RECOMMENDED ACTION: 1) Reappoint Joan Kelley-Williams as the PIC Chair for a term ending December 31, 1996. 2) Reappoint Elaine Miyamori, Human Resource Manager, Great Western Bank to a Business Category position on the Private Industry Council for a term to 9/30/96. 3) Reappoint Eric Frank, Business Consultant, to a Business Category position on the Private Industry Council for a term to 9/30/97. II. FINANCIAL IMPACT: None; One hundred percent federal funds. III. REASON FOR RECOMMENDATION/ BACKGROUND: At its meeting of 12/18/95, the Contra Costa PIC members unanimously voted to recommend Joan Kelley Williams for appointment as PIC Chair for the 1996 calendar year. The PIC was authorized to appoint its own Chair, but recent state legislation moved that authority to the Board of Supervisors. Although there is some question about the legality of the State law, since it has not been formally challenged, this action will allow the Board to ratify the PIC selection and ensure we are in compliance with both Federal and State legislation. Mr. Frank has served the full 3 two year terms allowed by the PIC by - laws - under the PIC by-laws his term is continued until replaced. Although thR7P. This appointment would be an interim appointment until a replacement is selected. Elaine Miyamori is a similar situation, due to increased work commitments she has resigned effective the date a replacement is selected. Since State law requires PIC vacancies to be refilled within 60 days, the interim reappointment of Eric Frank and Elaine Miyamori is necessary to protect possible County liability and ensure the Contra Costa PIC is in compliance with State legislation. Both are residents of Contra Costa County, neither is a County employee, Mr Frank was first appointed to the PIC on 10/10/89, Ms. Miyamori on 10/6/92, during the last year Mr. Frank has attended 89% of PIC and PIC Committee meetings, Ms. Miyamori has attended 33% of PIC and PIC Committee meetings.
