BACKGROUND/REASONS FOR RECOMMENDATIONS
In 1990, the Community Development Department proposed a number of
changes to the zoning ordinance which would add restrictions to the
size and height of accessory building s and reduce the maximum
building height for structures located within the residential
zoning districts . This amendment was brought before and approved
by the County Planning Commission on January 23 , 1990 . As other
zoning ordinance revisions were pending at that time, this
amendment did not go to the Board of Supervisors. .

In January, 1993 , the issue was renewed and municipal advisory committees and
other interested parties were notified of the , proposed changes . The proposed
revisions were brought before the County Planning Commission on March 8, 1994 .
The item was continued through several hearings to allow staff to meet with
interested parties .
Workshops before the County Planning Commission were held on April 18, 1995 and
June 6, 1995 . On June 27, 1995 the County Planning Commission recommended
adoption of the proposed ordinance revisions regarding the measurement of
building height and the restricted height and size of accessory structures .
Under the proposed ordinance revisions, building height would be measured from
grade to a point directly above . This would result in the design of hillside
structures that stepped back with the slope of the hill . There are no proposed
changes to the maximum building height in any zoning districts . In addition,
Accessory buildings would be limited to either 500 or 600 square feet in size and
15 feet in height dependent on the size of the lot .
Proposed revisions to the zoning ordinance are detailed on Attachment A.
ATTACHMENT A
REVISIONS TO HEIGHT ORDINANCE
Staff finds that the following ordinance code sections should be revised, corrected,
deleted or added as noted:
(1) Section 82-4.212 "Building, accessory". Change wording to indicate accessory
buildings as subordinate in both size and use to the main building on the same
lot, and restrict size to 500 square feet of floor area on lots less than 20,000
square feet and 600 square feet on lots greater than 20,000 square feet, and,
restrict accessory structures to 15 feet in height. Section 82-4.212 to read:
Building Accessory. "Accessory building" is a building the use and size of
which is clearly subordinate and incidental to that of a main building on the
same lot. The accessory structure shall meet the following conditions:
(a) No accessory structure shall exceed 500 square feet on lots less than
20,000 square feet and 600 square feet on lots greater than 20,000
square feet.
(b) No accessory structure shall exceed 15 feet in height.
(2) Section 82-4.214 "Building height". Change wording to indicate that height is
measured vertically from grade to top of structure directly above. Section 82-
4.214 to read: Building height. "Building height" means the vertical distance
measured from grade to the top of structure directly above with exceptions
noted elsewhere in the code. Height may be measured from finished grade
when such grade is below natural grade. Height shall be measured from natural
grade when the finished grade is higher than natural grade.
(3) Article as follows: 84-4.14, 84-6.14, 84-8.14, 84-10.14, 84-12.14, 84-14.16,
84-16.16, 84-18.16, 84-20.16, and 84-22.14; Land Use and Variance Permits.
Add section allowing variances in floor area and height of accessory structures.
New section to read: (Section #) Variance permits to modify the provisions for
accessory buildings in Section 82-4.212 may be granted in accordance with
Chapters 26-2 and 82-6.

RESOLUTION OF THE PLANNING COMMISSION OF THE COUNTY OF CONTRA
COSTA, STATE OF CALIFORNIA, INCORPORATING FINDINGS AND
RECOMMENDATIONS ON THE PROPOSED ORDINANCE CODE AMENDMENT PERTAINING
TO THE MAXIMUM SIZE AND HEIGHT OF ACCESSORY STRUCTURES AND THE
MEASUREMENT OF BUILDING HEIGHT, FOR SAID COUNTY.
WHEREAS, this ordinance code amendment amends Section 82-4.212 of
the County Ordinance Code to revise the definition of accessory
buildings to indicate accessory buildings as subordinate in both
size and use to the main building on the same lot, and restrict
size to 500 square feet of floor area on lots less than 20, 000
square feet and 600 square feet on lots greater than 20, 000 square
feet, and restrict accessory structures to 15 feet in height; and
WHEREAS, this ordinance code amendment amends Sections 84-4. 14,
84-6. 14, 84-8.14, 84-10.14, 84-12.14, 84-14.16, 84-16. 16, 84-18 . 16,
84-20. 16, and 84-22 . 14 of the County Ordinance Code to amend Land
Use and Variance Permits section allowing variance permits to
modify the provisions for accessory buildings in Section 82-4 .212
as regards floor area and height of accessory buildings in
accordance with Chapters 2672 and 82-6; and
WHEREAS, this ordinance code amendment amends Section 82-4 .214 of
the County Ordinance Code to revise the definition of building
height so that the method of measuring building height will be
changed to indicate that height is measured vertically from grade
to top of structure directly above. The height definition change
would result in the design of hillside structures that stepped back
with the slope of the hill but would not alter the maximum building
height in any zoning districts; and
WHEREAS, for the purposes of establishing compliance with the
California Environmental Quality Act, this activity is not a
project subject to CEQA, pursuant to Section 15061(b) . It can be
seen with certainty that adoption of the proposed ordinance could
not have a significant effect on the environment because it has no
potential to change any aspect of the physical environment; and
WHEREAS, after notice thereof having been lawfully given, a public
hearing was scheduled for the County Planning Commission for public
hearing on March 21,1995, whereat all persons interested therein
might appear and be heard; and
WHEREAS, said March 21, 1995 hearing was continued to April 18,
1995 to provide for scheduling of a public workshop before the
County Planning Commission prior to the public hearing on the
proposed ordinance modifications; and,
WHEREAS, after notice thereof having been lawfully given, a public
workshop and a public hearing were scheduled for the County
Planning Commission on April 18, 1995, whereat all persons
interested therein might appear and be heard; and

WHEREAS, said April 18, 1995 workshop and public hearing was
continued to June 6, 1995 to provide for further discussion of
proposed revisions to the ordinance; and
WHEREAS, said June 6, 1995 hearing was closed, the Commission
declaring their intent to recommend approval but requesting
revisions to the proposed ordinance to be discussed at the June 27,
1995 hearing; and
WHEREAS, on Tuesday, June 27, 1995, the Commission recommended
approval of the ordinance code amendment; and
WHEREAS, the County Planning Commission recommends to the Board of
Supervisors of the County of Contra Costa, State of California,
that the County Ordinance Code be revised to indicate accessory
buildings as subordinate in both size and use to the main building
on the same lot and restrict the overall height and size of
accessory structures, and, that the County Ordinance Code be
revised to change the definition of building height so that the
method of measuring building height will be changed to indicate
that height is measured vertically from grade to top of structure
directly above resulting in the design of hillside structures that
step back with the slope of steep hillsides but would not alter the
maximum building height in any zoning districts; and
NOW, THEREFORE, BE IT RESOLVED that the County Planning Commission
recommends to the Board of Supervisors APPROVAL of the Ordinance
Code Amendment as presented on June 27, 1995, by the following vote
of the Commission;
AYES: Commissioners - Gaddis, Braxton, Hanecak, Straus,
Wong,Terrell.
NOES: Commissioners - None.
ABSENT: Commissioners - Richard Clark.
ABSTAIN: Commissioners - None.

SUBJECT: Ordinance Amending Building Height Measurement and
the Height and Size of Main and Accessory Structures
On this date, the Board of Supervisors considered the proposal to introduce
Ordinance 96-4, regarding building height measurement and the height and size of
main and accessory structures.
Dennis Barry, Community Development Department, presented the staff's
recommendations and the following speakers addressed the Board:
1 . Mike Stoll, Post Office Box 548, Crockett, CA;
2. Gregg Sherry, 650 Vinehill Way, Martinez, CA.
Following discussion by the Board, Supervisor Smith moved that the issue be
continued for at least three weeks.
Supervisor DeSaulnier seconded the motion.
The vote on the Motion was as follows:
Ayes: Supervisors Rogers, Bishop, DeSaulnier and Smith
Noes: None
Absent: Supervisor Torlakson
Abstain: None
The Board further discussed the matter, and the staff further clarified how
the Ordinance would change the way the height is measured.
IT IS BY THE BOARD ORDERED that the Hearing on the proposed Ordinance
96-4, regarding building height measurement and the height and size of main and
accessory structures is CONTINUED to February 6, 1996, at 2:oo p.m.

WHEREAS, on Tuesday, June 27, 1995, the Commission recommended
approval of the ordinance code amendment; and
WHEREAS, the County Planning Commission recommends to the Board of
Supervisors of the County of Contra Costa, State of California,
that the County Ordinance Code be revised to indicate accessory
buildings as subordinate in both size and use to the main building
on the same lot and restrict the overall height and size of
accessory structures, and, that the County Ordinance Code be
revised to change the definition of building height so that the
method of measuring building height will be changed to indicate
that height is measured vertically from grade to top of structure
directly above resulting in the design of hillside structures that
step back with the slope of steep hillsides but would not alter the
maximum building height in any zoning districts; and
NOW, THEREFORE, I.BE IT RESOLVED that the County Planning Commission
recommends to the Board of Supervisors APPROVAL of the Ordinance
Code Amendment as presented on June 27, 1995, by the following vote
of the Commission;
AYES: Commissioners - Gaddis, Braxton, Hanecak, Straus,
Wong,Terrell.
NOES: Commissioners - None.

I. INTRODUCTION
ZONING ORDINANCE - MAIN AND ACCESSORY BUILDINGS, County File #ZT 1-89:
This is a hearing to consider a proposal to amend the Contra Costa County
Ordinance Code in residential zoning districts to clarify existing regulations regarding
height and size of main and accessory buildings. This proposed Ordinance will
affect all of the unincorporated areas of Contra Costa County.
This item was continued from the June 6, 1995, County Planning Commission
hearing.
11. RECOMMENDATION
Staff recommends that the Planning Commission approve the proposed
amendments and make a recommendation to the Board of Supervisors that they
adopt an ordinance to effect the changes listed in attachment "A".
III. GENERAL INFORMATION
At the June 6, 1995 hearing, the Planning Commission declared their intent to
recommend zoning ordinance text changes regarding the method in which building
height is measured and restrictions to the height and size of accessory buildings.
The hearing decision was continued to allow staff to review the recommended
changes for consistency within the ordinance. Staff was also directed to look into
wording regarding 'grade' in terms of height measurement. Attachment A includes
all recommended changes.

ATTACHMENT A
Staff finds that the following ordinance code sections should be revised, corrected,
deleted or added as noted:
(1) Section 82-4.212 "Building, accessory". Change wording to indicate accessory
buildings as subordinate in both size and use to the main building on the same
lot, and restrict size to 500 square feet of floor area on lots less than 20,000
square feet, and 15 feet in height. Section 82-4.212 to read: Building
Accessory. "Accessory building" is a building the use and size of which is
clearly subordinate and incidental to that of a main building on the same lot.
The accessory structure shall meet the following conditions:
(a) No accessory structure shall exceed 500 square feet on lots less than
20,000 square feet and 600 square feet on lots greater than 20,000
square feet.
(b) No accessory structure shall exceed 15 feet in height.
(2) Section 82-4.214 "Building height". Change wording to indicate that height is
measured vertically from grade to top of structure directly above. Section 82-
4.214 to read: Building height. "Building height" means the vertical distance
