SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
1. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated October 16, 1996, from
Caroline Investment Company.
B. AUTHORIZE the Chief Engineer to execute said Right of Way Contract on behalf of the
District.
C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to
issue a check for $5,000 payable to Chicago Title Company, 590 Ygnacio Valley Road,
Suite 300, Walnut Creek, CA 94596, Escrow Number 76065, to be-forwarded to the Real
Property division for delivery.

D. DIRECT the Real Property Division to have the above-referenced Grant Deed recorded
in the Office of the County Recorder.
II. Financial Impact:
Payment of$5,000 from Drainage Area 56 funds.
III. Reasons for Recommendations and Background:
These property rights are required for the East Antioch Creek project, part of the East Antioch
Creek Watershed Area Drainage Improvement Plan. The marsh between Wilbur Avenue and
Cavallo Road will be cleaned up and opened to increased tidal water flow preserving and
enhancing the riparian habitat. Over time, the project will result in the reversion of the existing
freshwater marsh to a more natural saline marsh.
IV. Consequences of Negative Action:
The District will be unable to protect and preserve this valuable environmentally sensitive habitat.

A portion of the northwest quarter of Section 19, Township 2 North, Range 2 East, Mount
Diablo Meridian, being a portion of that parcel of land described in the deed to L. E.
Silverton recorded October 6, 1961 in Volume 3968 of Official Records at page 563, more
particularly described as follows:
Commencing at the north quarter corner of Section 19 (T2N, R2E); thence along the north
line of Section 19, north 89°29'35"west 175.00 feet, to the northeast corner of that parcel
of land described in the deed to George Curtis et al. recorded July 15, 1982 in Volume
10853 of Official Records at page 533, thence along the east line of said Curtis parcel,
south 00026'52" west 31.00 feet, to the Point of Beginning at the most western corner of
that parcel of land described in the deed to the City of Antioch recorded November 3, 1961
in Volume 3987 of Official Records at page 380; thence from the Point of Beginning along
the boundary of said City parcel as follows: 1) south 89029'35" east 61.82 feet to a curve
concave to the southwest having a radius of 25.00 feet, 2) along the arc of said curve
easterly, southeasterly, and southerly 35.40 feet through a central angle of 81 008'06" and
3) south 08021'29" east 281.21 feet to the north line of Block 4, River View Terrace filed
February 25, 1907 in Book B of Maps at page 43; thence along said north line, north
89°29'35"west 129.55 feet, to the southeast corner of said Curtis parcel (10853 0.R. 533);
thence along the east line of said Curtis parcel, north 00°26'52" east 299.00 feet, to the
Point of Beginning.
Containing an area of 31,717 square feet (0.73 acres) of land, more or less.
References to maps, boundaries, and ownership are to records of Contra Costa County,
California. Bearings are based on the California Coordinate System Zone III (CCS27) with
south 89°29'35"east being taken as the bearing of Wilbur Avenue centerline as shown on
the map entitled "A Precise Section of the Streets and Highways Plan, Contra Costa
