SUBJECT: Robert Pacini (Applicant & Owner) Requests an Extension of Time for an
Approved Tentative Map (County File 7118) in the Morgan Territory Area

RECOMMENDATIONS
Approve the request for a three-year extension of time for filing
the tentative map to expire on February 11, 2001 .
FISCAL IMPACT
None.
BACKGROUND/REASONS FOR RECOMMENDATIONS
SUB 7118 was approved by the Board of Supervisors on August 12 ,
1992 . Subsequently, a lawsuit was filed challenging the Board' s
action. Due to the legal challenge, the time limits for tentative
map were suspended from August 12 , 1992 to February 13 , 1993 , with
a new expiration date for filing the tentative map of February 13 ,
1996. Furthermore, an automatic two year extension was granted by
the Legislature for projects approved prior to September 13 , 1993 ,
extending the life of the map until February 13 , 1998 .
County Code 94-2 . 610 permits extensions of approved tentative maps
for a period or period not totaling more than three years after the
original expiration date upon application by the subdivider. On
December 7 , 1995 the applicant requested an extension of time to
file the tentative map to satisfy the conditions of approval for
the project. See Attachment A.

Application for Extension of Vesting Tentative Map
Mountain Meadows #2 -- TR#7118
Dear Mr. Alexeeff:
You will find enclosed a request by the property owner to extend the life of
TR 47118 for three years, pursuant to Section 94-2.610 of the County Subdivision Ordinance.
The map is currently scheduled to expire on February 13, 1996. This application is based upon
the following grounds:
Delay due to Water District Studies:
For purposes of determining the phasing of the project,the Water District had to
determine how many houses could be served from the existing system without building a new
water tank. For reasons that were never explained, the Contra Costa Water District did not even
begin to ad ess the issue until October of 1993 and did not issue a will-serve letter until April of
1995.
The Water District was scheduled to supply the information in January of 1994,
but the calculations were not completed until April or May of 1994. When these were
completed, they were wrong, and the figures had to be reworked several times. Finally, in April
of 1995, the Water District concluded that 12 houseycould be served from the existing system.
In the meantime of course, nothing could be d ne with the project, which means that nearly three
years of the map's life was lost. /

Economic Conditions for High End Housing:
As noted, the project has only been able to move forward since this Spring.
However, the statewide economic slump has only recently begun to recover. With respect to the
housing market, a much stronger recovery is needed before it would make economic sense to
develop expensive, large lot homes, such as those planned for Mountain Meadows#2.
It is Mr. Pacini's intent to market this project rather than build it. However, the
absorption rate of high end housing has been extremely slow and very unpredictable, and this
project is heavily burdened with conditions and expensive infrastructure costs. Accordingly,
construction of the project can only realistically occur in phases. Therefore,unless the map has
the longest possible life, the project will be unmarketable, as the buyer will need adequate time to
build out all of the phases.
