Weir, County Clerk-Recorder By: Sue Olvera, Elections Processing Supervisor Subject: APPOINTMENT IN-LIEU OF ELECTION Date: November 22, 1996 California Elections Codes Section 10515 (copy attached) states that if no one has been nominated or an insufficient number of persons has been nominated to fill an office or offices, and a petition signed by 10% of, or 50, voters (whichever is the smaller number) has not been submitted,the election official shall certify this fact to the Board of Supervisors. Also California Election Code 10515 b (copy attached) states that if no person has filed a declaration of candidacy for any office, the supervising authority shall appoint any person to the office who is qualified on the date when the election would have been held. These appointments shall be made at a regular or special meeting of the Board of Supervisors by December 3, 1996. Attached is a listing showing appointments to be made.
