County Committee to develop a scope of work and the estimated costs of a study on
EBMUD rates for subsequent presentation to both Boards.

Dear Mr. Smith:
Thank your for your August 29, 1996, letter to President Clinton
requesting that an independent Federal agency conduct a threat
assessment for the planned foreign spent nuclear fuel shipments through
the Concord Naval Weapons Station and on to the Idaho National
Engineering Laboratory.
Shipments of spent nuclear fuel and other radioactive materials have
been made in this country and throughout the world for over 40 years.
The Department of Energy is part of an expert and sophisticated network
of national security agencies throughout the Federal Government that
conduct such shipments in a manner that protects the public and the
environment.
Prior to the movement of any spent fuel , Federal- law requires that a.
security plan be developed by the shipper and the Department of Energy
receiving site. The security plan is part of a larger transportation
planning process for these shipments which involves input from
appropriate state and Federal law enforcement official's.
The Department i.s working closely with the Federal Bureau of .
Investigation, '(FBI) in planning for the foreign research reactor
shipments. The local FBI office in the Bay--:area, other appropriate
Federal agencies (e.g. , U.S. Nuclear Regulatory 'Commission and the U.S.
Department of Transportation) , and law enforcement officials from Contra
Costa County were included in the Western Governors Association's
Foreign Research Reactor Spent Fuel Planning Meeting on September 25-26,
1996. Part of the discussion during this meeting included security
matters and the roles and responsibilities of the various levels of
government.
You are correct that the Department has planned an assessment of the
threat environment for these foreign research reactor shipments. In
doing this, the Department works closely with the FBI, the Department of
State, the Central Intelligence Agency, and other agencies involved in
anti -terrorism intelligence. The assessment is completed as close to
the shipment date as possible. Please be assured that the assessment is
the combined effort of the appropriate Federal , state., and local
security agencies. The Department has neither the capacity nor the
jurisdiction to complete a threat assessment on its own.

The Department of Energy and all other Federal security agencies will
also work with your County's security personnel to develop the
appropriate documents required prior to any shipments of spent nuclear
fuel through your County.
