996. This ordinance was developed originally over at least three years by the Hazardous Materials Commission. it was considered at two full hearings by the County Planning Commission. The Planning Commission considered objections to the proposed ordinance offered by the Building Trades council. On June 25, 1996, . at the first reading of Ordinance 96-20, the Board resolution included additional language presented by Supervisor Torlakson which expressly acknowledged that "the Hazardous Materials Commission Ordinance does not fully address the current Board of Supervisors concerns regarding safety. . . " Additionally, the Board resolution contains a long list of additional issues which were referred to the Ad Hoe Committee on Industrial Safety for "hearing and report within 60 days. " A1065.123 OCT 01 '96 09:55Ah ADAMS & BROADWELL 415-589-5062 P.3/4 The Honorable Jeff Smith October 1, 1996 Page 2 This resolution was adopted by a 4-1 vote and represents a clear expression of dissatisfaction with the existing ordinance and a direction that the issues identified should be carefully considered by its Committee and promptly brought back to the full Board for further action. No member of the Board argued that Ordinance 96-20 was adequate or that a longer review period was appropriate. The issues were considered by the Board's Committee at four separate meetings during July, August and September. One of these meetings, July 29, 1996, was a joint meeting of the Board committee, the Planning Commission, and the Hazardous Materials Commission. The meetings of the Board Committee were detailed and extremely substantive. Instead of broad conceptual discussions, specific ordinance amendments were presented. These amendments were analyzed and commented on in writing and orally by the county Staff, including the community Development Department, the Health Services Department, the Building inspector, and the County Counsel. In addition, written reports on the accident history in the County were presented to the Board Committee. one report, Neighborhoods At Risk, analyzed all the accidents and incidents since 1989 and was jointly authored by the Contra Costa Building Trades Council, Communities for a Better Environment, and the Shoreline Environmental Alliance. Two reports were prepared by the Health Services Department. These reports contained both a further analysis of the accident history in the County and of the various state and federal programs which also regulate heavy industry. Unfortunately, no report on the accident history was presented by any industry group, but there was certainly ample opportunity for them to do SO. The Board Committee reported its conclusions and recommendations back to the full Board on September 26, 1996, thirty days later than originally requested by the full Board. While it is always possible to add meetings and hearings to any process, the process that has been followed is the one adopted by four members of the Board on June 25, 1996. I believe the Board majority voted for this process because it was genuinely concerned about the continuing rate of accidents in the County and felt that the remaining issues identified in the Board A1065.123 OCT 01 196 09:56AM ADAMS & BROADWELL 415-559-5062 P.4/4 The Honorable Jeff Smith October 1, 1996 Page 3 resolution should be addressed promptly. This concern was fully justified in light of the fact that six new accidents occurred since the Board acted in June. The issues which are presented in the proposed amendments to Ordinance 96-20 all relate to topics which were generally identified in the Board resolution of June 25, 1996. There are no surprises in these amendments. The process that has been followed has been careful and thorough with ample opportunity for all interested parties to participate. County Staff has made substantial written reports . The Planning commission and the Hazardous Materials Commission have had a preliminary opportunity to participate. The Board itself heard lengthy and detailed testimony, including testimony from attorneys and experts, at its own hearing on September 26, 1996. As I understand the Board's intention, this process is by no means complete at this point. There will be additional hearings before the Planning Commission and the Hazardous Materials Commission before final Board action. It appears that the proposal could jeopardize the ability of refiners to continuously supply adequate amounts of motor fuels to the public, Since our agency received a copy of the proposal only on September 26, 1996, we have not had time to thoroughly examine it. However, it appears that the proposed ordinance could require refiners to apply for a determination of the need for land use permits, with possible CEQA ramifications, for certain maintenance procedures that sometimes become necessary without warning (and that can cost more than the $1 million exemption limit) and for the repair of major damage from accidents. If so, these refinery activities could be delayed while the County's requirements are met. We are concerned that such delays could harm the supply of gasoline and diesel fuel to northern California. It is well recognized that major technical problems in refineries can restrict the supply of fuels and cause retail prices to rise, For example, we have determined that the fire at the Shell refinery in Martinez in March, with the loss of Shell's production for one month, was an important cause of the coincident major price increases. The public interest would not be served by requirements that would tend to dely the restoration of production in cases like that. In addition to hampering emergency repairs, the proposal could prompt refiners to schedule routine maintenance less frequently. (Because of the magnitude of refining operations, many traditional maintenance activities could be subject to the proposed requirements.) Less frequent preventive maintenance could result in less reliability and, therefore, more frequent major failures. Besides compromising the supply of motor fuels, major failures probably pose a greater public risk than does routine maintenance. However, it appears that the proposed ordinance could require refiners to apply for a determination of the need for land use permits,with possible CEQA ramifications,for certain maintenance procedures that sometimes become necessary without warning(and that can cost more than the$1 million exemption limit) and for the repair of major damage from Accidents, If so, these refuiery activities could be delayed while the County's Acquirements are met. ; We are concerned that such delays could harm the supply of gasoline and diesel fuel to northern California. It is well recognized that major technical problems in :Ir fineries can restrict the supply of fuels and cause retail prices to rise. For example, eve have determined that the fire at the Shell refinery in Martinez in March,with the less of Shell's production for one month,was an important cause of the coincident major price increases. The public interest would not be served by requirements that would tend to dely the restoration of production in cases like that. I In addition to hampering emergency repairs,the proposal could prompt refiners do schedule routine maintenance less frequently. (Because of the magnitude of r,�ning operations, many traditional maintenance activities could be subject to the proposed requirements.) Less frequent preventive maintenance could result in less reliability and, therefore, more frequent major failures.
