SUBJECT: ADOPT THE ENGINEER'S REPORT FOR THE COUNTYWIDE LANDSCAPE DISTRICT AD
1979-3 (LL-2); ZONES 19 AND 29, MARTINEZ AND OAKLEY AREA.

Specific Request(s)or Recommendation(s)&Background&Justification
I. Recommended Action:
ADOPT the Resolution confirming the Engineer's Reports annexing Subdivision 7144 to Zone 19 (Martinez
area) and Development Plan 3022-94 to Zone 29 (Oakley area) of the Countywide Landscape District and
levying the first annual assessments.
II. Financial Impact:
Formation and annexation of the proposed zones to the Countywide Landscape District (LL-2), and the
assessments for Fiscal Year 1996-1997,will raise funds to be used solely on maintenance work in each zone.
III. Reasons for Recommendations and Background:
The proposed annexation of Subdivision 7144 into the existing Zone 19,and Development Plan 3022-94 into
the existing Zone 29, of the Countywide Landscape District is necessary to implement a requirement of the
Conditions of Approval for new developments, which require the inclusion of the subdivision within the
Countywide Landscape District. This action will provide the funding mechanism for maintaining and
servicing landscape and irrigation facilities constructed as part of the subdivision improvements. The
assessments will be levied in the upcoming Fiscal Year 1996-1997. The amount of the first year levy will
be no more than the amounts described in the Engineer's Report,and,in some cases,may be less the first year
if all the landscape improvements have not yet been installed.
On,January 9, 1996,it was determined that the activity is not subject to the California Environmental Quality
Act(CEQA)pursuant to Section 15061(b)(3) of the CEQA Guidelines.
IV. Consequences of Negative Action:
Funds will not be available for maintaining the landscaping and other improvements in the zone.

TO BE MAINTAINED
Zone 19 - Subdivisions 6769, 7820 and 7144
Landscaping improvements consists of maintaining landscaping and irrigation facilities along
Reliez Valley Road and Hidden Pond Road.
Landscape improvements, along the frontage of Reliez Valley Road, total approximately 1,500
linear feet. Landscape improvements along the frontage of Hidden Pond Road total approximately
1,000 linear feet.

METHOD OF APPORTIONMENT
OF ASSESSMENT
FISCAL YEAR 1996-1997
The assessments for Zone 19 (Subdivisions 6769 and 7820) will be
apportioned equally to all lots or parcels within the zone benefiting from
the landscape improvements. Method of apportionment of assessment
of parcels 365-160-025, 365-160-026, and 365-160-027, will be based
upon what the ultimate parcelization will be for these three parcels.

SUBJECT: Confirmation of Engineer's Reports, Formation of Landscaping Zones, Annexation
to the Countywide Landscape District and Levying First Annual Assessment, for
Subdivision 7144 and Development Plan 3022-94.
The Board of Supervisors of Contra Costa County RESOLVES THAT;
Pursuant to the Lighting and Landscaping Act of 1972,the owners of the land within the area
known as Zone 19 having requested that Subdivision 7144 and Zone 29 having requested that
Development Plan 3022-94 be included within the Countywide Landscape District and be assessed
annually for the cost of maintaining those improvements described in the Engineer's Reports and,
the owner having waived the right to notice and public hearing,on the annexation to the Countywide
Landscape District and the levying of the first annual assessment; and
The Board also finds that the engineer of work, in the Engineer's Report, has fairly and
properly apportioned the cost of maintaining the improvements to each parcel of land in Zones 19
and 29 in proportion to the estimated benefits to be received,and the annual assessment as described
in the Engineer's Reports is a range of assessments with the maximum amount to be assessed per
parcel and to be levied on the Fiscal Year 1996-1997 tax rolls.
NOW THEREFORE BE IT RESOLVED THAT, the Board of Supervisors ADOPTS the
Engineer's Reports, and
ORDERS the annexation of Subdivision 7144 to Zone 19 and Development Plan 3022-94
to Zone 29 of the Countywide Landscape District(AD 1979-3, LL-2), and the levy and collection
of the first annual assessment for Fiscal Year 1996-1997.
