SUBJECT: ADOPT THE ENGINEER'S REPORT FOR THE COUNTYWIDE LANDSCAPE DISTRICT AD
1979-3 (LL-2); ZONES 62 AND 64, EAST AND WEST COUNTY AREA.

Specific Request(s)or Recommendation(s)&Background&Justification
I. Recommended Action:
ADOPT the Resolution confirming the Engineer's Report, forming the landscaping zone, annexing to the
Countywide Landscape District and levying the first annual assessment for Zones 62 and 64.
II. Financial Impact:
Formation and annexation of proposed Zones 62 and 64 to the Countywide Landscape District(LL-2) and
assessments for Fiscal Year 1996-1997 will raise funds to be used solely on maintenance work in the zones.
III. Reasons for Recommendations and Background:
The proposed formations of Zones 62 and 64 is to implement a requirement of the Conditions of Approval
for new subdivisions,which require the inclusion of the subdivision area in Countywide Landscape District
(LL-2)for a funding mechanism for maintaining and servicing landscape and irrigation facilities constructed
as part of the subdivision. The assessments will be levied in the upcoming Fiscal Year 1996-1997. The
amount of the first year levy will be no more than the amounts described in the Engineer's Report, and in
some cases may be less the first year if all the landscape improvements have not yet been installed.
On January 9, 1996,it was determined that the activity is not subject to the California Environmental Quality
Act(CEQA)pursuant to Section 15061(b)(3) of the CEQA Guidelines.
IV. Consequences of Negative Action:
Funds will not be available for maintaining the landscaping and other improvements in the zone.

SUBJECT: Confirmation of Engineer's Report, Formation of Landscaping Zone, Annexation to
the Countywide Landscape District, and Levying First Annual Assessment,
Subdivisions 7640 and 7661, Zones 62 and 64, East and West County Areas.
The Board of Supervisors of Contra Costa County RESOLVES THAT;
Pursuant to the Lighting and Landscaping Act of 1972, the owners of the lands within the
area known as Zones 62 and 64, having requested that Subdivision No's. 7640 and 7661,
consecutively,be included within the Countywide Landscape District and be assessed annually for
the cost of maintaining those improvements described in the Engineer's Report and, the owner
having waived the right to notice and public hearing on the formation of Zones 62 and 64,
annexation to the Countywide Landscape District and the levying of the first annual assessment;and
The Board also finds that the engineer of work, in the Engineer's Report, has fairly and
properly apportioned the cost of maintaining the improvements to each parcel of land in Zones 63
and 64 in proportion to the estimated benefits to be received,and the annual assessment as described
in the Engineer's Reports is a range of assessments with the maximum amount to be assessed per
parcel and to be levied on the Fiscal Year 1996-1997 tax rolls.
NOW THEREFORE BE IT RESOLVED THAT, the Board of Supervisors ADOPTS the
Engineer's Report, and ORDERS the formation of Zones 62 and 64 and annexation to the
Countywide Landscape District(AD 1979-3, LL-2), and the levy and collection of the first annual
assessment for Fiscal Year 1996-1997.
