HomeMy WebLinkAboutMINUTES - 02271996 - D5 r f D. 5&D. 6 A BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on February 27. 1996 by the following vote: AYES: Supervisors Rogers, Smith, DeSaulnier, Torlakson and Bishop NOES: None ABSENT: None ABSTAIN: None ----------------------------------------------------------------- ----------------------------------------------------------------- SUBJECT: Hearing on Appeals of Dame' Construction Company and Shadow Creek Residents Association Relative to DP-3003- 95 and DP-3004-95, Bettencourt Ranch, Danville/Tassajara Area. On February 6, 1996, the Board of Supervisors continued to this date the hearing on the appeals of Dame' Construction Company (Appellant and Applicant) and Shadow Creek Residents Association (Appellant) , from the decision of the San Ramon Valley Regional Planning Commission on the application (3004-95) of Bettencourt Ranch Residents Association (Owners) to modify the Final Development Plan (3034-88) and Vesting Tentative Map 7188 for Bettencourt Ranch, Danville/Tassajara area; and the hearing on the appeals of Dame' Construction Company (Appellant and Applicant) and Shadow Creek Residents Association (Appellants and Owners) from the decision of the San Ramon Valley Regional Planning Commission the application (3003--95) to modify the Final Development Plan (3010-86) for the Shadow Creek Project to allow for the realignment of an approved road alignment (Fleetwood Road) through Parcel A of Final Map 7041, Danville/Tassajara area. Victor Westman, County Counsel, presented the staff report on the issues that the Board on February 6, 1996, had requested be addressed. Supervisor Bishop questioned staff on the issue of access . Supervisor Rogers requested clarification on the landscaping. Supervisor Torlakson requested clarification on the bonds for landscaping. Dennis Barry, Community Development Department, responded to the requests . The following persons appeared and gave testimony: Bob Jensen, 200 South Ridge Court, Danville, representing homeowners on South Eagles Nest and South Ridge Court; Servando DelaTorre, 4484 Fleetwood Road, Danville; Sean B. Absher, Miller, Starr and Regalia, one Kaiser Plaza, Ste. 1600, Oakland, representing the Bettencourt Ranch Association; Julia Durmis, 807 Buckingham Place, Danville; Bob Perussina, 842 Buckingham Place, Danville, representing the Bettencourt Ranch Homeowners' Association; Richard H. Case, 1159 Cheshire Circle, Danville; Sheila Savage, 4484 Fleetwood Road, Danville; Bruce Holt, 4430 Fleetwood Road, Danville; Tom Mulvihill, 4490 Fleetwood Road, Danville; Nancy Mulvihill, 4490 Fleetwood Road, Danville; Rich Gorman, 5000 Executive Parkway, San Ramon, Bryan and Murphy, representing Dame'. Construction; John M. Compaglia, 5000 Executive Parkway #125, San Ramon, representing Dame' Construction; Michael Rupprecht, 2070 San Ramon Valley Boulevard, San Ramon, representing Dame' Construction. The Board discussed the matter. Following discussion, the Board of Supervisors EXPRESSED concurrence to CONTINUE to March 12, 1996, at 2 p.m. , in the Board Chambers, the hearing on the appeals of Dame' Construction Company and Shadow Creek Residents Association from the decision of the San Ramon Valley Regional Planning Commission relative to DP 3003-95 and DP 3004-95, Bettencourt Ranch, Danville, Tassajara area; and REQUESTED staff to prepare and return for Board consideration on March 12 , 1996, alternative findings for issues including access, landscaping, and location of three lots, and to address concerns raised by Board members today.
