The county parcel number is 357-102-010-0. On November 13th, Mr.Connaughton left a message on our answering machine that stated the work on the street and curb had been issued for bid,the contract awarded to Mr. Steve Kindall,and that work on the project would begin on November 14th. This issue has been in contention since the original request to repair was issued on March 19, 1996. Enclosure(1)and (2)are copies of a letter,and the list of contractors I have contacted in an attempt to get this work done. At the time,I was under the belief that I was totally responsible for the project. I no longer believe this to be true. During the process of trying to resolve the drainage issue I have spoken to contractors, Mr. Thompson of the R 10 committee, neighbors on Lake Street,Marcia Keef Attorney at Law, and,while my husband was at the property, he spoke with a county public works person that came out to view the problem,who said he wasn't sure the area where the tree is located was even my property. Unfortunately,we did not get the name of this individual. It is interesting that the chosen contractor is one that was called by me,and stated that he would not do the job because of the redwood tree. It now seems that the county, after being adamant with me about how the repair should be enacted, has changed the method of accomplishment to the extent that the contractor who originally would not attempt the job is now willing to do it.It is my understanding that the majority of the$2,000 bid for the repair is to the street and not to the curb that I was told is my responsibility. I do not believe as a home owner that I should be held responsible for repairs to the.street. It has been brought to my attention that the county has discussed plans to tear up and do major repair work to Lake street. I have also been advised that a repair patch could be done which would result in a much lesser cost that would accomplish the needed result of correcting the drainage.I have also been told that the original request was for the county to put a catch basin at the end of the street. This is'why I object to being told by Mr.Connaughton that"you will be billed for the job", and hope that you agree that the billing is unjustified. Since March I have made phone calls to the Public Works department that have not been returned. From March 19th,until their letter of August 8th,received by my Mother-in-law on August 14th,and responded to by me on August 19th there has been no contact from the county.My letter and request of August 19th to Mr.Tom Borman has never been responded to.A letter was sent,at the end of October,to the Rodeo address but I was in Virginia on Government business and was unable to act timely on a response. Now before the county and our family have had a chance to look at all methods of resolution, Mr. Connaughton has issued a contract and is ready to proceed. I am as concerned as the Recreation Committee that the erosion be corrected the home that sits atop the hillside that is eroding, was built by my grandfather in 1945,I was born and raised in it,and my hope is to retire there.My husbands elderly mother currently resides there. It is because of this,and my desire to resolve the issue,that I ask you to consider my request for time to appear before the board to personally speak to these issues or that a meeting be setup between the board,public works staff,the R-10 chairman, and the Supervisor for District 2 to discuss the issue. I also respectfully request that the Clerk of the Board call me to advise when this matter can be added to the agenda. Thank you in advance for the attention given my requests. (i j '. "}ilt:ac".or 1,'Jti.i� Dear Mr. Borman: This letter is being written in response for request of compliance with the above reference. Our phone call and message of 15 August to Mr. Geoff Eukel has not been returned. While I realize that the county has granted us one extension already, we are requesting an additional extension to the completion date. Your certified letter was received on 15 August. On that date I called (14) contractors and cement repair companies. Of the ones called; (7)returned my call. Of the (7), (4) came out to the residence, (3)made appointments and did not show, (1) said he would send a written estimate that has not yet been received. Of the (4) that showed up, (3) said they would not attempt the project due to the possibility of endangering the property,with the hazard of 50+foot California Redwood tree that may topple onto the house by cutting the root_ On 19 August I called Birds of a Field Tree Service, and they will be coming out to the property to assess the issue of possible damage to the tree. This is a unique situation in that the curb is at the end of a dead end street, next to a chain locked cyclone fence, there is no foot traffic or motor vehicle tragic. The only person parking there is my husband on Wednesdays when he visit his aged mother that lives in the residence. As to the drainage, the back section of the curb and gutter is higher so that the water is draining toward my driveway and not down the hill toward the school that I believe lodged the complaint that the water is damaging their hill. In fact, if the school had tended their hill side, their erosion problem would not have developed to the condition that now exists. One of the contractors suggested that perhaps I and the county could relook at the situation and see if there is another alternative to fixing the way that the curb and gutter is situated so that all will be accommodated. I will be willing to work with the county if this is possible. Enclosure (1) is a list of the contractors we have called. Additionally, with the known factors of-possible property damage to my home, I will be seeking legal advise as to the liability of die county if this project is completed widiout iving due respect to all possible solutions.
