On December 19, 1995 the Council adopted Resolution No. 194-95 specifying the ballot wording and establishing deadlines for the submittal of ballot arguments. Sincerely, Marie Sunseri City Clerk enclosures cc: Barbara Lee, Assistant Registrar of Voters Robert Ewing, City Attorney, Town of Danville 510 La Gonda Way Danville,California 94526-1722 (510)820-6337 RESOLUTION NO. 130-95 SUBMITTING THE REFERENDUM AGAINST ORDINANCE NO. 95-5 TO THE VOTERS ON MARCH 26, 1996 AND AUTHORIZING THE COUNTY CLERK- ELECTIONS LERKELECTIONS DEPARTMENT TO ADMINISTER THE CONSOLIDATED ELECTION WHEREAS, on July 5, 1995 The Town Council adopted Ordinance No. 95-5 rezoning property from P-1 to P-1 in conjunction with the proposed Shadowhawk II development; and WHEREAS, opponents of the Shadowhawk II project obtained sufficient signatures to qualify a referendum against Ordinance No. 95-5; and WHEREAS, the Town Council of the Town of Danville is authorized by law to place the referendum on the next regular election more than 88 days after adoption of this resolution and to take other necessary actions related to holding an election; and WHEREAS,those actions include authorizing the City Attorney to draft an impartial analysis of the measure, authorizing the City Clerk to receive ballot arguments and rebuttals to those arguments and authorizing the Election Department of the County Clerk's office to administer the election and conduct the official canvass of the ballot. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Danville that the referendum described above be submitted to the voters of The Town of Danville at a consolidated election on March 26, 1996; that the City Attorney prepare an impartial analysis; that the City Clerk receive ballot arguments and rebuttals and that the Election Department of the County Clerk's office administer the election and conduct the official canvass of the ballot. Box 8039 1666 North Main Street Walnut-Creek, California 94596 4 (510) 94375800 9§Printed on Recycled Paper i RESOLUTION NO. 95-76 A RESOLUTION OF THE WALNUT CREEK CITY COUNCIL CALLING A SPECIAL ELECTION TO VOTE ON A MEASURE SUBMITTED BY THE COUNCIL The City Council of the City of Walnut Creek does resolve as follows: Section 1. Call for a Special Municipal Election. Pursuant to Government Code Section 36508 the City Council hereby calls a special municipal election to be held in the City of Walnut Creek on Tuesday, March 26, 1996 for the purpose of voting on the question whether the City Treasurer should be appointed by the City Council. Section 2. Description of the Question to be placed on the ballot. The exact form of the question as it will appear on the ballot is as follows: "Shall the office of city treasurer be appointive?" Section 3. Establishment of Deadline for Argument Submission: Designation of Preferences if Multiple Submissions. Pursuant to Elections Code Section 9286, the City Clerk has established December 28, 1995 as the deadline for submission of arguments in favor of and arguments against the question. If more than one argument for or more than one argument against the question is submitted, the priorities set forth in Elections Code Section 9287 shall control. Section 4. Provision for Rebuttal Arguments. Pursuant to Elections Code Section 9285(b), the City Council of Walnut Creek hereby adopts the provisions of Elections Code Section 9285(a), allowing the filing of rebuttal arguments. The deadline for filing rebuttal arguments shall be January 8, 1996. Section 5. Consolidation of Elections. Pursuant to Elections Code Section 10403 the Board of Supervisors is requested to consolidate the municipal election called by this resolution with the statewide election held on the same date.
