SUBJECT: EMERGENCY CLOSURE OF CHILD DEVELOPMENT CENTERS
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
ACKNOWLEDGE and APPROVE the emergency closure of Children's Centers as set forth below
due to the loss of electrical power, heat, and telephone services which resulted from the severe storm
that struck Northern California:

II. FINANCIAL IMPACT: Approval of this Board Order may allow the County to escape the loss of
funds under Education Code Section 8271 and 8277.2 as set forth in California Department of
Education/Child Development Division Management Advisory 94-02(re) dated February 1994.
III. REASONS FOR RECOMMENDATIONS/BACKGROUND: The Community Services Department
operates Child Development Centers under contracts with the California Department of Education
to provide child care and State Preschool services to eligible families who work, are enrolled in job
training, or are seeking employment. The contracted dollars are earned through Child Days of
Enrollment, and when centers are closed, no enrollment is earned. State Department of Social
Services, Community Care Licensing requires that children's centers provide safe and healthful
environments for young children at all times of operation. The Community Services Department
found it necessary to close the centers listed above for the health and safety of the children and staff
because of emergency conditions created by the severe storm which disrupted utility services.
Centers operating without utilities would have placed the children at risk.
Approval of the emergency closure of the centers should allow the County to escape the loss of
approximately $14,500 of funding under Education Code Section 8271 and 8277.2.

The purpose of this Advisory, which supersedes Management ,Advisory 42.03 (rc), is to remind
agencies that Education Code Section 8271 provides against loss of funds for days of operation or
child days of attendance for conditions such as the recent earthquake in Southern California. It

Circumstances beyond the control of operatWg agencies include, but are not necessarily Iin-ited to:
1. Earthquakes;
2. Floods;
3. Fires;
4. Epidemics;
S. Impassable roads;
6. The imminer=of a major health or safety hazard,as determined by the local health
department or law enforcement agency;
7. A strife involving transportation services to children provided by a non-agency entity;
$. Incomplete facility renovations authorized by the Department of Education pursuant
to Education Code Sections 8277.1 and 82772.
Whenever an agency's days of operation or daily/hourly attendance is reduced for any of the above
reasons, that fact should be communicated to the Child Development Division (CDD) in the form
of a resolution adopted by the agency's governing board (or other entity for agencies not having
a governing board). The board resolution must clearly and fully describe the nature of the
emergency condition as well as its specific effect On program operation. Ia addition it should
include the dates on which piogram operation was :necessarily suspended or substantially reduced
because of the emergency condition The resolution alsb should include the daily attendance for

both certified and non-certified children for the week prior to the date operation was suspended
or reduced. Upon receiving the resolution, CDD will process the Worrnation to credit your agency
with days of operation or dayAours of attendance. Appropriations in subsequent fiscal yaars %ill
not be affected by the above unless it is jointly agreed upon by both the agency and the
Department of Education.
