Development for Emergency Housing Assistance Program(EHAP) Grant
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDATIONS:
AUTHORIZE'William Walker, M.D., Health Services Director, to sign the attached letter
providing indemnification and saving and holding harmless the State of California,
Department of Housing and Community Development from liability by the Health Services
Department for the EHAP-Grant. This attached letter has been reviewed and approved by
Risk Management.
II. FISCAL IMPACT
None.
III. BACKGROUND/REASONS FOR RECOMMENDATIONS
The State of California, Department of Housing and Community Development has awarded
an Emergency Housing and Assistance Program (EHAP) Grant to the County of Contra
Costa for emergency,shelter operating expenses at the Brookside and Central County Shelters
and for site rehabilitation at the Brookside Shelter and Mt. View House. The State requires
the County to provide liability insurance and property insurance as a condition of our
contract.

RE: EHAP Grant: Brookside Shelter, Central County Shelter, and Mountain View House
The County of Contra Costa has been self insured for all liability risks including medical malpractice
and worker's compensation arising from its operations, owned property, equipment and leased
property and equipment since 1976. The County's self insurance program provides for the legal
defense of officials and employees pursuant to Government Code Sec. 825 and payment of all sums
which it is obligated to pay by reason of liability imposed by law arising from their acts or failure to
act,excepting exemplary or punitive damages. This protection covers services performed by officers
or employees within the scope of their official duties in accordance with the conditions of their
employment or services. With respect to workers' compensation benefits, the County provides
workers' compensation to all of its employees as required by California State Compensation laws.
The self-insurance programs are prefunded to provide funds for payment of claims.
Indemnification.By unanimous vote of the Board of Supervisors at their regular meeting of February
13,. 1.996, the County shall defend, indemnify, save and hold harmless the State of Califoriva,
Department of Housing and Community Development from any and all claims, costs, and liability for
any damages, sickness,death,or injury to person(s)or property arising directly or indirectly from or
connected with the operations or services of the County or its officers and employees, save and
except claims or litigation arising through the sole negligence or sole willful misconduct of the State
of California, Department of Housing and Community Development.

The County will make good to and reimburse the State of California, Department of Housing and �•
Community Development for any expenditures, including reasonable attorneys' fees the State may
make by reason of such matters and, if requested by the State, will defend any such suits at the sole
cost and expense of the County.
