Affinito, Pitttsburg, on County Ordinance No. 95-36, Mobile Vendor Regulations On this date the Board of Supervisors considered the comments of Mr. Alfred A. Affinito, 2980 Railroad Avenue, Suite D, Pittsburg, relative to Ordinance No. 95-36, Mobile Vendor Regulations . Supervisor Tom Torlakson March 20, 1995 5th District 300 East Leland, Suite 100 Pittsburg, California 94565 Dear Tom: On behalf of the Bay Point Municipal Advisory Council, I have been asked to respectfully request County Counsel, your office and the rest of the Board of Supervisors to write statute that will regulate the business practices of what are commonly known as "TACO COACHES. " These vehicles unfairly do business, mainly in unincorporated areas of the County, without paying the normal rents or expenses of ownership for restaurant operation. This Council was recently told by a business owner, that these trucks can charge up to one-half what restaurants in buildings must charge. An example of the way these -"Coaches" avoid the normal expenses is by parking in vacant lots, along a road or in a private parking lot to conduct their business. This .Council has no objection to catering trucks traveling from business to business, serving various companies with food during coffee breaks or lunch. That is, after all, how it has historically been done. It was never expected that catering trucks would unfairly compete with restaurants that cannot move about, so I would suggest the Board of Supervisors try to level the playing field. One way would be to legislate regulations making it illegal for these trucks to remain in one place for more than 15 minutes, while serving food or drink. This would allow these trucks ample time to conduct necessary business, yet prevent the. unfair advantage they now enjoy. This would also allow the Sheriff ' s department to cite them for violations, either by it' s own observation or by complaint from citizens. Rules of this type would be totally fair to both the catering trucks and business owners who are now threatened financally by these mobile entrepreneurs. Thank you for your consideration. (SSC) 432-2542 lis: (510) 432-0878 November 30, 1995 Honorable Chairperson and Members Contra Costa County Board of Supervisors Martinez, Ca 94553 Re: Ordinance No 95-36 Ladies/Gentlemen: I respectfully request the opportunity to address the Board or a subcommittee of the Board to discuss some problems which I do not believe were considered when the above captioned ordinance was approved on August 1, 1995 . I am = a Mobile vendor. However, before the adoption of the ordinance I had entered into a written contract to allow a mobile vendor to locate on my real property located at Port Chicago Highway and Willow Pass Road. I am satisfied with the operator. He and his wife maintain cleanliness of the unit and the area. They have all necessary Sanitation Department approvals . They are working hard to earn a living. They are also providing a service in an area where little service is available to those in need of a quick bite of lunch while working. My arrangements, made before the adoption of the ordinance limited the conduct of business to daytime between 10 :00 am and 6 :00 pm. Before entering into their written contract I inquired of the appropriate office in the Sheriffs. Department and was advised there was no application or approval necessary except that of the Sanitation department. I am having some difficulty understanding the limitation to one hour per day per site. This in effect requires the units to continually travel thereby having some effect on traffic. Allowing limited daytime use adjacent to public streets with appropriate safeguards for cleanliness, sanitation and safety would better eliminate the traffic problems. Allowing only one hour per site also affects the ability of this hard working family to earn a living. It could certainly be agreed that it may in fact put some people in unemployment. I do not know if my contract is "grandfathered" since it pre-dated the ordinance. I am not concerned with any financial effect that results by reason of a termination of my contract. I am truly concerned with an unnecessary interference with the desire of this hard working couple who evidence the ambition to earn their way with their small business enterprise.
