Acknowledge receipt of Monthly Report No. 8, dated November 1995, prepared by Davillier-Sloan, Inc. , on Contract Compliance Services. BACKGROUND The contract for construction management with O'Brien-Krietzberg & Associates for the Merrithew Memorial Hospital Replacement Project requires a monthly status report to be filed with the Project Director in the Office of the County Administrator. In addition, the monthly report, prepared by the consultant, Davillier-Sloan, Inc. , on the contractors ' compliance with the MBE/WBE and affirmative action contract requirements, is attached. A copy of the monthly report is provided to the Clerk of the Board and the Board of Supervisors for information purposes . Coordination with County, Construction Manager (O'Brien-Kreitzberg, Inc., "OKA") and other appropriate agencies/persons 7. Change order review S. Monitoring and reports Technical Data Corporation (TDC) began work on the project December 13, 1995. Our first initiative was to participate in several meetings prior to the existing consultant leaving the job. The attendance at these meetings was to give TDC staff some idea as to the ongoing continuity and substance of the current process. We were not able to conclude from these meetings a solid sense of what was going on. However, having proposed on the project earlier we did understand the project requirements. TDCs first order of business was to review everything currently in place. At the conclusion of this review our task was obvious. The development of operating procedures,monitoring kits for the various functions, work plans, Lines of Communication within the proper protocol and procedures to accomplish the job requirements are spelled out in the Scope of Services in the (* November and December 1995 statistical information was not available at this time. It will be furnished at a later date.) t TDC Contract Agreement and Section E of the Merrithew Hospital project specifications. These items of work have been tentatively accomplished and the tentative work product has been submitted to the County Compliance Officer and to the proper persons within the General Contracting (Centex Golden Construction Company "CGCG') organization for review and comment. On site project interviews were scheduled to begin December 26, 1995, but were rescheduled to January 4, 1996, due to the unavailability of the General Contractor's AA/EEO Officer. The on site interviews are now scheduled to begin January 8, 1996. The General Contractor felt that prior to beginning this phase of the work the labor compliance monitoring kit needed to be fully explained to the Project AA/EEO Officer to fully familiarize him with the duties and responsibilities of the General Contractor and all of the sub-contractors. TDC staff is recommending some program changes to improve the coordination, communication and effectiveness of the program, i.e., the prior data TDC has reviewed to date generally captures the program ideals, however there is a lack of specificity and timing. We are currently working with the County Compliance Officer and the General Contractor's AA/EEO Officer to effect these changes. These changes will not be new duties in addition to what is currently being done. It is a plan to make the current effort more effective in meeting the contract goals. TDC staff has reviewed the current change order (CCO) inventory and will be working with the Construction Manager's representative and the designated person from CGCC to provide a useful relative report to the County Compliance Officer highlighting any and all possible opportunities to involve additional MBE/WBEs as sub-contractors, suppliers and vendors on the project. TDC maintains a data base of labor unions, joint apprenticeship councils, community training programs and Department of Apprenticeship Standards Offices in the bay area. TDC staff working in conjunction with the County Compliance Officer, CGCC and OKA to identify and add to the data base any additional resource that may exist in the Greater Bay Area to assist in locating available minority and female workers. This information will be passed on to each sub-contractor scheduled to participate on this project. In addition to the Caltrans certification list, TDC staff will engage in outreach to other acceptable certification agencies and minority contractors associations to identify other MBE/WBE firms. TDC will assist non-certified MBE/WBE firms who are in a trade pertinent to the Merrithew Hospital project in becoming certified. During the month of December, TDC staff attended eight meetings related to AA/EEO requirements, construction coordination, labor compliance, contract compliance, the MBE/WBE project advisory, council and ether meetings as requested by the County Compliance Officer. TDC also attended meetings with the Construction Manager,the General Contractor and Contra Costa County Board of Supervisors, minority and women constructer groups and community training programs in Oakland to collect, exchange and share information relative to the execution of Section E of the Merrit,yew Memorial Hospital Project. TIBC. management and staff was engaged in follow up inquiries on an MBE/WBE substitution procoss that gave the appearance of a possible discrimination complaint, Our findings to date is that the dispute is currently a questionable dispute involving a business relationship.between an MBE/WBE electrical supplier and the project electrical sub-contractor. Until that business relationship is resolved and action is taken, `SDC has no role to play in the matter. upon resolution of the contractor/supplier business disputa,L the supplier is in fact substituted, TDC is already alerted and will assist the electrical sub-Contractor in locating_ another maE/WSE electrical supplier tofumish the product. As started earlier in this report, TDC stat" has been on site already to begin conducting field reviews,monitoring labor compliance(weekly payrolls),comparing the data with the inspector's Daily Reports and compiling data that truly reflect the hours worked by the various minority and female workers on the project, and comparing the findings with the MBE/Wl3E manpower goals reflected in the bid documents. This information will determine the percentage of workforce goals currently being met. if the stated goals are not met, TIBC, in conjunction with the General Contractor (CGCG, the Courtly Compliance Officer, and the Construction Manager (OKA), will immediately invoice the non-compliance sanctions process spelled out In the specifications. As spelled out In the TDC Supe of Work, we will prepare the detailed rnonthlY report and other speclea: reports as rewired or requested by the County Compliance Officer. OKA, the CM,_ has supplied to TDC a copy of the .Projoct Schedule and a listing of all sub-contractors cufr'entiy listed to work on the projwy. We are Currently reviewing this information and will utilize it to complete a detailed work plan for the t BF-/wBE requirements for the project. TDC also provided OKA, the.CM, a synopsis of our Scope of Services for their review. Major activities this month continued to involve the building foundation with over 1, 000 yards of concrete placed. A few final concrete pours were made on structural walls and footings, but most of the concrete placed this month was for slab-on grade pours . Anchor bolts were installed in the slabs preparing for structural steel column erection, scheduled for next month. Under slab plumbing and electrical rough-in continued in many areas and was completed, section by section, just prior to the slab on grade pours . Structural steel fabrication and welding continued at the steel mill . Progress was slowed by the fact that many welds failed to pass inspection. The problems encountered have the potential to delay the arrival of the steel, currently scheduled for December 4th. A meeting is scheduled between the Contractor, Construction Manager, and Architect to isolate the problem. The equipment planning consultant, Facilities Development Inc . , (FDI) , conducted group sessions for final quantity and accessory selection this month. A revised budget will be developed after the final quantity and accessory selections are made. The telecommunication consultant, COMSUL, Ltd. , has embarked on its programming effort. Several programming meetings were held this month with the project team, Hospital, and County staff . Budget The total project budget is $81, 841, 000 . The attached project cost report shows the same forecast amounts. Current expenditures have been updated. Schedule: Centex Golden submitted its third schedule update on November 28th showing an on-time completion date. The critical path continues to run through structural steel fabrication. Workforce Status as of October 28, 1995 Summary The cumulative analysis shows that Iron Workers, Laborers, Masons and Waterproofers continue to exceed the minority employment goal. Iron Workers also exceeded the female employment goal with 7.1% female participation. It should be noted and emphasized that no other trades have hired women. Carpenters, Electricians, Operating Engineers and Teamsters are currently under the minority hiring goal of 25.7%. Immediate emphasis should be placed on hiring minorities and women among subcontractors employing these trades. Among,the 14 subcontractors currently on site, Alamillo Steel, F.W. Spencer, Joe Carone, R & R Maher, Schnabel and The Ellis Roofing Company are exceeding the minority employment goal. Only Alamillo Steel has hired women. CGCC has spoken to each subcontractor and reminded them to utilize the unions' namecall and rehire procedures. CGCC has been directed to request specific affirmative action steps taken by subcontractors in apparent noncompliance in their efforts to increase minority and female participation. A special meeting was convened among members of the Contra Costa County Affirmative Action Advisory Council, CGCC, and contractors R&R Maher, Herrick and Meiswinkle to discuss the need to improve the participation among women, African Americans, Asians and Native Americans. Although not required under Division E, DSI has taken the initiative to monitor the ethnicities and residencies of the workforce.
