RECOMMENDATION A. APPROVE Third Amendment authorizing extra work under the Consulting Services Agreement dated October 9, 1995 with O'Brien-Kreitzberg, Inc. for project management and inspection services for fire damage repair at County court facilities, 640 Ygnacio Valley Road, Walnut Creek; 1950 Parkside Drive and 2970 Willow Pass Road, Concord; and 725 Court Street, Martinez. The Third Amendment increases the scope of services and increases the Payment Limit, as modified by the First and Second Amendments from $60,800.00 to $73,800.00. B. AUTHORIZE the Director of General Services to execute the Third Amendment to the consulting services agreement, and to issue written authorizations for extra work, in addition to the authorization for Amendments No. 1, No. 2 and No. 3, provided that the cumulative total extra cost for such additional authorizations shall not exceed $10,000.00. H. FINANCIAL IMPACT Funding for the services is being provided by insurance proceeds. III. REASONS FOR RECOMMENDATIONS/BACKGROUND A. By Resolutions dated September 12, 1995 and September 19, 1995, the Board delegated to the Director of General Services authorization to proceed in the most expeditious manner to repair fire damage at the court facilities enumerated above. Under that authority, the Director of General Services("Director") retained O'Brien-Kreitzberg, Inc. to assist in management and inspection of the repair projects. Also, the Director issued two amendments to the original consulting services agreement to continue services through completion of the repair work and to add services required for review and approval of contractor's applications for payment after the public works contracts for repair work were complete. The agreement and amendments were reported to the Board and documented by Board Resolutions issued periodically pursuant to Public Contract Code Section 22050. C. In Resolutions dated January 16, 1996 and May 21, 1996 the Board determined there was not a need to continue the emergency actions related to repair of the fire damage court facilities. D. However, claims and invoices for services and building contents damaged or destroyed by the fires, as well as for building repair work, have continued to be received and reviewed with the consultant's assistance. The insurance adjuster has requested explanations,justifications and documentation that certain County claims are lire-related and appropriate. This amendment to the consultant's agreement will permit that review and documentation process to be pursued and completed in a timely, efficient manner. IV. Pusose: On October 9, 1995,the parties entered into a contract entitled "Consulling Services Agreement," relcrred to as the "Agrecn)cnt,"which covers project management and inspection services related to lire damage repair at lour court facilities in Walnut Creek,Concord and Martinez, The Agreement has previously been amended as hollows to modify the scope of services,to increase file payment limit,and to change the completion data Amendment No. 1 dated March 4. 1996 and Amendment No. 2 dated May 14, 1996.
