CORCORAN, Auditor-ControllerJ COUNTY DATE: January 23, 1996 SUBJECT: DISTRIBUTION OF STATE HIGHWAY PROPERTY RENTAL REVENUE RESOLUTION NO.96/25 SPECIFIC REQUEST(S)OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION RECOMMENDATION: Distribute the 1994-95 State Highway property rental revenue in the amount of $41,831.08 to the County Road Fund, County Tax Collector, and to eligible cities pursuant to the provisions of Section 104.10 of the Streets and Highways Code and as recommended by the County Auditor-Controller, as follows: County Tax Collector (Possessory Interest Tax Bills) $ 1,355.05 County Road Fund 20,336.03 City of San Pablo 1,246.29 Town of Moraga 6,735.50 City of Walnut Creek 11,708.95 City of Richmond 449.26 TOTAL $41,831.08 BACKGROUND: Section 104.6 of the Streets and Highways Code authorizes the State Department of Transportation to lease any lands it holds which are not presently needed for State highway purposes and provides that 24 percent of such rental revenue shall be allocated pursuant to Section 104.10. Section 104.13 provides that all funds distributed to the County shall be deemed to be in full or partial payment of the possessory interest taxes due on such leased properties. The recommended distribution is in accordance with these State laws.
